A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 78-330, 78-1288 and 78-1435 FILE NO. 11-3525 WHEREAS, Steve V. Zawoyski and Sara E. Zawoyski, a married couple (hereinafter "the Applicants") are the owners of the property located at 724 Tonkawa Road within the City of Orono (hereinafter the "City") and legally described as That part of Lot 10, lying Northwesterly of a line drawn through it equi-distant from the Northwesterly and Southeasterly lines thereof, "Parten's Point, First Division", Hennepin County, Minnesota (hereinafter the "Property"); and WHEREAS, the Applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-330(B) to allow construction of a new residence and detached garage on an existing lot 11,490 square feet (0.26 acre) in area and 50- feet in width at the OHWL and 50-feet in width at the 75-foot setback where 43,560 square feet (1.0 acre) in area and 140-feet in width are normally required; and WHEREAS, the Applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1288 to allow 32.9% hardcover within the 75'-250' zone where 25% is normally allowed in conjunction with the construction of a new home and new detached garage; and WHEREAS, within the 0 to 75' foot zone 82 square feet of permitted hardcover currently exists; and WHEREAS, the Applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1435 to allow a 15-foot rear, street setback for a detached garage with doors which face the street where a 30-foot setback is normally required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on September 19, 2011 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. Page 1 of 5 O O � CITY of ORONO ti RESOLUTION OF THE CITY COUNCIL `�kEsKOw, NO. 6 0 8 3 NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 11-3525. 2. The Property is located in the LR-1B One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acres and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on September 19, 2011 and recommended approval of lot width, lot area, rear street setback and 75' to 250' zone hardcover variances based on the following findings: a. The Property contains 11,490 square feet (0.26 acre) in area and has 50 feet in width at the OHWL and 50 feet in width at the 75-foot lake setback. b. Sanitary sewer is available. c. There is no additional land available to bring the lot area into conformity. d. The Applicants' proposal results in an overall total reduction in hardcover from the current level of 828 square feet. e. The location of the Property along Tonkawa Road/CSAH 135 requires a driveway turnaround be provided on site. f. The topography of the Property creates a practical difficulty for locating a detached garage without the necessity to import additional fill material to the Property. g. The Applicants' request will alleviate a practical difficulty inherent to the Property and not created by the Applicants. h. The Applicants' request will not alter the essential character of the neighborhood and will result in minimal negative impact on adjacent properties. The Applicants have demonstrated that enforcing the 75' to 250' zone hardcover, setback, lot area and lot width provisions of the Zoning Ordinance deprive the Applicants of the reasonable use of their Property. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicants, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-330(B) to allow construction of a new residence and detached garage on an existing lot 11,490 square feet (0.26 acre) in area and 50- feet in width at the OHWL and 50-feet in width at the 75-foot setback where 43,560 square feet (1.0 acre) in area and 140-feet in width are normally required; a variance to Orono Municipal Zoning Code Section 78-1288 to allow 32.9% hardcover within the 75'-250' zone where 25% is normally allowed in conjunction with the construction of a new home and new detached garage; and a variance to Orono Municipal Zoning Code Section 78-1435 to allow a 15-foot rear, street setback for a detached garage with doors which face the street where a 30-foot setback is normally required, subject to the following conditions: 1. Council approval is based on the survey and building plans submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibits A & B. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. Hardcover shall not increase above the existing and approved levels as follows: 82 square feet of hardcover within the 0 to 75' zone; 2,526 square feet (32.9%) of hardcover within the 75' to 250' zone. 3. The Applicant's building permit survey and plans shall address the city engineer's comments and recommendations. 4. The home plans submitted are for the purpose of hardcover review. The construction plans and survey submitted for building permit will be reviewed for conformance with Orono's building height and number of stories calculation. 5. Authorities granted by this resolution run with the Property not with the Applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction and commencing construction of said project. A framing inspection must be completed within one year of the date of Council approval, or the variance will expire on that date (October 10, 2012). 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor.
