Looking in the file on the house property,the letter of credit he thinks covers this work doesn't. He was supposed to escrow when he got a temporary CO to cover this. It appears what was covered by the letter of credit is done, so we could revise the development agreement to have it cover this, but we probably don't need $20,000. The thistle has shown signs of herbicide treatment however the reed canary grass (RCG) in the buffer does not appear to have been treated. He verified that the RCG had not been treated because the contractor providing the service did not now what it looked like. He has agreed to have another treatment of the RCG and thistle. I recommended using a selective herbicide such as Poast or Assure II on the RCG due to some native vegetation underneath the canopy of the RCG. He would like to get his CO but is willing to have the escrow maintained for the treatment necessary for the RCG in the buffer. Giving him his CO and maintaining the escrow seems reasonable to me if it works with the City.
