W�I�R�AS, Richard and Kathy Kyle (hereinafter "the applicants") are the
owners of the property located at 1140 Tonkawa Road within the City of Orono (hereinafter
� "the City") and legally described as follows: �
Exhibit A attached, Hennepin County, MN (hereinafter "the property"); and
WI��AS, after due published and mailed notice in accordance with Minnesota
Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission
held a public, hearing on June 15, 1998, at which time all persons desiring to be heard
� � . � concerning this application were given the opportunity to speak thereon; and � � .
W�REt�S, the applicants have applied to the City for variances to Municipal Zoning
Code Section 10.22, Subd. 2 and Section 10.56, Subd. 16 (L) 1 and 2 to pernut a second story
addition to an existing residence that is located in the 0-75' setback where variances for
hardcover, lakeshore setback and average lakeshore setback are required. '

� 1. This application was reviewed as Zoning File .#2380. .
� 2. The property is located in the LR-1B Single Family Lakeshore Residential
Zoning District, where 1 acre or 43,560 sq. ft. minimum lot area is required.
The property consists of .62 acre or 27,186 sq. ft.
3. The Orono Planning Commission reviewed this application on June 15, 1998 and
recommended approval by a vote of 7 to 0.
�4. The Planning Commission made the following fmdings of fact:

A. The subject property does not meet the lot area or lot width requirements
for the LR-1B district. ;
B. The existing residence was built in 1960 and is located 36' from the
929.4' elevation of Lake Minnetonka. , �
C. The existing residence is located approximately 17' lakeward of the �i
average lakeshore setback. �
D. The existing residence does not exceed the 15% lot coverage requirement. �
E. The existing hardcover exceeds the amount of hardcover allowed in the
0-75' setback (38.42%) and 75-250' setback (43.47%).
5. The City Council fmds that the conditions existing on this properly are peculiar
• . to it and do not apply �generally to other property in this zoning district; that � � �
granting the variances would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely ;
serve as a convenience to the applicants, but is necessary to alleviate a ;
demonstrable hardship or difficulty; is necessary to preserve a substantial
properiy right of the applicants; and would be in keeping with the spirit and ;
intent of the Zoning Code and Comprehensive Plan of the City.

6. The City Council has considered this application including the fmdings and �
recommendations of the Planning Commission, reports by City staff, comments
by the applicants and the effect of the,proposed variance on the health, safety ;
and welfare of the community.

Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Municipal Zoning Code Section 10.22, Subd. 2 and Section 10.56, Subd. '
16 (L) 1 and 2 to permit a second story addition to the existing residence. Approval is subject
to the following conditions:
1. In the 0-75' setback, the shed, patio block by deck, rock and plastic to be
removed as shown in.E�ibit B, to reduce hardcover from 38.42% to 25.80%.

2. In the 75-250' setback, rock and plastic including the all rock area south of the
gazage (1,004 sq. ft.) to be removed as shown in Exhibit B, to reduce hardcover
from 43.47% to 28.5%.
3. Authorities granted by this variance run with the property not with the
applicants, but are pernussive only and must be exercised by application for a
building permit within one year of the date of Council approval, or this variance
will expire on that date (July 13, 1999). �
4. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and sha11 be punishable as a
misdemeanor.
� • 5. The undersigned applicants have read, understood and hereby agree to the terms �
of this resolution and ori behalf of themselves, their heirs, successors and
assigns, hereby agree to the recording of this resolution in the Chain of Title of
the properly.
' Adopted by the City Council of the City of Orono, Minnesota at a regular
meeting held on the 13th day of July, 1998.
