SECTION 10.56, SUBDIVISION 16(C), SECTION 10.56, SUBDIVISION 16 (C) (�, SECTION 10.56, SUBDIVISION(1� (L) (1) and (2); FILE NO. 03-2867 . WHEREAS,Daniel Adams(hereinafter"the applicant")is the owner of the property " located at 1145 Tonkawa Road within the City.of Orono (hereinafter "the City") and legally described as follows: - -_. ---. ----------- ------ . Exhibit A, (hereinafter"the property"); and WHEREAS,the applicant has applied to the City for a variance to Municipal Zoning • Code Section 10.22, Subdivision 1(B) and 2, Section 10.56, Subdivision 16(C), Section 10.56, Subdivision 16(C)(6), Section 10.56, Subdivision 16(L)(1) and(2) to allow construction of a new ' second story to the existing house to be 64' from the OHWL of Lake Minnetonka where 75' is required, a screen porch to be 70' from the OHWL where 75' is required, an average lakeshore setback encroachment of 17';to allow 1,215 s.f. (10%)hardcover in the 0-75' setback zone where 0 s.f. (0%) is allowed, to allow 9,092 s.f. (33%) hardcover in the 75-250' setback zone where 6,866.25 s.f. (25%) is allowed; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on Mazch 17,2003,at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. � NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: � FINDINGS � 1. The property is located in the LR-1B Zoning District,where 1.0 acre is the minimum required lot area. The property consists of approximately.95 acres. 3. The Orono Planning Commission reviewed this application on March 17, 2003 and recommended approval by a vote of 5 to 0. . � 4. The Planning Commission made the following findings of fact: A. The existing residence was built in 1966,prior to city adoption of the current 1 acre zoning standards. B. The adjacent neighbors' view of the lake will not be negatively impacted by � � the second story addition. C: Lot coverage by structures will be 4,231 s.f., (10.1%), below the 15% • � • allowed by City ordinance. D. The proposed addition is in character with other properties along Tonkawa Road. E. � Hardcover in the 0-75' setback zone will decrease by 515 s.f. Applicants shall remove 128 s.f.from the ground level(lakeside)patio,the shuffleboard deck and the brick pavers around the shuffleboard deck. F. Hardcover in the 75-250' setback zone will decrease by 1,162 s.f. Applicants shall remove 703 s.f. of gravel located by the driveway,25 s.f.from the circle portion of the driveway, the brick apron and deck. � G. The applicants have requested to add to the existing house rather than build a new structure on the property. The owner has stated the existing foundation will not be removed or altered as part of the remodeling plan. 5. The City Council finds that the conditions existing on this property are peculiar to it . and do not apply generally to other property in this zoning district;that granting the variances will not adversely affect traffic conditions,light,air,nor pose a fire hazard or other danger to neighboring property;would not merely serve as a convenience to • the applicants,but is necessary to alleviate a demonstrable hardship or difficulty; is Page 2 of 8 . � O� � O O � ! The City Council has considered this application including the findings and recommendations of the Planning Commission,reports by City Staff, comments by . the applicants and the effect of the proposed variances on the health, safety and welfare of the community. CONCLUSIONS, ORDER,AND CONDITIONS - - - - .---. Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.22, Subdivision 1(B) and 2, Section 10.56, Subdivision 16(C),Section 10.56,Subdivision 16(C)(6),Section 10.56,Subdivision 16(L)(1)and(2) �. • to allow construction of a new second story to the existing house to be 62' from the OHWL of Lake Minnetonka where 75' is required,a screen porch to be 70' from the OHWL where 75' is required, an average lakeshore setback encroachment of 17',to allow 1,215 s.f. (10%)hardcover in the 0-75' setback zone where 0 s.f.(0%)is allowed,to allow 9,092 s.f.(33%)hardcover in the 75-250'setback zone where 6,866.25 s.f. (25%) is allowed. Approval is subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicants attached to this resolution as Exhibit B. Any amendments to the site plan may require further Planning Commission and City Council review. 2. If it is determined the existing foundation which is located within the 75' lalce yard setback is required to be replaced, all variance approvals shall be withdrawn by the City of Orono and a new variance application shall be submitted by the applicants. 3. There shall not be anymore encroachment into the average lakeshore setback by future additions or remodeling. , 4. In order to meet the hardcover levels approved by this resolution,the applicants shall , remove 515 s.f.of hardcover in the 0-75' setback zone prior to final inspection. The removals shall include 128 s.f. from the ground level (lakeside) patio, the shuffleboard deck and brick pavers around the shuffleboard deck. i - . � .. Page 3 of 8, � o,�,. � 0 0 • '� a. The applicants shall remove 1,162 s.f.of hardcover in the 75-250' setback zone prior to final inspection. The removals shall include 703 s.f. of gravel located by the driveway, 25 s.f. from the circle portion of the driveway,the brick apron and deck. 6. The applicants shall remove 2,004 s.f. of plastic from rockbeds on the property as shown in Exhibit B prior to final inspection. 7. Authorities granted by this variance run with the property not with the applicants,but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date (April 14, 2004). ' 8. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. • � 9. The undersigned applicants have read, understand and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property.
