Guthrie moved, Kullberg'seconded, ithat' the Hiinutes of the Regular Meeting of June 17, 1974, be approved. Motion, Ayes (7) - Nays (0).. The Chairman opened the public hearing concerning the request of Emil Shenkyr for a street vacation of Oak Place between Lots 14 & 15, Block 7, and Lots 13- 14 -15 -1 Block 6, Saga Hill, to anyone who wished to be heard. When nobody appeared, the hearing was closed. Since the street has been mostly vacated at rior meetings and the remainder served no public function, Van Nest moved, Kullberg seconded, that the street be vacated. 14otion, Ayes (7) - Nays (0) . Torangeau - Garage Setback Variance Mrs. Arthur Torangeau represented the above in a petition to replace a 65 year old garage in the same site as the original -- namely, 31 from one side and 3' from the rear. The adjacent residence to the rear, Richard Stinson, has no objection to the setback to the rear, in fact, was in favor as it acts as a buffer between the two residential back doors. The property to the side is owned by Paul Fahlin, who has no objection. The - hardship involved, as shown in numerous photos, is that any other placement would involve removal of mature trees and landscaping and a change in driveway. 'urtis moved, Kallestad seconded, that the variance be approved. Motion, Ayes (7) - Nays (0) . 7:30 P.M. MINUTES PUBLIC HEARING Street Vacation Oak Place VARIANCE 2060 Central Avenue MINUTES OF A REGULAR MEETING HELD JULY 15, 1974 Robert Bathke represented himself in an application for a building permit. The Building Inspector read a memo to the Administrator, now on file, giving the sequence of action taken from August 1,, 1971 to the present. Also shown, and on file, is the list of people requesting the permit be denied. Attorney Jerome Rice, representing these people, stated that on account of the lagoon on the property, the lot could not be built on without•a variance. He also showed there were private easements for viewing and walking across the property granted to the property at 2610 Mapleridge Lane, when Chris Dahl, the owner of this property and 2610 Mapleridge Lane, sold the residence at 2610 zapleridge Lane. Members reminded Mr. Rice that the City did not have to honor private covenants. On studying the plat, it was felt that the lot was buildable without granting a variance; also, that the only hardship shown had to do with the private easements. Curtis moved, Kallestad seconded, that no variance to the 75' setback required be granted and owner should produce a new site plan to conform to existing regulations. Motion, Ayes (7) - Nays (0) . William Dickey and his engineer showed the plat of the proposed Farview subdivision. Brought out was that the Lake Minnetonka Conservation District has a moratorium on multiple use of docks on properties serving more than the owner. Mr. Dickey stated they would abide with any regulation the L.M.C.D. might come up with after their study. Sian Nest felt that regardless of the L.M.C.D. multiple use of the outlot should be forbidden. The Chairman read the engineer's report and recommendation on drainage for the sub- division. Engineer Willis stated the geodetic map did not show wetlands for the area. Van Nest stated the Hickock water study showed that Maxwell Bay as atrophic and the area around it had one of the fastest runoffs, stated at 199.7 cu. ft. per second in heavy rains. He felt with some added cost more water could be diverted to French Lake than Shown on the plat plan. Van Nest felt that the area should be kept as much as possible in its natural state.and that the road near Leaf Street as proposed would affect runoff contrary to engineer's report. (Continued) Page 2 BUILDING PERMIT 2605 Mapleridge Lane SUBDIVISION Farview - Fox Street & Old Crystal Bay Road 14INUTES OF A REGULAR MEETING HELD JULY 15, 1974 Mr. Dickey stated that to come up with any plan to get both a good configuration and the required two acre lots, it is necessary the street be placed as shown. Curtis asked why the configuration could not be changed allowing some slightly smaller and larger lots than the zoning requirements. Gasch moved, Hake seconded, that a public hearing on the matter be held before the Planning Commission on July 29, 1974 at 7:30 P.N, in the Council Chambers. Van Nest placed an addendum strongly opposing any multiple dock use of the outlot. Motion, Ayes (7) - Nays (0) . Kallestad left the meeting. Nessrs. Hawley and Ewald represented North- western Bell Telephone Company in a petition to construct a garage to the rear of their present site. Van Nest stated that contrary to the zoning maps, the legal description in the zoning code showed that only the front 250' of this property was zoned B -1 under the present zoning and the new zoning would be different than the present zoning. Gasch moved, Curtis seconded, to table the matter until the City Engineer prepares a report on the impact of the new zoning on the construction; also, what impact Municipal Ordinance No. 125 would have on grading and filling as proposed. Motion, Ayes (6) - Nays Messrs. Shafer and Beckstrom represented Van Dale in an application to construct a warehouse on property zoned "I" to the west of the present structures. Site plans showed two new entrances on Old Crystal Bay Road and retention of the present driveway on Wayzata Boulevard. Gasch was of the opinion this might be an aid to getting .a much- needed semaphore on that intersection. Van Nest quoted the new zoning showing 20% of any surface must be other than metal and 40% of other than metal on front and any side facing residential. This would be the north and west sided.. (0) . Structure conform to new zoning 2. Engineer submit a drainage report 3. Landscaping plan be produced and bond posted to insure installation according to plan Notion, Ayes (6) - Nays (0). Thomas Betz represented himself in a petition to vacate a City lake access, Lake Street and G.1so part of County Road #84. Three years ago, i:_lleeiedly due a surveyor's error, he found he had const - =ted a residence in,such a manner as to encroach on County Road #84 right -of -way and the City Lake Street. The County Road #84, through usage, has moved away from his house. The County will vacate sufficient right -of -way to the City which in turn would have to give it to Betz. He proposed to exchange another 30' access for the acquisition of 30' of Lake Street. G<asch moved, Guthrie seconded, to have the City Attorney investigate the ramifications in such a transaction and report to the - ommission before the August 19, 1974 meeting; also, a public hearing on the matter to be ordered.for that date. Van Nest added the attorney should investigate the vacating of all platted land presently under water. Motion, Ayes (6) - Nays (0) . Members studied Roy Starkey's proposed division of two parcels of land from a five -acre tract. Members could see no need for a 50' public road dedication since the property to the north abuts Wayza•ca Boulevard. They proposed that he dedicate a 50' Drivate easement along the present driveway to the property in the rear and move the division line as close to the residence as legglly possible and grant a variance if it is close to the two -acre -roposed zoning. Furthermore, that 11-r. Starkey bring in a plat made by a registered surveyor showing exact dimensions and square foot computations. Page 4 BUILDING,PERMIT Van Dale (Continued) STREET VACATION 3775 Bayside Road DIVISION Starkey 3546 Sixth Avenue North MINUTES OF A REGULAR MEETING HELD JULY 15,1974 Page 5 Members discussed the chain of officials in C014MITTEE OFFICIALS the committee, calling for a chairman, a vice chairman, and a Council liaison officer. The chairman would serve a six -month term then step down to be liaison officer. The vice chairman would automatically step into the chairman seat; thus, the only appointment would be a vice chairman every six months.
