A RESOLUTION REVISING RESOLUTION NO. 5857 FILE NO. 09-3414 AND RESOLUTION NO. 2324 FILE NO. 1227 o,�,. 0 0 CITY of ORONO ti ti RESOLUTION OF THE CITY COUNCIL S80 NO. 5 9 8 A RESOLUTION REVISING RESOLUTION NO. 5857 FILE NO. 09-3414 AND RESOLUTION NO. 2324 FILE NO. 1227 WHEREAS, Patrick Middleton and Kathleen Middleton, husband and wife (hereinafter "the applicants") are the owners of the property located at 720 Tonkawa Road within the City of Orono (hereinafter the "City") and legally described as follows: Attached as Exhibit A, Hennepin County, Minnesota (hereinafter the "property"); and WHEREAS, in order to construct a larger entry porch the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78- 1403 to allow 18.01 percent structural coverage when 17.85 percent was approved by Resolution No. 5857, 18.64 percent previously existed and 15 percent is allowed; and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1288 to allow an additional 317 square feet of hardcover in the 75 to 250 foot zone to allow for a sidewalk and other items not included in Resolution No. 2324. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. The Planning Commission reviewed this application at a public hearing held on January 19, 2010, and by a vote of 6 - 0 recommended approval of the revisions to the variances based on the following findings: a. Because of an error in calculating existing structural coverage, the original application appeared to be a request for additional structural coverage when in Pagel of 3 r 0,�. The 20 square foot increase in the size of the porch is minimal but will improve the functioning to the porch, which is at the main entrance to the house. b. The retaining walls were shown on the site plan with the staff report for the variance but not listed in the allowed hardcover on Resolution No. 2324. The sidewalk was necessary because of an unanticipated six to eight foot difference between the garage floor and grade at the rear of the garage. In conjunction with the construction of the garage a permit was issued for the sidewalk and building new retaining walls to replace the ones shown on the staff report, notwithstanding they were not listed as approved hardcover. Air conditioner units were not considered when hardcover was calculated in 1986. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby revises Resolution No. 5857 to allow 18.01 percent structural coverage when 18.64 percent currently exists. The Council also revises Resolution No. 2324 to allow 317 additional square feet of hardcover in the 75 to 250 foot zone, bringing the allowed hardcover to 4,860 square feet or 55.40 percent, subject to the following conditions: 1. Council approval is based on the site and building plans and hardcover calculations submitted by the applicants and annotated by City staff, attached to this resolution as Exhibit B, C and D; 2. An as-built hardcover survey shall be submitted prior to the scheduling of the Final Inspection for the addition. Resolution Nos. 2324 and 5857 otherwise remain in effect.
