A RESOLUTION GRANTING
A CONDITIONAL USE PERMIT �
� PER MUNICIPAL ZONING CODE
SECTION 10.24, SUBDIVISION 3 (A)
FILE#2632
WI�REAS,Temple Israel(hereinafter"the applicant")is owner of property located
at 645 Tonkawa Road,within the City of Orono(hereinaf�er"City")and legally described as follows:
Attached"Exhibit A", (hereinafter "property"); and
WHEREAS, the applicant has applied to the City for a conditional use pemut to
permit construction of a toiledshower facility on the property per Municipal Zoning Code Sectior�
10.24, Subdivision 3 (A); and
� WHEREAS,Section 10.24,Subdivision 3 A of the Munici al Code ermits clubs
� ) P P
and camps as a conditional use in the LR-1B district; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes,the Orono City Council held
a public hearing on October 23,2000,at which times all persons desiring to be heard concerning this
application were given the opporh,�nity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#2632.
2. The properry is located in the LR-1B, One Family Lakeshore Residential District.
3. The City Council approved a request to schedule a public hearing for October 23,
2000 for a CUP for Temple Israel. The request is to permit a toilet and shower

facility on the property,with the condition that a full CUP application for the Camp
use be submitted prior to issuance of a Certificate of Occupancy.
4. No CUP has ever been issued for Camp Teko. The use has been"grandfathered"as
the properry has been in use as a camp since before adoption of the zoning ordinance.
Before Camp Teko the property had been used as a Boy Scout camp. A CUP had
been applied for in 1989 to permit an expansion to the main building for Camp Teko.
The item had been reviewed by the Planning Commission,but before Council review
the applicant had withdrawn the application.
5. The Municipal Code requires accessory buildings, for the proposed use, to meet a
minimum setback of 50' to property lines. The proposed location of the building
meets all required setbacks for new accessory structures on the property.
6. The City Council fmds that granting a conditional use permit to permit construction
• of a toiledshower facility will not be detrimental to the health, safety or general
welfare of the public, will not adversely affect light, air nor pose a fire hazard or
other danger to neighboring properties, nor will its use depreciate surrounding
property values and that the proposed level of use of the property will be in keeping
with the intent and objectives of the Zoning Code and Comprehensive Plan of the
City.
7. The City Council has considered this application including the findings and �
recommendations of the Planning Commission,reports by staff and comments of the
applicant and the affect of the proposed use on the health, safety,and welfare of the
community.
CONCLUSIONS, 012�ER AND CONDITIONS
Based upon one or more of the above findings,the Orono City Council hereby grants
a conditional use permit per Municipal Zoning Code Section 10.24, Subdivision 3 (A), subject to
the following conditions:

1. Applicant shall submit a CUP application for the Camp use of the property prior to
a Certificate of Occupancy being issued for the new building.
2. Authorities granted by this resolution are permissive on�y and must be exercised by
application for a building permit within one year of the date of Council approval or
this conditional use pernut will expire on that date (November 13, 2041).
3. Violation of or non-compliance with any of the terms and conditions of this
, resolution shall constitute a violation of the Zoning Code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
4. The undersigned applicant and owner has read,understood and hereby agrees to the
terms of this resolution and on behalf of himself,his heirs, successors and assigns,
hereby agrees to the recording of this resolution in the chain of title of the property.
• Adopted by the Orono City Council on this 13th day of November, 2000.
