Staff conducted a preliminary review based on the information provided and recommends the following items be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Certificate of Survey. The survey submitted dated June 30,2015 is not to scale and is not signed. Please submit two updated, full-size certificate of survey's which meet all of the City's survey standards. If any exterior/landscaping improvements, i.e. patios, grading, sidewalks, retaining walls, etc., are proposed and currently not shown on the survey, please have them added and provide the name of the person performing the work. Please note our engineer has not reviewed the survey,so additional comments maybe forthcoming. 2. Septic System/Sanitary Sewer. a. Our records indicate this property has a 5-bedroom home and which currently has two, 1,000 gallon septic tanks. According to City code section 58-50(2)(b),a 5-bedroom home must have a minimum of one, 1,250 gallon septic tank and one, 1,000 gallon septic tank, since this home doesn't meet the current minimum requirements,the septic system is considered non-compliant. City Code section 58- 47(b) states no building permit can be issued until a sewage treatment system is in compliance. Further, City code section 58-45(1)(a) states when a septic system is non-compliant and sewer is available, it must connect to city sewer. Copies of the City code sections are attached. b. In 2003 sanitary sewer was extended to this property. This is a pressure system which requires an E1 pump. Before a building permit will be issued, the property must connect to City sewer. A sewer connection permit is required along with the following fees to be paid prior to a building permit being issued. Copies of the 2015 fee schedule are attached. i. Sewer Availability Charge(SAC) passed through to MetCouncil $2,485.00 ii. 2003 Old Long Lake Road Sewer Project(2003-2) $9,130.00 3. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is$2,500. The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a check for$2,500. 4. Separate City Permits Required for: a. Pumping stations. In order to standardize installation and electrical connection methods,the following pumping station requirements must be met in addition to Minnesota Rules chapter 7080: 1. Electrical connection. i. A watertight,lockable electrical box must be mounted on a four-inch-by-four-inch treated redwood or cedar post. ii. All electrical connections shall be made within the box. Pump connection must not be made using a direct line(plug-in only).Wire entry to the electrical box shall be sealed with a watertight material such as foam or putty. iii. Alarm and pump floats shall be on separate electrical circuits. iv. Electrical wire from the power supply must not run over any tanks but must be laid beside the tanks and placed in conduit along the electrical post. v. Electrical cords from the pump and floats must be run through a two-inch PVC(or equivalent)conduit (schedule 80)with a one-inch gap between the conduit and the electrical box.Electrical cords must not run through or under the manhole cover.Wires must not have ground contact. about:blank 7/30/2015 Orono, MN Code of Ordinances Page 3 of 3 2. Pumping chamber. L Pressure pipe exiting the pumping chamber must be laid on a uniform slope up to the soil treatment area for proper drain back.The pressure pipe must be sleeved inside a larger diameter pipe for additional support if spanning ground that has been excavated. If the pipe at the tank must be lower than union to get elevation for drain back,a one-quarter-inch weep hole must be used. ii. Trenches.Trenches must meet Minnesota Rules chapter 7080. 2. Mounds and at grades. Mounds and at-grades must meet specifications per Minnesota Rules chapter 7080. (3) Compliance standards. a. A new system shall be located,designed and constructed as a code system. b. When an existing code system is repaired or expanded,such ISTS shall remain a code system.Compliant systems,when repaired,shall be upgraded to a code system status whenever such classification is reasonably attainable. (4) Construction procedures. a. Protection of drainfield area. Proposed drainfield areas shall be identified and marked off on the lot at the time of the site evaluation and prior to any construction or grading occurring in the area.The drainfield area shall remain undisturbed until drainfield construction is commenced. No vehicular traffic shall be allowed in the drainfield area either before or after drainfield installation. b. Favorable weather required. Drainfield area or trench construction must not proceed if the area is wet or has had rain within 48 hours.Mound or trench construction shall not proceed unless the soil moisture content is below the plastic limit. c. Construction inspection required.The contractor issued a permit for ISTS construction shall perform all work according to the design specifications approved by the city for each particular ISTS.All subsurface work, including building sewer,sewage tanks,distribution system and soil treatment area shall be inspected by the city inspector prior to backfilling or covering of any portion thereof.It shall be the responsibility of the contractor to notify the city at least 24 hours prior to the time an inspection will be required,and it shall be the responsibility of the contractor to ensure that the inspection is accomplished and the construction is approved prior to any backfilling,covering or continuation of the construction. If the building will be connected to an existing system,a site evaluation and design must be approved by the city,including the existing system specifications and a future site meeting the provisions of this article.A new residence must be connected to an ISTS meeting the definition of a code system. (b) Required upgrade or replacement.A sewage treatment system not meeting the requirements of Minnesota Rules Chapter 7080,as amended,or the requirements of this article,whichever is more restrictive,must be upgraded,at a minimum,at any time a building permit is required for any improvements on,or use of,the property,subject to the following: (1) Any such system for which the city has previously issued orders requiring upgrade or replacement of the system by December 31,2007,shall not be subject to this requirement until January 1,2008. (3) Regardless whether previous upgrade or replacement orders have been issued,this upgrade or replacement requirement shall not apply when said building permit is for regular maintenance or upkeep including but not limited to replacement of mechanical equipment such as air conditioning,furnaces,water heaters,or water softeners,or for re-roofing,re-siding or window replacement. (c) Construction of additional bedrooms or construction including water-using appliances that will increase the sewage flow into an ISTS.A building permit shall not be issued until the city confirms that the existing ISTS is compliant and of adequate size to treat the sewage flow from the building and that a future drainfield site is designed and preserved. If the existing ISTS must be repaired or replaced,an ISTS design for both the existing ISTS and a future drainfield site must be approved before issuing a building permit. If expansion or replacement of the ISTS is required,the ISTS must be installed and inspected before a certificate of occupancy shall be issued for the construction.Failure to identify satisfactory drainfield sites for the proposed sewage flow for use now as well as a future site shall result in the denial of the building permit application. (d) Expansion of an existing building including decks and patios,•construction of an accessory building,driveway or land alteration.A future drainfield site must be designed and preserved prior to the issuance of a building permit for any expansion of an existing building,construction to an accessory building or driveway or land alteration on a properly using an ISTS.A building permit will not be issued when the proposed work would preclude the use of the only future drainfield site approved by the city. As discussed in your letter,the septic system requirements,per the city of Orono, are not met at our property,due to the size of our septic tanks. This was not disclosed to us when we purchased our home in 2010,nor was it brought to our attention when we pulled permits for home renovations in 2012-13. In addition to that,our current plans do not change our septic/plumbing in any way,as the structure has no plumbing. Lastly,though we have a 5 bedroom house,we have only 4 occupants,for which our existing septic system is more than sufficient. Another Section of the letter states that we did not submit the escrow payment and signed agreement,however,we did sign the paperwork and submit the payment on July 15, 2015. The City of Orono cashed the check on September 17,2015. Please let me know if you have any questions or need anything further from us in order to proceed with the permitting process. Owners request the City to review this application which requires City approval and may require consultant legal and/or engineering review. 3. The City will commence its review of the application and incur costs associated with said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for under a building permit application. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to public property or infrastructure that is caused by the work(including planning, engineering, or legal consultant review) associated with building permit# jS_nn 7i I if compliance with the approved building permit is not accomplished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in tum send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'receipt of bill. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for eligible expenses the City has incurred. 5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow agreement two times per year to determine whether the requirements of the project have been successfully completed and whether it is appropriate to return the funds.
