' 2 BIDDERS INSTRUCTIONS ' FOR TEMPLE ISRAEL ROOF REPLACEMENT ' NOTE TO ALL BIDDERS The following Scope of Work is considered to be an integral part of the ' specifications. Contractor will coordinate with Temple Israel on this project. A pre-bid conference will be held on June 28, 1994 at 9:00 A. M. at the Camp Teko on behalf of Temple Israel. A prerequisite for any Contractor wishing to bid this project ' means the Contractor or his Subcontractors must be present at the Pre Bid Meeting. Any bids supplied by contractors not at the Pre-Bid meeting will be null and void. ' Sealed bids will be received on July 8, 1994 at 11:00 A. M. to furnish all labor materials, tools equipment, transportation and all else necessary to complete the described work. ' Bid opening will be private and not public. All bids become the property of Temple Israel. ' All roof tear off will be removed from Job site to an approved State Land Fill. Failure to comply to all rules and regulations becomes the responsibility of the Roofing Contractor. All Contractors must conform to the most current rules and regulations of OSHA. ' Roofing Contractor to remove only as much roof as can be replaced on that day to insure water tightness of roof. ' Field Measurements: The applicator shall have the sole responsibility for the accuracy of all measurements, and for the estimate of material quantities required and necessary to satisfy the requirements of these specifications. ' Late or incomplete quotations may be viewed as "NO BID". 1 3 ' INSTRUCTION TO BIDDERS EXAMINATION OF SITE AND DOCUMENTS ' Bidders shall examine all documents, shall visit the site and record their own investigation, and shall inform themselves of all conditions under which the work is to be performed at the site of the work, the obstacles which may be encountered, all of the conditions of the documents, including obstacles of the work, requirement of ' temporary heat, time of completion, furnishing a list of subcontractors, and all other relevant matters which may affect the work of the bidding. The bidder shall base his bid on materials complying with the plans and specifications. He shall list all ' materials where the proposal form requires. ' 2. INTERPRETATION AND CHANGES BY ADDENDA If any bidder is in doubt as to the meaning of a part of the Plans and Specification, they may submit a written request of the Project Manager for an interpretation on that part. Any interpretation or change will be made only by addendum numbered, dated, and issued to each bidder on record of receiving a set of documents. The Project Manager will not be responsible for any other explanations or interpretations of the document. 3. PREPARATION OF PROPOSAL ' The bidder shall submit his proposal on the forms furnished. The blank space in the proposal must be filled in correctly with ink or typewritten. A bid containing an alteration or erasure of any price contained in the bid which is used in determining the lowest responsible bid shall be rejected unless the alteration or erasure is corrected as herein provided. An alteration or erasure may be crossed out and correction printed in ink or typewritten adjacent to and initialed in ink by the person ' signing the bid. In the event that any price used in determining the lowest responsible bid is expressed by the bidder in both written and numerical form, the written representation shall govern in all cases. If the proposal and specification ' include alternates, each bidder must bid on each alternate and shall submit only one bid. Alternates will be accepted in the numerical order in which they appear. The bidder shall submit with his bid all catalogues, drawings, warranties, specifications, descriptive information and other detail of special equipment ' proposed to be furnished if the proposal form so requires. Failure to comply may be cause for rejection. ' 4 1 r rProposals shall be signed by the individual if the proposal is submitted by a sole owner. Proposals of partnerships shall be signed by two partners. Proposals of ' corporations shall contain the correct name of the corporation, and the state of incorporation. The signature of the president, or other authorized officer of the corporation shall be manually written below the name of the signed official other than ' the president, the certified copy of the resolution of the board of directors showing the authority of the official to sign the bid, should be attached to the bid. ' Bids of individuals or partnerships, if signed by an attorney-in-fact should have attached to the bid the power of attorney, evidencing the authority to sign the bid. If the bid is signed by any other legal entity, the authority of the person should be ' attached to the bid. ' 4. QUALIFIED PROPOSALS The bidder shall not stipulate in his bid any condition not contained in the specifications and other documents submitted for bid. r5. DELIVERY OF PROPOSALS Each proposal and all papers bound and attached to it shall be placed in an envelope and security sealed therein. The envelopes shall be marked to indicate ' the following: 1. The name and address of the bidder. 2. The name of the project and location. 3. The nature of the bid (type of contract). rThe envelope shall be addressed to: MR. DAVID SUSSMAN TEMPLE ISRAEL 2324 EMERSON AVE. SOUTH MINNEAPOLIS, MN 55405 1 Proposals shall be at the above office before the time set for the opening of the proposals. ' Proposals arriving by mail or otherwise after the time designated for the opening of the bids will be returned unopened. Oral telephone or telegraphic modifications will be accepted. r r r 5 ' 6. CONSIDERATION OF BIDS ' Temple Israel reserves the right, in the determination of the lowest responsible bidder, to consider the ultimate economy as affected by the cost of operation, maintenance, and repairs in the best interest of Temple Israel and such, other ' factors as may be reasonably determined to affect the ultimate economy of the award. ' Temple Israel reserves the right to accept or reject any or all bids, or parts of bids and to waive informalities therein. ' For the purpose in determining the lowest responsible bidder in the consideration of all bids submitted, Temple Israel reserves the right to accept or reject any bid or alternates in the numerical order in which they appear on the Bid Proposal form and ' as it may consider in its best interest. ' 7. UNIT PRICES In cases where any part of the bidding is to be received on the unit price basis, the quantities stated are approximate only, and will be used in making a comparison of bids. Each bidder will be required to make his own estimate of the actual quantities involved and to calculate his unit price bid accordingly. A bid of unit prices may be ' rejected if it is found to be unbalanced. ' 8. CONTRACT The Bidder to whom award is made, will be required to execute a written contract within 10 working days. The Contractor shall within 10 days of signing the contract, submit in writing to the Project Manager a complete list of all items of work which he proposes to sublet and ' the names of the subcontractors to whom he proposes to sublet such work. The subcontractors named shall be recognized standing with a record of satisfactory performance. The Contractor shall not employ any subcontractor or use any material to which the Project Manager may object as incompetent, unfit, or where there is reason to assume the work will not be accomplished in accordance with the Contract Documents. Prior to the employment of the named subcontractors. the subcontractors must be approved in writing by the Project Manager. 6 9. STATE EXCISE AND PERMITS ' In submitting the bid, the bidder is understood to have included in the bid price the State taxes on all sales of building materials, supplies, and equipment to contractors, subcontractors or builders for the erection of buildings or the alteration, repair or ' improvement of real property. The bidder shall also have included all permit fees necessary to do business in the cities where the work is to be performed. Temple Israel will not be responsible for either of the above. 10. EXECUTION OF CONTRACT Owners Right to Reject Bids: The owner reserves the right to accept any Bid, and to reject any or all Bids. ' Qualifications of Bidders: Each bidder shall be prepared, if so requested by the Owner, to present evidence of his experience, qualifications and financial ability to ' carry out the terms of the Contract. 11. COMPLIANCE WITH LAWS All products must comply in quality and type of material and method of manufacturer ' with all applicable local and or state law pertaining hereto. ' 12. CERTIFICATE OF COMPLIANCE (MINNESOTA HUMAN RIGHTS ACT CHAPTER 363 MINNESOTA STATUTES.) A bidder having more than 20 full time employees in Minnesota at any time during the previous 12 months and bidding on a contract exceeding $50,000, must show prior to award that he is a holder of a Certificate of Compliance Issued by 1 Commissioner of Human Rights. All bidders must complete this portion of the proposal on bids in excess of$50,000. Failure, to do so will be considered grounds for rejection of such incomplete bids. 13. TITLE IX COMPLIANCE NOTICE -- NONDISCRIMINATION POLICY "As required by Title IX of the Non Discrimination Policy Amendments of 1972", notification is being given to all contractors or entities providing benefits or services to Temple Israel employees, of the non-discrimination policy adopted by Temple Israel, states as follows: 7 ' EQUAL OPPO TUNITY ' "It is the policy of Temple Israel in compliance with current federal and state statutes and regulations, and in recognition of its obligation to provide equal opportunity for ' education and employment for all persons within its jurisdiction, not to discriminate on the basis of sex, race, religion, color, national origin, economic status, disability, age or marital status or personal practices". The Executive Director is designated as coordinator for compliance for all areas relating to educational program and ' personnel practices. Title IX prohibits Temple Israel from doing business with any contractor or vendor not complying with Title IX requirements. ' 14. NON-DISCRIMINATION ' All contractors and subcontractors shall conform to the State of Minnesota Statues Section 181.59 which prohibits discrimination in hiring of labor by reason of race, creed or color and all other laws, ordinances, and legal requirements affecting their work in Minnesota which is reproduced below: A. That in hiring of common or skilled labor for the performance of any work ' under Contract or any subcontract hereunder, no Contractor, Material Supplier, or Vendor shall by reason of race, creed or color discriminate against the person or persons who are citizens of the United States who are ' qualified and available to perform the work to which such employment relates. ' B. That no Contractor, Material Supplier, or Vendor shall, in any manner, discriminate against or intimidate, or prevent the employment of any such persons from the performance of work under any contract on account of race, creed or color. C. Any violation of this Section shall be a misdemeanor. ' D. That this Contract may be canceled or terminated by the State county, city, or any other person authorized to grant contracts for such employment, and ' all money due, or to become due hereunder, may be forfeited for any subsequent violation of the terms or conditions of this contract. 1 8 SUPPLEMENTARY CONDITIONS ' OF THE CONTRACT ' 1. SCOPE ' The articles contained in the Supplementary General Conditions of the Contract may amend, modify, supersede, void or supplement the Articles of the General Conditions of AIA Document, A201, and when applicable, and if used, AIA Document A201/SC (latest edition) and shall take precedence over the provisions of the General Conditions. Where any part of an article of General Conditions is not so amended, modified, superseded or voided by a provision of the Supplementary ' General Condition, such part shall remain in effect. ' 2. CONTRACT DOCUMENTS Article I of the General Conditions is amended as follows: The Contract Documents include bidding documents including the Instruction to Bidders, samples of forms, the Contractor's Bid and any addenda thereto. ' 3. ARBITRATION ' Arbitration referred to in Article 2.2.12 and described by Article 7.9 of the General Conditions does not apply to Contracts within the State of Minnesota. The following paragraphs apply: ' In case any question, dispute, or controversy arises between Temple Israel and the Contractor out of any provision of the Contract Documents, such dispute of controversy-shall be referred to a neutral individual or organization designated by the Commissioner of Administration such as the American Arbitration Association or the Office of Administrative Hearings, whose decision shall be final and binding upon ' all parties. All costs of arbitration shall be born by the party demanding arbitration subject to any award of costs by the arbitration panel. In case any question, dispute of controversy arises between the contractor and other independent specialists, ' consultants, or contractors separately employed by Temple Israel, such dispute or controversy shall be referred to the Commissioner of Administration whose decision shall be final and binding. ' The venue for arbitration is herein agreed to be Hennepin County, State of Minnesota, unless otherwise specifically agreed. ' The Contractor shall carry on the work and maintain the progress schedule during any arbitration proceeding, unless otherwise agreed by the Contractor and the Owner in writing. 9 1 ' 4. OWNER ' The owner referred to in Article 3 of the General Conditions is Temple Israel. In addition, Article 3.2.2 is amended to delete the requirement that Temple Israel ' provide a legal description of the site. ' 5. MATERIAL AND EQUIPMENT Article 2 of the General Conditions is supplemented as follows: ' Makes and Models of items which the Contractor alleges to be equal to the makes and models of items named in the Specification, shall be subject to written approval ' by the Project Manager. The use of substitute items will not be permitted without the approval of Temple Israel and the Project Manager. The Contractor shall not be relieved from the responsibility of furnishing articles or materials equal in quality, ' specified by the Project Manager. The Project Manager's approval or rejection of a proposed substitute may be based on any of the previous considerations, and his decision, which may or may not express reasons to the Contractor, not a Subcontractor. The material or equipment shall be sufficiently described to enable the Project Manager to easily identify the salient features. Requests shall be made at least 10 days prior to bid opening date. ' 6. PERMITS LICENSES AND FEES ' Article 4.7 of the General Conditions is supplemented as follows: The contractor shall secure and pay for all permits in accordance with the City and ' State Codes. Where an inspection and/or certificate is required by the Code, to be paid for by a fee, the Contractor shall include such fees in their Bid and in the Contract. ' 7. CHANGES IN THE WORK In Article 12 of the General Conditions of the Contract and throughout the Contract Documents whenever the term "Change Order" is used, substitute the term "Supple- mental Agreement". Substitute the following for Article 12.1.3 of the General Conditions of the Contract. The value of such additional, omitted or changed work shall be determined in either ' or both of the ways described hereinafter. A. By unit price contained in the Contractor's original bid and ' incorporated in the construction contract. 10 ' B. On the basis of the actual cost of materials and labor on the job site, a maximum of 10% on materials and 10% on labor for Contractor's ' overhead and profit, which shall include the cost of Insurance and field supervision. If the work is done by a subcontractor, the Prime Contractor may add not more than 10% for his general overhead and ' profit. In preparing the Supplemental Agreement, the following document must be provided: 1 1. A breakdown of material and an hourly breakdown of labor must be shown on each supplement submitted. ' 2. All supporting documents must be incorporated by reference on each supplement. ' 3. Corrections must be dated and initialed by the Contractor and Project Manager. 4. The contract summary must be complete, and adequate justification and supporting documentation must be included with each supplement. 8. PAYMENTS AND COMPLETION ' Article 9, "Payment and Completion" is supplemented by the following: ' Unless otherwise provided in the specifications, Temple Israel in making partial payments, will retain ten (10) percent of the duly approved value of the work performed under contract as of the date of the application for payment until final completion and acceptance of all work covered by the Contract. ' Payment request will be made on AIA forms G702-1978 and G703-1978. Request for payments will be given to Project Manager for his review and approval. ' Temple Israel may at its discretion, withhold final payment until the Contractor has filed with the Temple Israel an affidavit showing evidence that all claims against him ' by reason of the Contract have been paid or satisfactorily secured. In case such evidence is not furnished, Temple Israel may retain from any amount due said Contractor sums sufficient to cover all claims unpaid. All Contractors and Subcontractors shall comply with the provisions of Minnesota Statutes 290.92 relative to the withholding of Income Tax on wages and no final ' settlement with any Contractor shall be made until said Contractor has offered satisfactory proof that he has complied with the provision of the Withholding Section of the Statute: ' 11 ' 9. INSURANCE The Contractor will during the life of the contract maintain the following Insurance Coverage: A. Minnesota Workmen's Compensation: Employers, Liability Insurance with limits of not less that $1,000,000.00 and where required by state law, and any Insurance required by any Employee Benefit Acts or other statutes applicable, as will protect the Contractor and Subcontractor(s) from any and all liability under the aforementioned Acts. ' B. Comprehensive General Liability with Limits of: $ 500,000 Each Occurrence Bodily Injury $1,000,000 Aggregate Bodily Injury $ 250,000 Each Occurrence Property Damage $ 500,000 Aggregate Property Damage The Comprehensive General Liability shall provide all of the following coverages: ' 1. Operations of the Contractor 2. Operations of the Subcontractor(s) (contingent) 3. Products/Completed Operations (to be carried for 1 year after ' completion of Contract) 4. Broad Form Property Damage (including completed operations) 5. Personal Injury Liability (Penals A, B, C) 6. Employees as Additional Insured 7. Property Damage Hazards-Explosion, Collapse, and Underground (if an exposure exists) ' 8. Broad Form Blanket Contractual Such insurance shall insure the General Contractor and/or Subcontractor(s) and Project Manager against any and all claims for bodily injury, including death resulting ' therefrom, and damage to the property of others and arising from his operations under the Contract, and whether such operations are performed by the Contractor, Subcontractor(s), or any of their Subcontractors, or by anyone directly or indirectly employed by any of them. This insurance shall cover the Project Manager/Consultant. ' TEMPLE ISRAEL assumes no responsibility in the event that the limits set above are not adequate. ' 12 C. Comprehensive Automobile Liability Insurance: ' Including the ownership, maintenance, and operation of any automotive equipment owned, hired and non-owned, in the following minimum amounts: $1,000,000 Bodily Injury, each person $1,000,000 Bodily Injury, each occurrence $ 500,000 Property Damage, each occurrence $ 500,000 Property Damage, each aggregate Such insurances shall insure the General Contractor and or Subcontractor(s) against any and all claims for bodily injury, including death resulting therefrom, and damage to the property of others caused by accident and arising from his operations under the Contract, and whether such operations are performed by the Contractor. This insurance shall cover the Project Manager/Consultant. Subcontractor(s) or any of their Subcontractors, or by anyone directly or indirectly employed by any of them. ' Temple Israel assumes no responsibility in the event that the limits set above are not adequate. ' In addition to the above limits, the Contractor shall carry an Umbrella Liability Policy in the amount of$1,000,000.00 each occurrence and $1,000,000.00 aggregate. D. Additional liability coverage for Owner and Project Manager will be provided: 1. By endorsement as additional insured on Contractor's General Liability Policy. ' E. Insurance Company P Y 1. The insurance must be written by a Company licensed for business in the State of Minnesota which the work is located and only by a Company acceptable to the Owner and Project Manager. Evidence of the coverage must be furnished prior to commencement of any work. Certificates shall state that the Owner will be notified in writing fifteen (15) days prior to cancellation, material change or renewal. 13 2. The insurance shall cover the full value of the Contract, together with all materials located on the site during the entire period of construction, and until said project is accepted in writing by Temple Israel. The Contractor shall be responsible for payment of all deductibles resulting from losses under the coverage provided herein. 3. The insurance shall be of the type know as "Multiple Peril Builder's Risk" policy on a completed value form. Such policy shall provide ' minimum coverage as recommended by the Construction Industry Cooperative Committee of Minnesota. In the event of occupancy the Contractor shall notify the insurance company and obtain a "Use of ' Occupancy Wavier" such that the policy will not be invalidated by occupancy. The Contractor shall file such endorsement with the Project Manager and Maintenance Supervisors. 10. LAYOUT OF WORK The Contractor shall take measurements and verify dimensions of existing or old work if any, that affect his work or to which his work is to be fitted. The ' Contractor alone shall be responsible for the correctness of all measurements and shall verify all grades, lines. levels. elevation and dimensions. ( 11. MISCELLANEOUS The following terms may have been stated but this will not alleviate Contractor from all set of Terms and Conditions. ' 1. That no extra work or changes done by the Contractor shall be paid for unless authorized by Temple Israel in writing. 1 2. That this Agreement constitutes the entire understanding of the parties and that this Agreement may be modified only by written agreement of both parties. t3. That absent contrary provision on the face hereof, the Job price includes all freight charges and all taxes assignable to the Job. 1 4. To protect partially completed work on the Job and equipment or materials left at the Job site and to be financially responsible for any damage occurring by Contractor's failure to do so. 14 ' 5. To indemnify and hold harmless Temple Israel, its agents and employees from all claims and expenses incurred in connection with any Iinjury to persons, or property in any manner connected with the execution of the Job by the Contractor, or the Contractor's agents or employees. 6. To be responsible for all incidental damages and expenses, relating to the Job caused by the Contractor, including but not limited to: cleaning up and removal of rubbish and debris, cleaning of outside soiled walls, and replacing broken glass. 7. Not to assign or subcontract this Agreement or any part thereof and not to ' assign any money due or become due here under without first obtaining the written consent of Temple Israel. ' 15 ' CONTRACT FOR ALTERATIONS SPECIAL PROVISION TEMPLE ISRAEL ' SUMMARY OF THE WORK: SP-1 Removal of existing roofing, insulation, sheet metal and any other items and furnish all labor, material, equipment, services and supplies required to complete the work which includes but is not limited to the following principal items; install new insulation and roof over existing deck as stated in the Scope of Work and Specifications. QUANTITY OF WORK: SP-2 The total quantity of work which will be required under this contract shall be determined by the contractor before submitting a bid. The summary is outlined in SP-1 above. ' WORK SCHEDULE: SP-3 All work shall commence after August 15, 1994 and be completed within Ninety Days. CONTRACT TERMINATION: SP-4 If the Contractor has breached the contract, the owner may terminate the contract. The owner may then have the work completed and bill the Contractor for all cost incurred in the completion of the work described in the contract. SAFETY -ADDITIONAL REQUIREMENTS: SP-5 Performance for Temple Israel: In the performance of the contract, the Contractor shall: A. Comply with applicable Occupational Safety and Health Standards (Title 29, Code of Federal Regulations, Par 1910) promulgated pursuant to the authority of the Occupational Safety and Health Act of 1970 and any and all updates. ' B. Comply with any other applicable Federal, State or local regulations governing workplace safety . 16 ' C. TAKE ALL OTHER PROPER PRECAUTIONS TO PROTECT THE SAFETY AND HEALTH OF THE CONTRACTOR'S EMPLOYEES AND THE PUBLIC. ' D. In addition to the foregoing, the Contractor shall coordinate his use of the premises with the manager or other representative designated by the Project Manager. Subjects of this coordination shall include: 1. The designation of work and storage areas. 2. The furnishing by Contractor of appropriate signs and barricades to exclude unauthorized personnel from the ' work area and to call attention to hazards and dangers. 3. Other matters relating to the protection of property, ' customers and the general public. ' PRE-CONSTRUCTION CONFERENCE SP-6 Before commencing work under this contract, a meeting will be held with the Contractor and his prime subcontractors, and representative of the Temple Israel and the Project Manager, to discuss the contractual procedure, safety regulations, work procedures, and so forth to be used to accomplish the work requested. The meeting will be held at the job site. SCHEDULING WORK SP-7 Before any of the work is started, the Contractor shall confer with the Project Manager and Temple Israel and agree on a sequence of procedure; means of access to premises and building , delivery of material, and use of approaches; use of corridors, stairways, elevators and storage of materials. Contractor shall inform Project Manager ' when all roof removal will be completed to allow for him to be present. Contractor shall abide by times established by Temple Israel PROTECTION AND DAMAGE SP-8 The Contractor will: A. Provide all labor, material, and equipment necessary for protection of personnel, furnishings, equipment, or building structure from damage. Remove and replace movable items, if necessary. Replace or repair any items damaged, due to work performed under this contract, equal to their present construction and finish. ' 17 B. Premises shall be kept neat and clean, so that business may proceed ' without interruption. C. Whenever flammable solvents or adhesives (Do not use unless ' nonflammable items are not suitable for the condition) are used, provide adequate ventilation and fire protection measures. Do not use flammable solvents or adhesives in any case when flame-or-spark producing operations are being performed in the area. 1 DEMOLITION - CUTTING AND PATCHING ' SP-9 The Contractor can cut, drill, alter, remove, or temporarily remove and replace building parts, as necessary for the performance of the contract work and approved by the ' Project Manager. Work that is replaced shall match similar existing work. Work remaining in place which is damaged or defaced by reason of work done under this contract shall be restored to the condition it was at the time of the start of the project. ' Any items which are to be removed and not to be reused in this contract shall be removed from the project, and shall become the property of the Contractor. USE OF BUILDING FACILITIES SP-10 Temple Israel will make available to the Contractor, from existing outlets and supplies to the extent that they are available, all reasonably required amount of utilities. The Contractor, at his own expense and in a workmanlike manner satisfactory to the Project Manager, shall install and maintain all necessary temporary connections and distribution lines, and he shall remove the same prior to final acceptance to the construction. ' Toilet facilities shall be provided by the Contractor. (Contractor will be responsible for any and all tracking or mess their employees make.) OWNER'S USE OF BUILDING SP-11 It is the Owner's intention to continue to use the building in the usual manner during the roof replacement. Therefore, the Contractor must schedule his work so as to not ' interfere with normal activities and shall coordinate his work with the Owner's roof areas over interior spaces having critical occupancy requirement. ' 18 ' SITE ACCESS AND AVAILABILITY SP-12 The project site will be made available to the Contractor upon receipt of the Owner's written notice to proceed. Care, custody and control of the site work area, equipment area and material storage areas are the sole responsibility of the Contractor during the term of ' operation. Failure to examine the project building and site and to become familiar with the ' existing conditions shall not constitute cause for complaint or claim for extra payment. Accept project site as it exists. ' Means of ingress or egress to the building shall not be blocked for any reason or hamper the normal operation of the building in any way unless permission is first obtained from the Owner. Fire protection and inundate access for fire fighting equipment must be maintained ' at all times. Equipment and material storage areas are limited to those designated. Fencing of ground ' work areas may be required to keep unauthorized personnel out of the area. INSPECTION OF SITE OR BUILDING SP-13 It shall be the Contractor's responsibility to ascertain possible conditions at each site, ' including such things as existing building material and components, etceteras, before finalizing work orders. TRASH REMOVAL SP-14 The Contractor shall be solely responsible for the removal of construction related trash. ' All material to be disposed of shall be loaded directly into trucks or other suitable storage containers by means of chutes or other methods that will prevent damage to existing, or new surfaces and to control pollution. No accumulation of materials to be disposed will be permitted at any time. The Contractor is responsible for prompt removal from the site and disposal in a manner approved by local authorities. The Contractor is solely responsible for disposal of material to approved State ' land fills. ' 19 ' PROTECTION ' SP-15 The Contractor shall provide for and be responsible for protection of existing structure not scheduled to be removed. All existing materials, surfaces and construction to remain which are not affected by the work shall be repaired, or replaced, to the original ' constructions. Provide all protective materials and methods as required to protect the existing building and ' adjacent surfaces, features and property. The Contractor is responsible for any damage, including from water or flying debris, resulting from work under this contract. Precautions shall be taken to protect the building grounds from damage due to necessary construction traffic. ' REPAIR OF EXISTING PROPERTY ' SP-16 The Contractor shall be responsible for patching of existing membrane, not scheduled for replacement or alteration, which is damaged during any sequence of the removal, or reroofing work. The Contractor is also responsible for any water damage to ' existing insulation and building interior finishes, furniture, equipment and work in progress that may result from damage to the existing roof membrane due to inadequate repair work. ' TRADE STANDARDS AND WORKMANSHIP SP-17 Workmanship shall be first class. In case of dispute and in the absence of any definite criteria or specification for work required under this contract, the association, institute or similar organization of the trade or material involved shall be guiding authority. ERECTION OF SIGNS AND-BARRICADES SP-18 The Contractor shall erect the necessary signs and barricades to insure the safety of all personnel, and general public. These signs shall be in compliance with OSHA Standards ' and shall be installed immediately upon commencement of work. ' CONTRACT DRAWINGS AND SPECIFICATIONS SP-19 The Contractor shall check all documents furnished him immediately upon their receipt and shall Promptly inform the Project Manager of any omissions or discrepancies from the following list: 20 One (1) set of drawings (included in specifications) and specifications will be furnished to the Contractors. CONTRACTOR SUBMITTALS ' SP-2 SHOP DRAWING, PROJECT DATA AND SAMPLES: 1. DRAWINGS, SCHEDULES. ETC. shall be prepared especially for, and pertinent to, this project containing only data applicable thereto Manufacturer's standard catalogs or submittal data not completely edited ' accordingly will not be accepted for checking. 2. IDENTIFICATION: - Materials and schedules. etc., shall be properly identified ' by specification number and shall bear the stamp of approval of Contractor. They shall be accompanied by a submittal Form listing and dating the submitted data in sets. Submit 4 copies of each of them. ' SPECIALTY: CONTRACTOR ' SP-21 The Contractor shall be experienced in Built-Up Roof Systems and Shingles. Prior to award, the Contractor shall submit the following as proof of his experience: ' 1. List of three previous contracts on built-up roof installation, together with names, phone numbers of the purchases of the service and location of the work. The minimum size of each project submitted shall be 25,000 square feet of new built-up roof installation. One of the projects shall have been done while the building was occupied. 2. Briefly describe the work procedures used in accomplishing the above work. 3. The Contractor-shall briefly but concisely describe what procedures would be ' used on this project in order to comply with OSHA regulations. ' 21 ' 4. Describe training program of employees in regard to safe procedures to be used on roofing projects. ' Prior to award, the contractor shall submit AIA Document entitled "Contractor's Qualification Statement". ' The bid may be rejected if the prime contractor cannot demonstrate a satisfactory history of performance and level of capability leading to successful contract completion. SMOKING POLICY ' SP-22 The Contractor will follow the following rules in regard to smoking. A. No person may smoke or use a tobacco product in any portion of the building. B. The term "smoke" shall include a cigarette, cigar or pipe: carrying a lighted ' cigarette, cigar or pipe. The term "tobacco product" shall include the chewing of tobacco or snuff of the consumption of any other tobacco product. The utilization of any smoke or tobacco product, as long as it does not generate smoke, is not permitted under this policy. 22 1 SCOPE OF WORK FOR ' TEMPLE ISRAEL ' BUILT-UP ROOF REPLACEMENT 1. Remove all existing rubber membrane built-up roofing, flashing, and metal work ' roofing to be removed down to the deck. tkstb#4W-coat�­bas6sheet and fasten as per NRCA details. t2. One layer of two inch (2") Isocyanurate Insulation and one layer of one-half inch (1/2") HD Fiberboard Insulation will be installed as the base layers of insulation. One layer of additional layer of High Density Fiberboard will be installed at base of shingle roof four feet wide. All joints of the insulation will be staggered. Tapered roof edge strip at one-half inch (1/2") down to zero (0") inches twelve inches (12") ' wide will be used to taper transition from one layer of HD Fiberboard to the next. 3. Wood blocking to meet top of new insulation before cant strip is installed. Install new 6"wood cant strip. ' 4. Install three (3) plies of Type VI Felt in a solid application of Asphalt Bitumen. 5. Install new Mineral Surfaced 160 Mil SBS Coated Polyester Membrane over base roof and at perimeter. ' 6. New Nervastrol will be used at perimeter. 7. Install new Kynar Coated scupper downspouts. All Scuppers are to be sumped. 8. Install new Kynar coated metal on perimeter. Metal to be two piece and cover the entire wood fascia. ' 9. Upon completion of roof work issue a Ten Year Manufacturer's. ' SHINGLE ROOF REPLACEMENT ' 1. Remove all existing shingle roofing, wood nailers down to the wood deck. 2. Install an underlayment of a 15 Ib asphalt base sheet as approved by the shingle ' manufacturer. Fastening to the existing wood deck as needed. 4. InstaWnew pressure treated wood blocking where shingle roof meets flat section. i 23 ' 5. Install new Soffit vents. ' 6. Install R-61 Roof Vents as specified. 7. Install new 30 year GAF (or approved equal) Shingles as specified. 1 1 ' 24 ' ROOF REPLACEMENT ' FOR TEMPLE ISRAEL SHINGLES ' PART I GENERAL ' 1.01 WORK INCLUDED A. Furnish and install Insulation, Asphalt Fiberglass Shingles, Kynar Coated ' Fascia and Flashing, and Deck Repairs. Roof systems as approved by Consultant and as specified. ' 1.02 SYSTEM DESCRIPTION ' A. All existing shingles, plywood, and base sheet shall be removed from the roof surface. Substrate shall be clean and prepared for application. ' B. Install one layer of 15 Ib. base felts as per approval. C. Fiberglass shingles shall be applied over the designated roof area. ' D. Kynar coated Fascia flashing system shall be installed as specified. E. Miscellaneous flashings, caulking and accessories shall be installed. ' 1.03 QUALITY ASSURANCE A. Application Qualifications: 1. The applicator shall be experienced with shingle installation and substrate preparation and methods of application. 2. The applicator shall be trained by and acceptable to the manufacturer. ' 25 1 3. The applicator must have on file with the manufacturer and the building owner: a. Roofing Contractor Agreement. ' b. Statement of current Insurance coverage. ' 1.04 REFERENCES A. The fiberglass shingle, shall be evaluated under the following applicable ' standards of the American Society for Testing and Materials (ASTM). 1. Fiberglass Ply Sheets: ASTM D-4977-89 Granule Loss ASTM D-3426-87 Asphalt Bitumen 2. Asphalt Base Sheet: ASTM D-1628 Grab Tensile ASTM D-5 Tensile Strength 1.05 DELIVERY, STORAGE AND HANDLING A. Delivery of Materials: 1. Deliver materials to the job site in new, dry, unopened and well marked containers indicating the names of manufacturer and product. ' B. Storage of Materials: 1. Shingles, and base sheet, must be stored in a dry place or otherwise protected from water or extreme humidity. 2. All roll materials should be stored on end to prevent their becoming deformed or damaged. ' 3. Stack insulation on pallets at least 4" above the ground and cover with a breathable covering such as canvas. All coverings must be secured at the end of each work day. ' 26 1 ' C. Handling Materials: ' 1. Handle ply sheets and shingles to avoid bending tearing or otherwise damaging them during transportation and installation. 1.06 SITE CONDITIONS A. Existing Conditions: 1. The building space directly under the roof covered by this specification will be utilized for concurrent and on-going operations. These operations shall not be interrupted by the applicator unless prior written approval is received from the Owner. Under no circumstances will the contractor work at times that are disallowed by the time instructions enclosed in this package. B. Environmental Requirements: 1. No installation work shall be performed during rainy or inclement weather. C. Protection of Persons and Property: r1. Initiate, maintain and supervise all safety precautions and programs in connection with the work. All current OSHA requirements will be met tand are the responsibility of the contractor. 2. Take all reasonable precautions for the safety of persons, and provide all reasonable protection to prevent damage, injury or loss of property. 3. Give all notices and comply with all applicable laws, ordinances, rules, regulations and orders of any public authority bearing on the safety of 1 persons and their protection from damage, injury or loss. 4. Promptly remedy all damage or loss to any property caused in whole or in part by the Contractor any subcontractor, or anyone for whose acts deem them to be liable, except damage or loss attributable to the acts or omissions of the Owner or his representative or anyone directly or indirectly employed by either of them. They may be liable and not attributable to the fault or negligence of the Contractor. 5. Provide protection so as to minimize interference with and interruption to the normal process at the Temple Israel . ' 27 ' 6. Advise the Owner whenever roofingwork is to be expected to be P ' hazardous to the Owner's employees. 7. Maintain a crewman as a floor area guard whenever roof decking is being repaired or replaced. 8. Maintain fire extinguishers within easy access whenever power tools, are being used. ' 9. Move traffic barriers and signs as needed to permit maximum traffic flow on Owner's property. 1.07 SEQUENCING AND SCHEDULING A. Install all base sheet at least throughout the anticipated work area, each day prior to any shingle application. B. Complete all specified carpentry and wood component installations at least throughout the anticipated working area each day prior to a shingle application. 1.08 UNIT PRICES rA. As directed by the Specifier or Owners Representative, submit unit pricing for: ' 1. Deck Replacement per square/ft. 1.09 WARRANTY A. Field Measurements: ' The applicator shall have the sole responsibility for the accuracy of all measurements, and for the estimate of material quantities required and ' necessary to satisfy the requirements of these specifications. 3.02 ROOF REMOVAL SYSTEM I A. Remove only as much roofing as can be restored to a watertight condition each day or before showers commence. Plan work and take whatever action is necessary to prevent water from entering the building during roof replacement. B. Remove only those shingles that can be replaced in a days work. ' Remove dust and debris from the roof areas and premises. All debris is to be removed to an approved State Land Fill. ' 3.03 CLEANING ' A. Remove loose debris, dust and foreign matter from the roof. B. Remove debris from premises. 3.04 ROOF DECK REPAIRS A. As directed by the Project Manager. 3.05 CARPENTRY A. As directed by the project manager, replace all areas of wood including ' wooden nailers and wood blocking. See Scope of Work for additional information. ' B. Wood nailers and blocking to meet the top elevation of new roof insulation. ' 31 C. Severely warped wood members cannot be used. D. Fasten new nailers with common nails, having annular or spiral shanks. 1. Nails shall be long enough to penetrate by at least 1-1/4 inches. 2. Place nails in two rows staggered, with nails spaced in each row at 24 inches on center along each row. ' 3. Within 20 feet of outside comers, space nails in each row 12 inches on center along each row. C. Comply with other applicable recommendation of Factory Mutual Loss Prevention Data 1-49. ' L 3.06 APPLICATION OF ROOF SHINGLES E A. Install new Inorganic Fiberglass Shingles in shingle fashion and placed to ensure that water will flow over or parallel to but never against shingles. B. An underlayment consisting of a Ice and Water Shield at the base of the roof two feet up. Apply when roof surface is dry and dew has left the ' roof. C. Apply 15 Ib base felt parallel to the eaves lapping each course of the felt ' over the lower course at least 2" and where ends join, lap the felt at least 4". D. Apply the felt and shingles on the same day. Do Not apply Base Felts and leave exposed to the weather. ' E. Fasten the shingles with standard type roofing nails (Staples not allowed) Nails should be 11 or 12 gauge wire. Heads should be 3/8" to 7/16" in diameter. F. Drive nail head flush with shingle surface. G. Install R-61 roof vents daily. Five vents will be installed on long roof section and three on short. ' H. Apply Fiberglass Shingle as per Manufacturer Specification. ' 32 ' 3.07 FLAT SECTION A. Install three plies of Type IV felts set in a solid mopping of asphalt. B. One layer of a 160 mil Mineral Surfaced will be installed in a solid mopping of steep asphalt. Apply extra mineral surfacing into hot asphalt. 3.08 CLEAN UP A. Clean Up: ' Immediately upon completion of all work specified the roof membrane surfaces and the ground set-up shall be cleaned of any debris, construction dirt or other flaws in appearance. 3.09 FIELD QUALITY CONTROL A. Authorized Field Representative: ' 1. The designated project representative shall make periodic job-site inspections to observe and report on job progress and quality of work in progress and work completed to date. ' B. Final Inspection and Approval: ' 1. Formal final inspection of completed work shall be made jointly by the designated Project Representative, Owner's Representative and the Roofing Contractor. 3.10 ADJUSTING AND CLEANING ' A. Repair of Deficiencies: 1. Installations or details noted as deficient during Final Inspection must ' be repaired and corrected by the applicator, and made ready for re-inspection within five (5) working days. 33 ROOFING WARRANTY ' FIVE YEAR CONTRACTORS WARRANTY ' The Contractor named below hereby warrants to Temple Israel that during a period of five years from date of acceptance of completion of the Roofing Project that said Contractor will maintain the ' roof membrane and sheet metal in a water tight condition. Contractor will repair any defects not covered by Manufacturer's Warranty found to be caused by poor workmanship or improper installation. Repairs will be at no cost to Temple Israel. Contractor will further remove and replace at no additional cost to Temple Israel wet insulation caused by poor workmanship.
