Thanks for getting back to me. It looks like the builder will be LDK builders but he is out of town until next Monday and will
work out details then. My controller sent the additional$500. 1 am paying for the permit direct and would like to start the
dirt work can it be issued to me then transferred to builder?

Melanie,
I have reviewed the survey for the proposed house at 1065 Tonkawa Rd and have the following concerns:
• There is a sanitary sewer line toward the lake which is not shown on the survey. The survey will need to be
updated to show the location of the sanitary sewer, manholes, and any utility easements.
• Aerial photos show trees located by the lake. Will the proposed stairs impact any trees?
• The proposed retaining wall is shown to be 4' high. If the wall is installed over 4' in height,the applicant will
need to have a registered professional engineer prepare plans and specifications for it.
• The back of the retaining wall needs to be a minimum of 5' from the property line without a variance.
• The survey needs to show the location of the silt fence or other erosion control measures.
• Will the applicant need to have a tree preservation plan?
• If the driveway entrance is going to be altered the applicant will need a Hennepin County permit.
• The applicant will need to get a MCWD permit.

I am going over the plan this weekend to make sure we get any and all changes that we have talked about and clarify
before we submit to you next week. This will save everyone's time and we should have to you by tues or wed. Lyle
when are you available? Lance is out of town next week and I leave wed afternoon.
On a side note as we were excavating we looked at the proposed retaining wall and considered a change. Also on the
south side I was considering talking to my neighbor about grading that area different. How do we handle that if we
decide to pursue it?

hardcover regulations must have a driveway or proof of driveway included in the hardcover
calculations. If you wish to revise the plan to reflect an overhead door 6' in width or less the
hardcover for a driveway will not need to be provided.
The hardcover calculations do not currently reflect a driveway access to the lower 10' x 8' door.
The hardcover calculations must be modified to including driveway access to the door or the

AGREEMENT made this day of Aldr , 202, by and between the CITY OF
ORONO, a Minnesota municipal corporation ("City") and James Bebo ("Owners").
Recitals
1. Construction of the new residence located at 1065 Tonkawa Road the ("Subject
Property"), legally described as the Northwesterly 128.21 feet of Lot 6, measured by right
angles from the northwesterly line thereof, Auditor's Subdivision Number 217, Hennepin
County Minnesota, is the subject of building permit application number 2012-01191 has
been completed.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2012-01191 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
S. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when the review has been completed and written notification is received from the Owners
requesting the funds.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvements, final grading, establishment of vegetation and
the restoration of the subject property should the Owners not complete the work by the specified dates.

TEMPORARY CERTIFICATE OF OCCUPANCY

AGREEMENT made this day of /Vd , 202, by and between the CITY OF
ORONO, a Minnesota municipal corporation ("City") and James Bebo ("Owners").
Recitals
1. Construction of the new residence located at 1065 Tonkawa Road the ("Subject
Property"), legally described as the Northwesterly 128.21 feet of Lot 6, measured by right
angles from the northwesterly line thereof, Auditor's Subdivision Number 217, Hennepin
County Minnesota, is the subject of building permit application number 2012-01191 has
been completed.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2012-01191 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when the review has been completed and written notification is received from the Owners
requesting the funds.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvements, final grading, establishment of vegetation and
the restoration of the subject property should the Owners not complete the work by the specified dates.

NOW THEREFORE, PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrawi
Agreement, tie Own rs shall deposit an additional $500, for a total of$2,500 to be held by the City. All accrued
interest, if any, shall paid to the City to reimburse the City for its cost in administering the escrow account
2. PU POSE OF ESCROW.The purpose of the escrow is to guarantee reimbursement to the City
for 1x11 out-of-pocketcosts the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) 0r will incur i reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners world be responsible for under a building permit application. The escrow will also guarantee
reimbursement to th City for all ut-of-pocket costs the City has incurred to assure that the work is completed in
accordance Oth th StormwaterPollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial secur' may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair a y damage tq public property or infrastructure that is caused by the work (including planning,

s. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in tum
send a bill to the Owners. owners shall be responsible for payment to the City within 30 days of the Owners'

4. DiS URSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the 'meframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City foi eligible expenses the City has incurred.
5. CL SING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the r iew has been completed and written notification is received from the Owners requesting the
funds.
S. CE TIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City xc the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pu uant to Minn. Stat. §§415.01 and 366.012.

ESCROW AGREEMENT
AGREEMENT made this Z>' � day of OCf c 20/Z, by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City")and Jim Bebo ("Owners").
Recitals
1. An application for a demolition permit has been filed for an accessory structure located at
1066 Tonkawa Road ("Subject Property")legally described on attached Exhibit"A".
2. In conjunction with the demolition, erosion control measures are required as shown on attached
Exhibit"B".
NOW,THEREOFRE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement,
the Owners shall deposit $2,000 with the City. All accrued interest, if any, shall be paid to the City to reimburse the
City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for
all out-of-pocket costs(including planning, engineering, or legal consultant review)the City has incurred to assure that
the erosion control measures are installed and maintained so the property complies with the provisions of Orono City
Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions
associated with the work and to repair any damage to public property or infrastructure that is caused by the work. If
compliance with the approved Land Disturbance Permit is not accomplished within the allowable time period, the City
may bring the project into compliance by use of the security.
3. RIGHT OF ENTRY. The Owners hereby grant the City, its agents, employees, officers and
contractors the right to enter the property to perform all work and inspections deemed appropriate by the City in
conjunction with the required erosion control measures, including but not limited to constructing or completing any and
all of the agreed upon improvements should the Owners' contractor not complete those improvements by the date
specified herein.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt
of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
6. CLOSING ESCROW. Any remaining amount of the financial security deposited with the City for
faithful performance of the plans and specifications and any related remedial work will be released after the
completion and inspection of all such measures and the establishment of final stabilization for the Subject Property.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
