The Planning Commission met on the above date with the following members present: Acting Chairman Van Nest, Curtis, Kullberg, Guthrie, Elliott. Absent: Kallestad, Pesek, and Gasch. Guthrie moved, Curtis seconded, that the Minutes of the Regular Meeting of January 21, 1974, be approved. Motion Ayes (6) - Nays (0). ?11r. Dick Curtin, the attorney representing the pet- itioners, expressed his concern that the people that appeared at the Public Hearing for the restaurant did not truly represent the feelings of all of the people in the community. To emphasize this point, Mr. Curtin called on Mr. Straley (property owner) to present sev- eral petitions from the neighboring B-2 (Lakeshore Commercial) property owners, Orono business people, and the general public, all supporting the idea of the restaurant. In addition, Mr. Straley submitted a pet- ition of those favoring the issuance of a liquor lic- ense to the proposed restaurant. Several people in the audience rose to speak in favor of the restaurant project. Chairman Van Nest read a letter from Mr. Pillsbury, Chairman of the LMCD. Mr. Pillsbury's letter was in response to Orono's concern about the amount of boat traffic on the south shore of'Maxwe�ll Bay and the pos- sibility of rezoning some of the B-2 property to a residential land use to reduce the boat traffic. Mr. Pillsbury's letter did conclude that a moderate density zone would probably contribute less to boating density than marina expansion. sir. Gratwell, attorney for Mr. Straley, asked the Plan - ning Commission to consider the repercussions of re- zoning the lakeshore commercial property to some res- idential land use. If Orono decides to rezone the property to residential, Mr. Straley would lose a maj- or portion of his financial investment. K01 berg moved, Elliott seconded that the Planning Commission consider the restaurant application at the rezoning Public Hearing in March. The-motion was with - drao -:n. Kullberg moved, Elliott seconded that the variance and conditional use permit for a restaurant be approved, and in addition, the Council should modify the present liquor license ordinance to allow the issuance of a liquor license for this application in this B -2 zone. Liquor licenses should not, however, be issued in all B -2 zones. 111otion, Ayes (3),- Nays (3). Van Nest, Guthrie, and Gasch - Nay. :Offlrlissioner Gasch entered the Council Chambers at 9: 15 P. $"I. 8:22 P.M. 141nutes Restaurant Roelofs & Zeanchock MINUTES OF A REGULAR MEETING HELD FEBRUARY 12, 1974 Page 2 Commissioner Gasch expressed concern that Orono North Star Marina should not agree to allow a new structure for the Storage Building storage of boats before we know that the LMCD dock & Seawall ordinance will be upheld in court. Guthrie moved, KulJberg seconded that conceptual approval be granted for the variance and condit ional use, contingent on: (1) A landscaping plan, (2) An architecual plan, (3) A storm - water runoff plan, and (4) The assumption that the L14CD dock ordinance regulating the lengths of docks will be upheld in the courts. The motion was withdrawn. The Planning Commission directed commissioners Gasch and Kullberg to work with the staff in form- ulating conditions that should be part of a con- ceptual approval for the North Star request. This matter will be placed on the March 18, 1974, Plan- ing Commission meeting at which time a recommend- ation will be made. Mr. Terry Schnieder, the architect for I.D.S., I.D.S. presented plans for a 101,000 sq. ft. shopping Cty. Rd. 19 & 15 center and a 30,000 sq. ft. office building. The application involves the following: I. Shopping Center a) Rezoning from R -IC (I acre) to B -3 (shopping center) b) Rezoning from B -I (commercial) to B -3 c) Rezoning from B -I to R -IC d) Variance from existing setback re- quirements for the building e) Vacation and relocation of Kelly Avenue 2. Office Building a) A variance to allow a commercial parking lot in a residential zone b) A variance to allow a 30 ft. struct- ure with 3 floors exposed on some sides rather than the maximum al- lowed in the ordinance of 2 1/2 stories A public hearing on the request was scheduled for March 5, 1974, at 7:30 P.M. at the Church of the Good Shepherd. Mr. Hays application regarding a conditional use Charles Hays permit for a livestock farm was tabled until the livestock Farm petitioner presented more information. MINUTES OF A REGULAR MEETING HELD FEBRUARY 12, 1974 The Zoning Administrator informed the Planning Commission that the proposed sign ordinance was drafted last fall to correct some shortcomings of the existing ordinance. Since we will soon be working on an entirely new zoning ordinance, it was the Zon i nc; Adrii i n i strator I s recommendat i on to incorporate these revisions, and perhaps others, into a completely revised sign ordinance. The Planning Commission ordered a Public Hearing for the March 18, 1974, meeting for Mr. Holasek's greenhouse request. Mr. Starkey presented a plan to divide Parcel 5200 of Section 29 into 2 lots approxiamtely 2 1/2 acres in size. Mr. Starkey plans to pro- vide access to the rear lot with an easement. Chairman Van Nest expressed his concern with al- lowing subdivisions and not requiring public ac- cess, and perhaps there should be an ordinance revision which would require public access. A Public Hearing was ordered for the March 18, 1974, Planning Commission meeting regarding the Starkey division, and at that time, the Planning Commission should discuss the issue of public roads. Chairman Van Nest informed the Planning Comm- ission members that the Public Hearing for the rezoning of Orono would be on March 13, 1974, at the Orono High School Cafeteria, and if necessary the Public Hearing would be continued to ivlarch 20, 1974.
