Dear Mr. Jabbour:
At the time of the issuance of the Certificate of Occupancy on
December 4, 1989, your property was found to have no violations. All
previous concerns raised by the City within the 0-751 setback,
lakeshore protected area, have been satisfactorily addressed and
reaffirmed with the issuance of the Certificate of Occupancy enclosed.

Subject: 985 Tonkawa Road - Owner seeks resolution of City
confirming no violations within lakeshore protected
area.
The current owner of the property, Gabriel Jabbour, has
asked that the City pass a resolution confirming that all
previously reported violations within the 0-75' setback area be
confirmed as removed. The violations resulted from actions of an
earlier owner, Richard Mast, who proceeded to remove trees
greater than 6" in diameter within the 0-75' setback area. Mr.
Jabbour purchased the property in 1988 and has worked with staff
to relandscape the lakeshore yard. With the issuance of a
Certificate of Occupancy on December 4, 1989, the City found all
previous violations had been removed.
The enclosed resolution has been drafted reconfirming the
above findings. The resolution will be filed against the chain
of title at the Title Company's request.

A RESOLUTION REAFFIRMING
NO VIOLATIONS WITHIN THE 0-75'
LAKESHORE PROTECTED AREA AT THE PROPERTY
LEGALLY DESCRIBED AS LOT 2, BLOCK 1, PARWOOD,
HENNEPIN COUNTY, MINNESOTA
WHEREAS, Gabriel Jabbour (hereinafter "Owner") is the
owner of the property located at 985 Tonkawa Road within the City
of Orono (hereinafter "City") and legally described as Lot 2,
Block 1, Parwood, Hennepin County, Minnesota (hereinafter
"property"); and
WHEREAS, the owner has requested a formal resolution of
the City reaffirming that all previously recorded violations
within the 0-75' lakeshore protected area have been removed and
satisfactorily resolved.
NOW, THEREFORE BE IT RESOLVED, by the City Council of
Orono, Minnesota:
FINDINGS
1. On December 14, 1987, the former owner, Richard Mast,
had contracted with a landscape company to remove
approximately 8 trees with trunks in excess of 6" in
diameter.
2. Orono's Zoning Code Section 10.22, Subdivision 3 Tree
Removal Regulations - requires a permit from the City for
the removal of all live trees within 75' of the shoreline
with a diameter of 6" or more.
3. Neither the former owner, Mr. Richard Mast, nor the
landscape contractor obtained the necessary permits for the
removal of such trees. Dale A. Gustafson, a landscape
architect, confirmed that at least 4 of the trees were dead
and the remaining were potential safety hazards.
4. On July 20, 1988, the current owner, in a letter dated
July 20, 1988, agreed to a landscape improvement plan within
the 0-75' area involving:
a. immediate erosion control steps for disturbed area;
b. replanting of 4 trees within the lakeshore
protected area.

5. On December 4, 1989 the City issued a Certificate of
Occupancy for the new residence reconfirming that the
conditions of the proposed landscape plan had been
satisfied.
CONCLUSIONS
Based upon one or more of the above findings, the Orono
City Council hereby reaffirms that all previously reported
violations against the property legally described above and
located at 985 Tonkawa Road have been removed and satisfactorily
resolved.
Adopted by the Orono City Council of this 12th day of
August, 1991.
