NO. � `� � � A RESOLUTION GRANTING PRELIMINARY APPROVAL OF A CLASS III SUBDIVISION LOCATED AT 905 TONKAWA ROAD FOR ALAN AND MARILYN RICHIE FILE NO. 2512 WHEREAS,Alan Richie and Marilyn Richie(hereinafter the "subdividers")on July ' , 21, 1999, filed a formal subdivision application with the City for approval of a three (3) lot residential plat of properry legally described as: Lots 1, 2 and 3,Vasa Park, Hennepin County,Minnesota (hereinafter "the property"); and . • � r WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the Municipal Code of Ordinances, Chapter 10 (Zoning Code) and Chapter 11 (Subdivision), the Orono Planning Commission held a public hearing on August 16, 1999, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, on September 13, 1999 the Orono City Council considered the subdivision application, noting the following findings of fact: l. The property is located within the LR-1B One Family Rural Residential Zoning District requiring a minimum of one acre of contiguous dry buildable land within � each newly created lot. 2. The entire site is approximately 6.3 acres. 3. The proposed plat consists of three(3)residential lots each meeting or exceeding the one (1) acre minimum.requirement for the zoning district. � 4. All lots sha11 have direct access to Tonkawa Road(County Road No. 135). 6. All existing hardcover will be remo�-ed by the subdividers upon completion of the final plat. 7. Setbacks for structures is 35' front yazd and 10' side yard. 8. The draft version of the City's Comprehensive Stormwater Management Plan shows that the site lies within the Stubbs Ba�drainage district. The site drains to the south and the north from the high point on Lot 2. All flows ultimately reach North Arm.� The bluff area along the lake and the existing topography of the site will make ponding difficult. 9. A vegetated buffer strip along the top of the bluff is necessary to provide water • quality benefi�s to Lake Minnetonka 10. Hennepin County shall grant access pemuts for access to Tonkawa Road. � 11. The property was assessed for 3 units in 1976 as part of the 73-1 sewer project. Sanitary sewer to serve Lots 1 and 2 should be provided sanitary service from Tonkawa Road. The existing sewer on Tonkawa Road east of Lot 1 should be extended southerly appro�cimately 1 QO-200 feet to serve Lot 2. Sewer connection for Lot 3 is located over the southwestern portion of the property. 12. A bluff spans the entire lakeshore of the properry. Structures aze required to meet a 30'top of bluff setback. This setback has the greatest impact on proposed Lot 3. 13. Any alteration within the bluff imgact zone shown on the preliminary plat shall require further Planning Commission and City Council review. 14. The Planning Commission reviev�ed the application on August 16, 1999 and recommended approval by a vote of 6 to 0 to approve the three lot subdivision. � NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of th�e findings noted above,the City Council of the City of Orono hereby approves the preliminary plat for • Page 2 of 5 � �_ . � O� . Gronberg, a licensed surveyor of Coffin& Gronberg, Inc. dated July 15, 1999, revised September 8, 1999 subject to the following conditions: 1. Subdividers submit a Grading and Erosion control plan for the entire site to be reviewed and approved by the City Engineer. 2. Subdivider shall obtain a permit from Hennepin County Department of Transportation for new curb-cut and access to Lots 1, 2 and 3. 3. Plans shall be completed for the extension of sanitary sewer service to the property by a registered engineer to the specifications set by the City Engineer and Director of Public Services. Development plans shall be approved by the City prior to final plat approval. • 4. Lots 1,2 and 3`shall each have direct private access to Tonkawa Road(County Road 135). 6. No building permits will be issued until the structures and hardcover is removed from � � Lots 2 and 3 and erosion control measures are in place and approved by the City Engineer. • 7. Sanitary sewer to serve Lot 3 exists west of the existing home along the south property line. Lots 1 and 2 should be provided sanitary service from Tonkawa Road. The existing sewer line on Tonkawa Road east of Lot 1 shall be extended southerly � to serve Lot 2. Detailed plans shall be provided to the City for review and approval by the City Engineer and Director of Public Services prior to final plat. Tonkawa Road is a County Road,final plans shall be provided to Hennepin County for review. ' 8. The developer shall grant Drainage and Utility easements 5 feet wide along all interior lot lines and 10 feet wide along the right-of-way. � 9. Subdivider is hereby advised that the City will not grant fmal plat approval until the - MCWD has approved all grading and drainage improvements for the property. 10. Payment of Park Dedication Fee for two(2)new residential lots per City Ordinance. � .. Subdivider is hereby advised that preliminary subdivision approval will expire one year from the date of Council preliminary plat approval. Should the subdivider fail to file a final plat application within the year deadline, it shall be necessary for the subdivider to file a new preliminary subdivision application with the City. 12. Subdivider is hereby advised any changes with the layout of lots shall require further review by the City Planning Commission and City Council. FINAL PLAT SUBMITTALS � . The following list of final submittals shall be submitted to the City two (2) weeks prior to the regularly scheduled City Council meeting: 1. Record plat drawings in the form of two (2)mylar copies and one (1) copy reduced to 1"=200'. Drawing to include: . . � � � , A. .Lot lines per survey by Coffin&Gronberg, Inc. dated July 15, 1999 revised . September 8, 1999. � B. Designation on the plat of all drainage and utility easements. 2. LEGAL DOCUMENTS required: A. Title opinion addressed to the City. All owners, mortgage holders or others with properry interest indicated therein shall sign the plat and all other documents affected by such interest. B. The applicant shall provide certified copies of all recorded easements currently affecting the property. C. • Signed and executed Developers Agreement and Letter of Credit for sanitary sewer extension and improvements. - D. Completed application for private road name. E.
