Among our biggest challenges is our neighbor. Our neighbor's little brown cabin that sits on the shore takes on water if any water crosses the property line. Bad - ugh. • And, the neighbor being unhappy that the path created this spring crosses onto their property. As a result, the plan my husband and I are discussing and plan to draw includes: • Restoring the current water path, filling it with dirt displaced from new path and putting sod or ground cover of some sort to help ensure it stays. Continuing the rock bed started by the city but gradually angling it a bit more south as it moves towards the lake, so it stays on our property and around the pine E. oak. • Have normal rains flow into the pipe system that exists from the previous owner. • Have a shallow rock bed that helps the excess water spill more gently over the bank where there is vegetation. • Attached is a very crude illustration so you your engineer can get the idea. I don't actually think there is any removal of earth but more adding rocks to protect the bank area from erosion and allow the water to flow more gently. But, let me get this figured out and a plan together. Is our final certificate of occupancy being held up by this? The structure should have final approval today as they had to add an extra railing to the deck stairs and the city is viewing it at 2. Hope all is well with you! I do not know if you and she spoke yesterday but I'll respond in an effort to keep things moving. You may continue the restoration up to the 75'setback limit to match the City's work. The work conducted within the 0-75'zone will need City Council authorization if the earth movement/disturbance exceeds 10 cubic yards. I haven't viewed the washout myself so I don't know the amount/volume of the damage. When I spoke about this with Scott it wasn't clear how close to the lake the damage extended. 1 Please submit a plan for the 0-75 restoration. Technically a conditional use permit (CUP) and a public hearing are required for work exceeding 10 cubic yards within the 0-75'zone. Once you determine the volume we will have to decide how to proceed. If a CUP is needed it will take some time for the process. Please call me if you have any questions as this can be quite confusing. As per my conversation with Scott, we will continue the city drainage by widening the existing channel and putting rock in it to help stabilize the situation. We were waiting to have the city work done so we could follow their lead. Scott conveyed we would need to get a permit for our work. I, perhaps wrongly, assumed that we could continue the city drainage work as a first step, between where they leave off and the 75' mark and would need to pull a permit where it involved the 0-75'. Please let me know if it is ok to continue what the city has started, carrying it up to the 75' line in advance of the permit. We will draw up a plan to replace the existing flow/pipe system on the bank submitting it to you for permitting. And if you need us to wait to do anything, let me know that too. Recitals 1. A zoning permit application has been filed for grading relating to a washout repair within 75' of the OHWL located at 760 Tonkawa Road the ("Subject Property"), legally described as: Lot 13, Parton's Point 1:t Division, Hennepin County Minnesota. 2. Owners request the City to review this application. 3. The City will commence its review of the application and incur costs associated with said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owners. In the event that the Owners do not make payment to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced pursuant to #3.
