I understand from our building official, Lyle Oman, that someone from Hennepin County came into the office to say the contractors working on the new house on 724 Tonkawa Road destroyed the ditch. The Hennepin County employee wanted the City to see the ditch was repaired prior to us issuing a Certificate of Occupancy. Do you know the procedure for this? Are there certain requirements the county requires when this happens? I'd like the property owner/builder at 724 Tonkawa Road to receive a letter from HC stating what must be fixed/repaired and the City to be copied on the letter. A copy of the building permit application is attached. We can then work the HC and the homeowner/contractor to ensure it's repaired before issuing a CO. I look forward to hearing from you. I asked about this situation upon my return and it was my understanding that everything was resolved. Let me know if this is not the case. Before I left, I tracked down who contacted Lyle. It was Mark McClarity. Mark told me that the ditch is fine, but the shoulder is all tore up from the contractor doing work on this house. The shoulder was just redone by County forces last fall. The contractor ruined it this spring by parking along the shoulder. For procedural information: The contractor received its permit to do the work by the City. I'm assuming that there's a clause in your permit that they shouldn't adversely affect neighboring properties and/or they need to restore Right-of-Way areas to existing or better conditions. If you need a letter from Hennepin County, we can certainly do that, but I feel that the City has an opportunity (and a responsibility)to require adequate repairs for damage off the applicant's property as a direct result of a building project permitting by the City. If we do write a letter, it would be to the City to ask you to hold the Certificate of Occupancy. Let me know if further discussion is needed on this situation. Carolyn Fackler, P.E. Again, if you are not the correct person to help with the problem below, please let me know. The contractor and landscaper were in today asking some questions. When we were finished, I asked them if they had been contacted by Hennepin County and the issue brought to our attention about the"ditch". They said they hadn't been contacted by anyone from Hennepin County. Please advise the status of this issue. The shoulder of the county road must be repaired/reconstructed. Once the new home construction is completed, please repair the county road shoulder at the property. If you have questions regarding Hennepin County's standards, please contact Carolyn Fackler with the Permits Office. Once the repairs have been completed contact Carolyn again to schedule an inspection with Hennepin County Transportation Department for compliance.
