He and our building official will be meeting on site to review the height and structural massing questions. Jorj confirmed the deck was constructed larger than proposed and will be reduced to be in compliance. The as-built survey shows grading changes within the 75'setback where no work was proposed. Please have your landscaper provide us with the earthwork calculations showing the total amount of disturbance within the 75'setback. Once the boat house changes have been made, have an updated survey and hardcover calculations submitted for our review. I also met with Jonathon Smith from Concept Landscaping. We have resolved our questions and have confirmed the riprap was replaced as proposed. Don't hesitate to contact me with any questions. We have been trying to work with the surveyors who has been on site from day one. We were doing all the measurements concerning the boat house being re-built in the same place with the same dimensions. Using a 3rd party contractor such as an surveyor was the request as the permits were issued. We followed all dimensions as mentioned on the plans and were verified by the surveyors and were filed and passed all the inspections all the way to the final inspection. I will be contacting you next week and possibly do a short meeting over the details. Thank you. I'm obviously not directly involved in the permitting & building on our property, but I have since spoken with both Jorj Ayaz - Aspen Builers (612-670-4999) and Jon Smith - Concept Landscaping (612- 750-2456). They've both reassured me that their intentions (and ours) during the remodeling work was to restore and replace things exactly as they were prior to the remodel. In my discussions with them, they feel fairly confident that they achieved these goals, however it sounds as if you have identified some areas that need clarification. It sounds like possibly some of this is hopefully just a matter of where the measurements were taken, such as in the case of measuring the boat house dimensions (foundation dimensions vs stucco wall/concrete terrace overhang dimensions). As far as the hardcover calculations, you are correct: - The driveway to the west (2,889 S.F.) will not need to be included in the calculations. - This would decrease the Net Existing Hardcover (17,822 - 2,889 = 14,933 S.F.). - This would put the total calculation at (14,933 / 66,681 = 22.39%) I didn't even look at the initial worksheet, I had just forwarded the document provided to me from Advance Surveying. 4 Can you let me know if you've had a chance to talk with Jorj and Jon, and if not possibly reach out to them for clarification. The existing boat house was 18.9' x 33.2'; the as-built boat house is 19.6' x 33.4'. This is an unpermitted increase of 0.7 feet in width and 0.2 feet in length, or 27.16 square feet. • Our building official visited the property on October 11, 2018 and noted also that boat house exceeds the height and width of the pre-existing structure. • NOTE: The building exceeds the in-kind replacement permitted, it will need to be reduced/modified to conform to the in-kind replacement; or you may apply for after-the-fact average lakeshore setback, lake setback, and hardcover variances. Please note the fact that the building exists today as-is is not a practical difficulty. 5 • A deck on the boat house and concrete stoop on the lake side of the boat house were shown on the approved/proposed plan. They are not shown on the as-built survey. Were these re-built? Grading, riprap, and retaining wall within 75-foot setback. • No grade changes were proposed or approved within 75' of the lake. The as-built survey shows that the grades were changed around the area of the boat house. Additionally, based on the surveys it appears that the riprap extends landward farther than it should, and that the retaining wall was changed or expanded. Please provide grading/disturbance calculations for the 0-75' zone. Note, only 50 cubic yard of total disturbance is permitted; and no change to the retaining wall was permitted. • A rip rap permit was issued by the MCWD, but it appears the retaining wall was possibly expanded without proper City approvals. Hardcover. • The as-built hardcover calculations submitted show the property at 26.73% where a maximum of 25% is allowed. It appears the access to the property via the western driveway was abandoned and now access to the property is only off of Frederick Street. If the access from the west is no longer benefitting the property, this bituminous driveway area can be removed from the hardcover calculations. Reference the City's Hardcover Information Packet. Hardcover in excess of 25% is not permitted and must be removed. The issues above must be resolved; the as-built survey is not approved. Please contact me with questions.
