City Administrator Date: September 27, 2013 Subject: Hardcover Review per Revised Hardcover Ordinance In September 2012 the City Council adopted Ordinance 94, 3rd Series which made significant changes to the City's hardcover ordinances. Specifically relative to the situation at 1335 Tonkawa Road,the new Ordinance allows hardcover credit for the area of the 0-75' setback zone of lakeshore lots. While hardcover allowed within that zone is strictly limited,the additional creditable area adds to the overall hardcover allowed on lakeshore lots. A review of the hardcover on this property in 2003 after construction revealed excessive hardcover within the 75-250' zone, as follows: 0-75': 25 s.f. /11,582 s.f. =0.2% 75-250': 8,612 s.f. /25,897 s.f. in 75-250' zone= 33.3 %(25%allowed) Excess =2,138 s.f. 250-500': 323 s.f. /2,294 s.f. in 250-500' zone= 14.1 %(30% allowed) An in-house review of the hardcover numbers based on the 2012 code revisions yields the following: Total hardcover=25s.f. + 8,612 s.f. + 323 s.f. + 156 s.f. (Patio at 100%HC)=9,116 s.f. Total lot area= 11,582 s.f. +25,897 s.f. +2,294 s.f. =39,773 s.f. 9,116 s.f. /39,773 s.f. =22.9 % (25% allowed) Under the new ordinance, the property has a conforming hardcover percentage based on the 2003 hardcover observations. These changes were not approved with the property's Building Permit. The approved site plan had 24.95% hardcover where 25% is allowed. Since the Certificate of Occupancy was issued driveway, landscaping with fabric and patios have been added. There has also been fill added in the back corner of the lot up to the property line where a 5' setback is required. A fence has been added that is taller than permitted by city code. Fences are allowed to be 6' max height in certain locations. Fences are measured from existing grade. This letter is to require you to remove the excess hardcover and fill, and to lower the fence to 6' or less from existing grade. A deadline of October 14, 2002 has been established for compliance. If you have any questions please feel free to call me at my office Sincerely, 'T4 (Q4,v.— Lyle Oman Building Official LO/dml Enclosure Telephone(952)249-4600 • Fax(952)249-4616 www.ci.orono.mn.us MEMORANDUM To: Ron Moorse, City Administrator Greg Gappa, Public Services Director From: Mike Gaffron, Planning Director Date: March 18, 2004 Subject: 1355 Tonkawa Road, Michael Fasching -Hardcover Issue & Sewer Easement Proposal SUMMARY After obtaining a building pen-nit in January 2001 for a new home with a site plan meeting standard hardcover limits, property owner was issued a Certificate of Occupancy in January 2002, prior to construction of driveways, etc. It was later discovered by staff that driveways and other hardcover subsequently installed is far in excess of the limits,and not within the scope of what was approved with the permit. The property owner was advised to remove the excessive hardcover,but the owner claims he needs it to make the site functional. He has suggested to the City that rather than remove the excess hardcover or go through an after-the-fact variance,he would rather grant the City an easement for sewer maintenance over virtually his entire driveway,and call it even. The owner believes the City needs access over his driveway to maintain the sewer system;further,he believes he needs all the existing hardcover for the access to his property to be functional. Zoning staffdisagrees with this analysis;we believe a smaller driveway would be functional,and we believe the 626 s.f,patio(which we have not viewed as ofthis writing but which is reported by owners surveyor as only 470 s.f.hardcover or a 0.75 HC factor!?)should be removed,as there is clearly no hardship for it and it was not on the approved site plan. Greg Gappa and Jeanne Mabusth discussed the easement with the property owner over the summer of 2003. Zoning staffconcurrently anticipated that the owner would be applying for an after-the-fact variance, and the subj ect of an easement would be part of the variance discussion. Instead,the property owner has merely submitted an easement document that gives the City certain rights over his driveway,without having to remove any of the hardcover excess. Building&Zoning staffhave concluded that this is an inappropriate process to allow the hardcover excesses to remain. An after-the-fact variance should be applied for,and the City should be allowed through the normal procedures to detennine whether adequate hardship exists to allow the excesses. If the City needs an easement because ofpast actions or inactions by the City,that should not become the sole deciding factor in whether excessive hardcover is allowed to remain. REQUEST FOR COUNCIL ACTION DATE: March 8, 2004 ITEM NO.: Department Approval: Administrator Reviewed: Agenda Section: Name Gregory A.Gappa Public Services Director's Report Title Director of Public Services Item Description: Easement 1355 Tonkawa Road This property is located at the end of the private road in the Tonkawa Shores Subdivision, a three lot subdivision,which is located across Tonkawa Road from the Maxwell Bay public boat landing. This development has a narrow private road that does not have a cul de sac at the end of the road as the residents were concerned about public traffic from the boat landing using the road if it was too wide with a large turnaround area. This development was first platted with provisions for a hammer head type of turn around,but before the project construction was completed an additional property was added to the west end of the development. When the property was replatted to include the additional property and enlarge the three lots,no provisions for a turnaround were included in the revised plat. The City has a sanitary sewer line with several manholes located on the south side of this property, and we have been using the driveway for 1355 Tonkawa Road to turn around when we need to access the manholes. The driveway includes a circular turnaround with a 25' radius and a grass island in the center of the turnaround. The City standard for a cul de sac is a 40' paved radius, so this turnaround area is actually smaller than a standard cul de sac. The property owners are willing to grant the City an easement across their driveway for a turnaround area. The standard procedure for hardcover in easement areas is to remove both the area of the easement and the hardcover in the easement area from the hardcover calculations for the property. The provision of this easement brings the property into compliance for hardcover in the 75' to 250' zone and provides the City with a legal turnaround area. This concept results in the efficient utilization of hardcover, and the turnaround area is smaller than a standard 40' radius cul de sac. The property owners are providing this easement at no costs to the City and have paid for the surveying and legal costs to prepare the easement documents. As you recall when Tonkawood Shores was initially plotted there was a provision for a turn- around for emergency vehicles etc. This initially consisted of a hammer-handle type of situation with a T at the end of the road or at a minimum opposing driveways. With the addition of Tonkawood Shores Two, this was omitted from the plan and no means for turn around available. Essentially, this left my end lot, at the end of the road, with no tum around facility for myself nor for any fire, emergency vehicles etc. Because of necessity I placed a tum around, which actually became a circular drive on my property. This was brought to the attention of the city as it exceeded the hardcover. In that regard, as we worked out the details last summer with Jean Mavis, an agreement was made to provide easement to the city for maintenance, emergency vehicle use etc. across my property, allowing recalculation of the hardcover making this conforming to the city regulations. As we discussed, this is a benefit to myself and the city. The city now has a turn around for emergency, police, fire etc. as well as maintenance. In addition to this, it is also very efficient use of hardcover for the entire addition. As we discussed, the city requires use of this turn around but there would be no need for any member of the private road as they have a driveway, which comes at a right angle to the road. As we discussed on February 25, 2004, 1 think this essentially covers all the facets of our discussion of both parties. I trust that this is agreeable and we need to have the signatures of the designees. thank you me and effort and look forward to having this resolved. Fasching, husband and wife("Fasching") and the City of Orono, a municipal corporation("City") . RECITALS (i) Fasching is the owner of the real property legally described on Exhibit A attached to this Agreement ("Fasching Property"). (ii) The Fasching Property is adjacent to Outlot A Tonkawa Shores Second Addition, Hennepin County, Minnesota("Outlot A"). (iii) Outlot A is a private road which provides access to the Fasching Property. (iv) Fasching desires to grant to the City an easement for ingress and egress over a portion of the Fasching Property for access to Outlot A. (v) Pursuant to the terms and conditions of this Agreement,Fasching has agreed to grant to the City, its successors and assigns,which assigns shall be limited to the United States Government, State of Minnesota,Hennepin County or lawful agencies thereof ("Permitted Assigns"), a permanent non-exclusive easement for ingress and egress ("Access Easement") over and across that part of the Fasching Property described on Exhibit B to this Agreement(the, "Access Easement Area"). GRANT OF ACCESS EASEMENT. Fasching hereby grants and conveys to the City for the benefit of the City and its Permitted Assigns, a permanent non-exclusive access easement over and across the Access Easement Area for the purpose of ingress and egress to Outlot A. Fasching, on behalf of themselves,their successors and assigns specifically reserve the right to continue to use and occupy the Access Easement Area for any purpose which does not materially interfere with any of the rights granted to the City under this Agreement. 3. MAINTENANCE OF ACCESS EASEMENT AREA. The City acknowledges and agrees that Fasching has installed a driveway over the Access Easement Area. Fasching shall be responsible for all costs of repairing,replacing or maintaining the Access Easement Area and the driveway over the Access Easement Area, except for any repair or replacement which is a result of the acts of the City, the Permitted Assigns, their employees or agents. All such construction, repair,replacement or maintenance required under this Agreement shall be in compliance with all applicable statutes, ordinances and codes. 4. NO IMPROVEMENTS TO ACCESS EASEMENT AREA. Provided that Fasching, their successors and assigns are in substantial compliance with the terms and conditions of this Agreement,the City, for and on behalf of itself and its Permitted Assigns shall not commence or undertake to make any modifications or improvements over, under or across the Access Easement Area. 5. INSURANCE FOR ACCESS EASEMENT AREA. Fasching on behalf of themself, their successors and assigns shall procure and maintain a policy or policies of insurance, at their own cost and expense, insuring the Access Easement Area in amounts and against claims, demands or actions as are customarily insured against for property similar to the Fasching Property. All insurance required under this section shall be issued by an insurance carrier(s) licensed and admitted to do business in the State of Minnesota. 6. COMPLIANCE OF FASCHING PROPERTY AND ACCESS EASEMENT AREA WITH CITY REQUIREMENTS. In consideration of the Access Easement, the City acknowledges and agrees that (a) the square footage of the Access Easement Area is part of the Fasching Property for all purposes, (b) the creation of the Access Easement Area does not alter the boundaries of the Fasching Property for City set- -2- back requirements, and(c)the improvements on the Fasching Property as of the date of this Agreement comply with City regulations and hardcover ratios. 7. ASSIGNMENT AND BINDING NATURE. This Agreement shall be binding upon and inure to the benefit of Fasching, their successors and assigns,the City and its Permitted Assigns, to have and to hold all and singular the easement herein granted to the City pursuant to the terms and conditions of this Agreement. The Access Easement granted under this Agreement shall be a covenant running with the Fasching Property as a burden upon the Access Easement Area for the benefit of the City and its Permitted Assigns. Any modification of the terms of this Agreement must be in writing signed by the party against whom enforcement of the modification is sought. 8. LIMITATION OF LIABILITY. Notwithstanding any provisions to the contrary contained in this Agreement, no fee owner of the Fasching Property shall be responsible, obligated or liable under this Agreement, except to the extent such responsibility, liability or obligation arises during the period of its actual ownership of the Fasching Property. 9. GOVERNING LAW. This Agreement was executed in Minnesota and shall be governed by the laws of the State of Minnesota. 10. COUNTERPARTS. This Agreement may be executed in any number of counterparts, each of which shall be deemed an original, but all of which shall constitute one and the same instrument. 11. HEADINGS. Headings contained herein are for reference only and are not a part of this Agreement. 12. RIGHT TO INDEPENDENT COUNSEL. Each of the parties has been represented by independent counsel in connection with this Agreement and the Exhibits or has knowingly and voluntarily decided not to be represented by independent counsel. Each of the parties represents that this Agreement and the Exhibits have been read and understood and that each has received a copy. 13. REPRESENTATION OF AUTHORITY. The parties signing this Agreement warrant and represent to all other parties to this Agreement that they have full power,right and authority to execute this Agreement in their own name or in a representative capacity on behalf of any business entity named in this Agreement and that those signing on their behalf have the power and authority to bind such business entities to the terms and conditions of this Agreement. 14. FURTHER ASSURANCES. At any time and from time-to-time after the signing and delivery of this Agreement, each party shall upon the reasonable request of -3- another party, sign, acknowledge and deliver all such further and other assurances and documents, and will take such actions consistent with the terms of this Agreement, as may be reasonably requested to carry out the transactions contemplated by this Agreement and to permit each party to enjoy its rights and benefits under this Agreement.
