It is my understanding that Dvorak, et al, is intending to sell Tract I with the existing house, and keep Tract J for the purported purpose of maintaining a dock. I want you to be aware of the following issues: 1. The City will oppose any sale of the two Tracts separately for the following reasons: a. Building permit #3026 was issued for construction of the residence on October 11, 1974 specifically based on Tracts I and J being combined to meet zoning lot area requirements. Permit#3022 was issued earlier that same day based on use of Tract I only, and then voided. A building inspector's memo of August 21, 1974 confirms this was the City's intent. b. The City assessed 1/2 sewer unit to each of Tracts I and J for the 1970 Saga Hill sewer project, Levy#5382. This is further evidence that the two parcels were intended to be used as a single entity. 2. The Orono Zoning Code since 1968 has prohibited the construction and use of accessory structures (including docks) without a principal structure on the property (See Section 10.03, Subd. 9(A) attached). If Dvorak retains Tract J without a principal residence structure, any dock on Tract J will be illegal, and the City will vigorously pursue its removal. I would refer you to a recent similar situation in which the Minnesota Court of Appeals upheld the City of Orono's right to enforce this ordinance (Richard Stodola vs City of Orono, 1994). 3. Tracts I and J together comprise approximately 0.75 acres in area. This area of Orono is zoned LR-1B requiring 1 acre minimum lot size. Given the history of the property Telephone (612) 473-7357 • FAX 473-0510 Betts Rogers July 15, 1997 Page 2 as noted above, it is highly.unlikely that variances would ever be granted to allow construction of a principal residence on Tract J,which by itself is approximately 0.4 acre in area. Based on the above,I would encourage you to avoid a sale that separates Tracts I and J.I would also urge you to advise the seller and potential buyer(s)of this information. Except in the case of Planned Residential Developments as provided for hereinafter, no more than one principal building shall be located on a lot except that staff may issue a permit to use a manufactured home that shall meet all required setback standards or an existing dwelling while a new principal structure is being constructed. Such permit shall be issued for a period of 3 months, any extensions must be approved by the City and shall expire upon issuance of a certificate of occupancy for the new structure and such structure removed. Source: Ordinance 26, 2nd Series Adopted: 7-14-86 Subd. 8. Lots to Face Streets. Each lot shall face on a public street or appropriate private easement. Subd. 9. Accessory Buildings. A. Time of Construction. No accessory building or structure shall be constructed on any lot prior to the time of construction of the principal building to which it is accessory. B. Height Restrictions. No accessory building in the "R" District shall exceed the height of the principal building, nor shall an accessory building exceed 30 feet in height. In all "R" Districts no accessory building shall exceed 1,000 square feet of footprint area except that accessory structures in excess of 11000 square feet will be allowed under the following conditions: 1. Not more than one Oversized Accessory Structure (OAS) shall be permitted on any property. An "Oversized Accessory Structure" is defined as an accessory structure of foot- print area in excess of 1 , 000 square feet, except that .the following non-roofed accessory structures which exceed 1,000 s.f. footprint area are not considered as "Oversize Accessory Structures", but are subject to the special setback restrictions of Section 10.03, Subdivision 14 (D): - Tennis courts - Pools , when pool basin structure (excluding non- encroachment-type patios) is greater than 1,000 s.f.
