We received an updated survey for 1070 Tonkawa Road. Please review and provide comments.
Item#3. John Sonnek from Charles Cudd says Retaining Wall "M" was constructed in conjunction w/the
neighbor. Does it still need to meet the setback?
Item#4. The lakeside deck and stairs were existing. John has no explanation for the change in topography or why it
wasn't shown on any of the previous surveys. Pictometry image shows it as existing.
Item#5. He is still working on obtaining.

Update:
I've completed a site visit and offer the following revisions to my comments:
1
1. The survey does not comply with City Standards.
a. Retaining must have top of wall and bottom of wall elevations called out(#23).
b. Service utilities(water,gas,electrical, and sanitary sewer with invert elevation at connection point)
(#14)
c. Drainage patterns are not indicated with arrows(#21).
d. Drain tiles are not indicated. I could not find the outlet for all of the drain tiles that the downspouts
feed into. (#9)
e. Driveway slope is not indicated (#22)
2. The approved plan had a drainage the and swales on the south side of the home. These are not shown in the as-
built and do not appear to be present on the site. Were these constructed and in accordance with the
comments provided in November of 2014? If not why not? There does appears to be a swale at the west end of
retaining wall "P" directing run off to the south and into a depression on the neighboring property near the
utility pole. Photo Attached (looking south from driveway)This must be remedied either with that originally
planned drain the or some other mechanism to capture the hard cover run off and direct it somewhere other
than the neighboring property.
3. Was the move of the retaining wall into the County ROW approved by the county? Normally they require 15ft
from the fog line. The retaining wall is actually—7ft from the fog line. This is a county issue but one the
homeowner will want to ensure has been approved to avoid future issues.

I've reviewed the as built and offer the following comments:
1. The survey does not comply with City Standards. Retaining must have top of wall and bottom of wall elevations
called out(#23).Any walls over Oft will need an engineered design.
2. The as-built depicts several variations from the approved site and grading plan, approved on 17 Jul 1015:
a. There is a retaining wall shown on the north side of the home along the property line. It appears to cross
the property line at the western end. Was this approved by the encroached upon property?
b. The drainage pattern/swale shown on the approved plan to the north of the structure is not depicted on
the as-built.
c. A retaining wall is depicted on the south side of the driveway.
d. The approved plan had a drainage tile and swales on the south side of the home. These are not shown
in the as-built. Were these constructed and in accordance with the comments provided in November of
2014? If not what was done to establish a drainage pattern that does not increase run off onto the
neighboring property.
e. A retaining wall is depicted around a concrete pad on the north side of the house.

f: A couple retaining walls are depicted extending from the north east corner of the home.
g. A retaining wall is depicted extending from the south west corner of the home.
h. A deck and stairs is depicted next to the lake. Preexisting? If so why not on the original site plan and
hard cover calcs?
3. Was the move of the retaining wall into the County ROW approved by the county? Normally they require 15ft
from the fog line. On the survey it appears that it might be closer than that.
The site will need to be inspected once the snow is gone.

Our City Engineer has reviewed the as-built survey dated 11-30-15 and visited the site on 2-24-2016. He has the
following comments:
1. The survey does not comply with city standards(survey requirements attached):
a. All retaining walls must have top of wall and bottom of wall elevations called out(#23).
b. Service utilities(water,gas,electrical,and sanitary sewer with invert elevation'at connection point)

c. Drainage patterns are not indicated with arrows(#21).
d. Drain tiles are not indicated. The outlet for all of the drain tiles that the downspouts feed into could not
be located. (#9)
e. Driveway slope is not indicated (#22)

swale at the west end of retaining wall "P" directing runoff to the south and into a depression on the
neighboring property near the utility pole. Photo attached (looking south from driveway). This must be
remedied either with the originally planned drain tile or some other mechanism to capture the hardcover runoff
and direct it somewhere other than the neighboring property.
3. Retaining wall,identified as"M" on the survey and hardcover calculation worksheet, appears to be on and over
the property line to the north and may be in conflict with City Code Section 78-1405(5.1). Please revised to
comply.
4. The as-built survey shows topographic contours changes and a deck and stairs within the Lakeshore setback
which were not shown as existing on either of the proposed surveys(9/30/14 or 6/18/15). Please provide
evidence that the structures were pre-existing and, if reconstructed,were built in-kind. A new deck in this
location is not permitted and a permit is required for reconstruction, if applicable.
5. Please provide evidence of compliance with Hennepin County's ROW permit.
Due to the incorrect or incomplete items noted above, only a temporary certificate of occupancy(TCO)can be issued. A
final CO will not be issued until issues are addressed/resolved and the site stabilized with vegetation. A TCO will require
submittal of escrow funds in addition to the building permit$2500 escrow totaling$10,000. The City will hold the
$10,000 escrow until disturbed areas on the property are satisfactorily vegetated from an erosion control perspective
and the above items are corrected. Upon verification of compliance the CO will be issued and the$10,000 escrow will
be refunded.

Our inspector Mike Olmstead did a site inspection and closed out the permit on 2/26/2016. Mike noted the following:
Looked at alignment of boulder wall after notification from City of Orono.After taking pictures, I saw that the wall was closer to
the road than was indicated by the plan, but boulders fell on the backside of the existing power pole line that will determine plow
limits. There is an improvement over the preexisting condition. I feel it is an improvement to the area that does not infringe on
road operations.
Hennepin County accepts the new driveway and right-of-way improvements as constructed.
