CERTIFY RESULTS OF THE NOVEMBER 6, 2018, MUNICIPAL ELECTION – RESOLUTION NO. 6915 MINUTES OF THE ORONO CITY COUNCIL MEETING Tuesday, November 13, 2018 7:00 o’clock p.m. _____________________________________________________________________________________ Page 2 of 7 Dankey moved, Crosby seconded, to adopt RESOLUTION NO. 6915, a Resolution to Certify Results of the Tuesday, November 6, 2018, General Election for City of Orono Offices. VOTE: Ayes 4, Nays 0. PUBLIC COMMENTS Catherine Miller, Orono Woods, stated she has lived for 42 years. Miller stated she read an article in the local paper about the big 190-unit apartment building that is being proposed to be built in Orono and that she has a few concerns about it. Miller stated her concerns are whether Orono needs that type of housing, whether it is for people that work in the area, whether it is going to be low income housing, and whether they have housing here already. Miller stated she would like people to know there are those issues associated with it. Walsh noted anyone can bring a proposal before the City and that the public hearings are held at the Planning Commission where people can provide their input. Miller asked how people are notified of the meetings. Rief stated all public meetings are posted in the Laker Pioneer newspaper prior to the public hearing and then again when it goes before the City Council. Rief noted the proposal was just a preliminary sketch plan without a formal public hearing but that there will be other chances for interested residents to appear at a public hearing and provide input. Miller stated she is concerned that people keep moving further into the suburbs and that she is interested in hearing what other people have to say about it. PUBLIC WORKS/CITY ENGINEER REPORT 13. CRYSTAL BAY ICE RINK Edwards noted at the October 22 Council work session, the City Council discussed installation of an ice rink at Crystal Bay Park. The intent was for an ice rink to be installed in time for the 2018-2019 winter season. The Council also indicated a desire to see additional improvements made to the rink for the following winter, including lighting. Due to time constraints with completing an ice rink before the winter freeze, Staff initiated elements of the plan that fall below the Staff approval threshold, with the Public Works Department doing some site preparation work and then ordering an ice arena kit. The Park Commission reviewed the plan at their November 5 Park Commission meeting. The Commission endorsed the provision of an ice rink at the park but expressed concern about not being consulted on the project and not having time to fully develop a comprehensive plan. The Park Commission recommendation was that the City Council refer other ice rink items to the Park Commission for their review and input. Walsh noted this has been talked about for approximately 20 years. Printup stated the prospect of an ice rink at Crystal Bay has already generated some interest among the nearby residents. Printup indicated he has some information from 1994 showing that this was originally MINUTES OF THE ORONO CITY COUNCIL MEETING Tuesday, November 13, 2018 7:00 o’clock p.m. _____________________________________________________________________________________ Page 3 of 7 proposed back then so it is not a new concept for the Crystal Bay area. Printup stated when people say government moves slow, this is an example of that, but at least it is now getting done. Crosby commented in his view this will be great for the neighborhood and the children in the area. Walsh noted he spoke at the Park Commission meeting about the proposal and indicated that it was not intended to be a grandiose, expensive project, but that the idea was to make it as simple as possible since the intent was to test the general concept. The Public Works Department has acquired a kit and will be flooding the area with the help of the fire department. If it works out, the Park Commission can incorporate it into their plans and the City can budget for it. Printup noted the plan depicts the basketball court and skating rink, and then further up at the top of the paper it says Crystal Avenue, which does not go through. In the area where it says ice skating rink, to the right of that there are some plans for a berm, a fence, and a gazebo or a shelter as well as an evergreen tree with Christmas lights. Printup noted the next item on tonight’s agenda is holiday decorations, which has nothing to do with this, but that it is exciting that the City Council is tackling items that were raised years ago. Printup stated the ice rink has generated some excitement for the immediate neighbors. The resident that lives next to the property that says existing house is willing to contribute time and his experience with rinks. Printup noted this is not going to be like a huge ice rink but instead a little neighborhood rink. The meeting minutes from 1994 show that a lot of the same concerns were expressed then about the amount of activity. Walsh indicated he is in agreement the City Council should refer these types of things to the Park Commission but that this ice rink was discussed a long time ago and is intended to be a small rink. The City re-implemented the Park Commission, who has done a number of improvements to the various programs and are bringing life to the parks. Dankey asked if there will be some benches. Printup stated to his knowledge that is included in the plan for next year. Edwards noted there is already a bench there facing the sidewalk and the Public Works Department will turn it to face the ice rink. Printup moved, Crosby seconded, to approve the establishment of an ice rink at Crystal Bay Park for the 2018/2019 season, and to direct Staff and the Park Commission to develop a plan for the city ice rink, including improvements at the existing rinks. VOTE: Ayes 4, Nays 0. 14. HOLIDAY DECORATIONS Edwards noted at the October 22 Council work session, the City Council also discussed the acquisition of additional holiday decorations throughout the City. Current holiday decorations include the 32 holiday Cascade snowflakes on the Navarre light poles. The Council expressed an interest in establishing more color and providing some large ground mounted ornaments as well as decorating some of the trees with lights. The Council further expressed an interest in having a tree lighting ceremony at the Orono Golf Course, including decorating the clubhouse and one of the large pine trees with lights near the parking lot. MINUTES OF THE ORONO CITY COUNCIL MEETING Tuesday, November 13, 2018 7:00 o’clock p.m. _____________________________________________________________________________________ Page 4 of 7 Staff has contracted to have lights installed at the golf course and purchased some garlands and some wreaths for some of the street light poles down in Navarre. Edwards noted the items are broken out between 2018 and 2019. Walsh noted this item has been discussed in the past and that the City acquired some snowflakes a few years back and are now looking to expand that somewhat. Crosby asked if funding is the main concern and where the initial funding will come from. Edwards noted these are unbudgeted items and that it will come out of the General Fund this year. Staff is proposing to allocate future expenses to the Special Projects and Contingencies budget. Crosby commented he is a big proponent of this and that enhancing the holiday season helps the business district of Navarre. Dankey stated it also provides opportunities for people to get together and meet new people in the community. Crosby moved, Dankey seconded, to authorize the procurement of holiday decorations and expenses associated with the holiday lighting ceremony, and to direct Staff to adjust the 2019 General Fund budget to account for these items and events in the future. VOTE: Ayes 4, Nays 0. PLANNING DEPARTMENT REPORT – KEVIN LANDGRAVER, REPRESENTATIVE 15. LA18-000057 TEXT AMENDMENT: ACCESSORY BUILDINGS AND STRUCTURES SETBACKS, ORDINANCE NO. , AND SUMMARY ORDINANCE NO. Curtis reviewed the draft ordinance regarding proposed changes for Accessory Building and Structure setbacks. Currently there are many specific rules for accessory structures and buildings based on their size, the zoning district, lakeshore lot versus non-lakeshore lot, lot size, and location of the lot. These regulations have evolved over time and have become difficult to understand. In addition, the terms structure and building, although defined differently, are used interchangeably within the regulations. The Planning Commission has been working on this amendment since June. The code has been reorganized so that a user can find the majority of the information regarding principal building, accessory buildings, and accessory structure setbacks within the specific zoning district sections. Additional modifications were made in the Accessory Buildings and Structures and Non-encroachment sections. At their October meeting, the Commission reviewed and discussed the draft ordinance. The Planning Commission voted 7-0 to approve the proposed ordinance. Further, the Planning Commission opened a discussion and the public hearing at their June meeting regarding this text amendment. The text amendment was discussed and the public hearing was continued at each of the subsequent Planning Commission meetings. At the October meeting the Commission reviewed and discussed the draft ordinance provided by Staff. The Planning Commission voted 7-0 on a motion to approve the proposed ordinance. No comments from the public were received during the public hearings. MINUTES OF THE ORONO CITY COUNCIL MEETING Tuesday, November 13, 2018 7:00 o’clock p.m. _____________________________________________________________________________________ Page 5 of 7 The Council should review the draft ordinance tonight and provide feedback. Staff plans to place the final ordinance on the Council agenda in December. Walsh noted there have been various changes to the City Code over the past 30 years and it refers the reader to different sections of the Code. Staff has been attempting to clean the Code up over the past year. In 2019, the City will be employing a code expert to help codify the code and get rid of all the duplications and referrals to different sections. Walsh stated the goal is to simplify the process. While the cleanup of the code will probably cost $60,000, it has not been done for 30 years and needs to be done. Walsh requested Staff summarize any major or minor changes with the text amendment. Curtis stated the following changes are being proposed: 1. Correction and clarification between the terms building and structure. 2. Reorganization of all setback information into each zoning district section. 3. Clarification of the terms Accessory Structure Accessory Building, and Oversized Accessory Building. 4. Revised required setbacks for accessory buildings versus accessory structures. 5. Removal of one level of accessory building size-based setback tiers. Reduced to two different setbacks from three. 6. Removed the definition of “private recreational facilities”. 7. Language clean-up in the non-encroachments section. 8. Allowance for accessory buildings to follow the nonconforming lot width flexibility for side setbacks and expanded the flexibility to other zones. 9. Allowance for accessory buildings streetward of principal buildings only in RR-1A and RR-1B districts, with certain aesthetic conditions. 10. Expansion of the accessory building footprint limit based on acreage; both building size and total building footprint. Mattick stated his review of the draft ordinance involved ensuring that the definitions were correct, that the changes made sense, and that it was overall written correctly. Walsh stated since this code touches on a number of different things in the Code, that cleaning it up solves a lot of headaches for Staff. Mattick stated from his standpoint, one of the things to keep in mind is that the court has said the City has a lot of deference but that they need to learn how to do it clearly and to the point where someone can understand what it says. Walsh asked what the next step will be. Curtis indicated she will make another review of the draft ordinance to make sure all the references are correct. If it is acceptable at that point, the City Council can make a motion to adopt it at their meeting in December. Walsh stated nothing jumped out at him when he reviewed it but that it would be good to go through it one more time. Printup asked whether there are any items that Staff feels need to be further clarified. Curtis stated she is glad the City is finally addressing these things and that the new code should help people understand it better and make things easier for Staff. Walsh stated the whole goal is to get to a more logical and reasonable method of doing things. Walsh asked whether anyone from the public would like to comment on this item. Caroline Miller asked if the City is still concerned about hardcover and protecting the area lakes. Walsh noted the City Council redid the hardcover calculations a few years ago and that the City is very strict in the 0-75 foot zone. There were no further public comments. The City Council took no formal action on this item. MAYOR/COUNCIL REPORT Dankey congratulated Mayor Walsh, Council Member Printup, and Matt Johnson for winning their elections. Dankey noted her term is up at the end of the year and that she will miss everyone. Crosby thanked the veterans for their service. Crosby recognized Andy Gitori for his service. Gitori joined the Army in 2010, completed several tours, including Iraq and Afghanistan, and is currently stationed in Alaska. Crosby stated he is a terrific young man and dearly missed and that he would like to thank him for being Orono’s hero. Crosby noted Orono lost a special person by the name of Jim Cox Monday night. Jim Cox served over 45 years with the Long Lake Volunteer Fire Department, from April of 1964 to June of 2009, and during that time served more than ten years as assistant chief. Crosby stated he would like to send a special remorse and thoughts to his friends and family and that he will deeply be missed. Printup stated he would echo the comments of Council Member Crosby. Printup thanked Council Member Dankey for her service on the Council. MINUTES OF THE ORONO CITY COUNCIL MEETING Tuesday, November 13, 2018 7:00 o’clock p.m. _____________________________________________________________________________________ Page 7 of 7 Printup stated as it relates to the text amendment earlier this evening, the Council is trying to make things make sense and reasonable but that they are not selling out the soul of Orono as far as water quality and green space. Mayor Walsh thanked the veterans for their service and congratulated Aaron Printup and Matt Johnson on their election wins. Walsh thanked Council Member Dankey for her service on the Council. Walsh reported there was a mayors’ meeting this morning in Shorewood where they discussed aquatic invasive species. University of Minnesota representatives were there and spoke on the topic. Walsh stated the biggest thing that came out of the meeting is that the University people told everyone that when you take a mower out on the lake to cut and collect milfoil and flowering rush, you are basically seeding the lake. Walsh stated it was a very eye-opening conversation. A number of LMCD representatives were in attendance along with other mayors and council members. Richie Anderson was also in attendance. Walsh stated the LMCD is aware of the issue and will be discussing this in the future. Walsh noted there is a November 30 tree lighting ceremony at the Orono Golf Course. Santa will be there and a number of other activities are planned. Walsh thanked the local businesses for their donations to this event. CITY ADMINISTRATOR’S REPORT Rief reported Staff has been busy with elections over the past couple of weeks and that Orono had an excellent turnout this year, with 77 percent of registered voters voting. Approximately 1,600 of those votes were via absentee ballot. In addition, Staff had a meeting today about the 2020 census. CITY ATTORNEY REPORT Mattick stated there will probably be a closed session at one of the next two meetings to provide a recap of where things are at. Purpose. The purpose of this action item is to adopt a resolution making a selection not to waive the statutory tort limits for liability. 2. Background. Minnesota Statutes 466.04 limits a city’s tort liability to a maximum of $500,000 per claimant and $1,500,000 per occurrence. Because cities have the right to waive the liability limit, our insurance carrier, the League of Minnesota Cities Insurance Trust (LMCIT), requires that the City Council adopt a resolution stipulating whether the City will or will not waive the statutory limits under the laws. A waiver of the limits would result in increased liability exposure and an increase in premiums. 3. Cost. Because waiver of the statutory limits increases the amount that the LMCIT could potentially be responsible for, waiver of the limit will increase the city’s general liability insurance premium by approximately 3% ($1,500). The City also carries excess liability coverage in the amount of $2,000,000. A wavier of tort limits would increase this premium by 25% ($5,200). 4. Staff Recommendation. Staff recommends that the adoption of the resolution not to waive tort limits. The LMCIT liability coverage is designed to meet members’ coverage needs in a simple and foolproof manner. LMCIT uses its own unique coverage document to provide liability coverage to member cities. LMCIT structures liability coverage differently than private insurance companies typically do. One big difference is that LMCIT uses a single coverage document, rather than issuing separate policies to cover general liability, errors and omissions, police liability, and so on. For more information on liability see Handbook, Insurance and Loss Control. Handbook, Liability. The industry term “general liability” or a “commercial general liability” (CGL) policy refers to coverage issued to organizations to protect them from liability claims for bodily injury, property damage, and advertising and personal injury. The LMCIT liability coverage is technically not a CGL, but encompasses coverage for risks typically covered by a CGL. The LMCIT liability coverage is tailored specifically for cities in Minnesota and is much broader than a regular CGL policy. RELEVANT LINKS: League of Minnesota Cities Information Memo: 2/13/2017 LMCIT Liability Coverage Guide Page 2 A.Covered parties Generally, the following are covered parties under the LMCIT municipal liability coverage. •City and its officers, employees, and volunteers. •Relief associations. •Some joint planning boards. •Additional covered parties, on a limited basis, for organizations from which the city leases a premise or equipment. This additional insured status is only granted if the city is contractually obligated to have the lessor named as an additional insured. It only applies to bodily injury, property damage, or personal injury for claims that are made by the lessor due to the city’s acts during the terms of the lease agreement. •Independent contractors acting in the administrative capacity of medical director or medical advisor to the city ambulance service; or serving as a member of, or representing the city as a member of a committee, subcommittee, board, or commission. See Section III.I, Joint powers entities and Section III.Q, Separate city boards and commissions. If the city is required to add another party as an additional insured or additional covered party, LMCIT can add the party on the city’s municipal liability coverage by endorsement. Also, joint powers entities and the following city boards, commissions, and agencies are not covered parties unless they are specifically named or added by endorsement. •Gas, electrical, or steam utilities commissions. •Port authorities, housing and redevelopment authorities, economic development authorities, municipal redevelopment authorities, or similar agencies. •Municipal power or gas agencies. •Welfare or public relief agencies •School boards. •Independent contractors. B.Liability claims The LMCIT liability coverage provides protection for claims someone else makes against the city, an officer or employee, or another covered party. The coverage only protects these persons for actions arising from the course and scope of his or her duties. The coverage applies to damages and defense costs. Damages is specifically defined in the coverage document, but essentially it means money. However, certain items are specifically included and others are specifically excluded by the definition. In other words, in order to be covered the claim must be reported either within the coverage period or within an applicable extended reporting period if the city has left LMCIT (there are a few types of claims to which the extended reporting period does not apply). For certain types of claims, the coverage document further specifies when the claim is deemed to be made. Coverage only applies if the occurrence giving rise to the claim occurred after the applicable retroactive date, which is specified in the declarations. It is generally the date when the city first joined LMCIT or added the specific coverage in question. The coverage document further spells out how the occurrence date is determined for specific types of claims. Most cities have been LMCIT members long enough that the retroactive date is rarely an issue. C. Liability exclusions Since the LMCIT liability coverage is broad in scope, sometimes it’s easier to first look at what’s not covered by LMCIT rather than what is covered. Following are some of the standard exclusions to be aware of. Members should contact their agent or underwriter if coverage is needed in any of these areas. It’s possible LMCIT may be able to find a way to provide coverage, or at least help find coverage elsewhere. 1. Liability not covered See Section III.M, Open meeting law and bankruptcy lawsuits. • Damages arising out of a city’s bankruptcy, except some defense cost reimbursement coverage is available for city officials under the LMCIT defense cost reimbursement coverage. • Criminal proceedings. • Most non-sudden pollution. • Nuclear hazards. • War. • Amounts owed under contract. • Condemnation, except some regulatory takings. • Damage the city does to its own property. • Fixing the city’s own work. • Not paying employees for the work they did. • Recalling defective products. 2. See Section III.T, Special events. •Aircrafts (a drone is not considered an “aircraft” as long as it’s not designed for the transport of persons or property). •Architects. •Big boats. •Doctors, most nurses, dentists, pharmacists, and psychologists. •Liquor sales. •Motorized amusement rides, such as carnival rides. •Motor vehicle demolition derbies, racing, pulling contests, or stunt driving. •Prisons. •Railroads. •Rodeos. •Specialty type operations such as hospitals, clinics, nursing homes and licensed child care programs. •Stunting activities or events that involve a significant risk of serious injury to the participant, performer, or others, such as high-wire acts, base or bungee jumping, skydiving, circus type acts, and acts involving dangerous animals. D.Coverage limits LMCIT gives members options for structuring their liability coverage. The member can also choose either to waive or not to waive the monetary tort caps the statutes provide. It can also select from among several liability coverage limits. 1.LMCIT primary liability limits Minn. Stat. § 466.04. The statutory municipal tort liability is limited to a maximum of $500,000 per claimant and $1.5 million per occurrence. These limits apply whether the claim is against the city, against the individual officer or employee, or against both. LMCIT’s liability coverage provides a standard limit of $2 million per occurrence. Coverage limits that are higher than the statutory tort caps are in place for a couple reasons. See Section II.D.3.a, Statutory limits may not apply. First, the statutory liability limit caps the city’s liability for many types of claims. But some types of liability claims aren’t subject to the statutory tort caps, so the city’s potential liability is unlimited for some types of claims. Second, it’s increasingly more common to see contracts require more than the statutory limit of $1.5 million; a more common figure is $2 million. LMCIT’s higher limit meets this requirement, but if even higher limits are required, there is the option to carry LMCIT’s excess liability coverage to meet the additional requirements. In some cases LMCIT, in partnership with its reinsurers, can also issue an endorsement to increase the city’s coverage limit only for claims relating to a particular contract. In addition to the LMCIT coverage limit of $2 million per occurrence, there are annual aggregate limits (that is, limits on the total amount of coverage for the year regardless of the number of claims), for certain specific risks. Aggregate limits apply to claims arising out of the following: See Section III.B, Data security breach and computer-related risks. See Section III.J, Land use and special risk litigation. See Section III.D, Employees’ activities in outside organizations. •Products $3 million annually •Failure to supply utilities $3 million annually •Data security breaches $3 million annually •Electromagnetic fields $3 million annually •Limited contamination $3 million annually •Land use/special risk litigation $1 million annually •Activities in outside organizations $100,000 annually Failure to supply utilities applies to the failure to supply water, electricity, gas, or steam service. It also applies to damages arising out of the failure to supply phone and internet or other electronic data transmission services. Data security breach coverage carries a $250,000 annual aggregate/sublimit (part of and not in addition to the $3 million data security breach aggregate) for Payment Card Industry (PCI) fines and penalties and data security breach regulatory fines and penalties resulting from a data security breach claim. Limited contamination includes the sudden and accidental release of pollutants; herbicide and pesticide applications; sewer ruptures, overflows, and backups; lead and asbestos claims; mold claims; organic pathogen claims; hostile fire claims; and excavation and dredging claims. Excavation and dredging claims are subject to an annual $250,000 sublimit. These limits apply to both damages and defense costs. See Section III.J, Land use and special risk litigation. Land Use Incentive Program. Land use litigation coverage is provided on a sliding scale percentage basis, which is based on participation in LMCIT’s land use incentive. Coverage applies to both damages and litigation costs. 2.Statutory liability limits Minn. Stat. § 466.04. The statutory municipal tort cap is limited to a maximum of $500,000 per claimant and $1.5 million per occurrence. The LMCIT liability coverage provides a standard limit of $2 million per occurrence. See Summary of LMCIT Liability Coverage Options and the effects of choosing the various coverage structure options. At the city’s coverage renewal each year, it must decide whether to waive or not waive the statutory limits. There is no right or wrong answer on this point. It’s a discretionary question of city policy that each city council needs to decide for itself. a.Waiving the statutory limit Members who choose to waive the statutory limits are waiving the protection of the statutory limits, up to the amount of coverage the city has. Someone with a claim against a city that has waived the statutory limits would be able to recover up to the LMCIT standard limit of $2 million, rather than the statutory limit of $500,000 per claimant. Because the waiver increases the exposure, the premium is a few percentage points higher for coverage under the waiver option. A city may choose to pay more in premium for the waiver option because the statutory liability limit only comes into play in a case where the city is in fact liable and the injured party’s actual proven damages are greater than the statutory limit. Some cities as a matter of public policy may want to have more assets available to compensate their citizens for injuries caused by the city’s negligence. Waiving the statutory liability limits is a way to do that. There is no increase in risk if the city waives the statutory liability limits. In other words, there is no risk for the city to end up with liability if LMCIT doesn’t cover it. The LMCIT waiver form specifically says the city is waiving the statutory tort caps only to the extent of the city’s coverage. That’s not to say there is no risk the city’s liability could exceed its coverage limits. There are certain situations in which this could happen, but the waiver doesn’t increase that risk. See Section II.D.3, Purchasing higher liability limits. In those cases where the city waives the statutory limit, but also purchases the LMCIT excess liability coverage, a claimant could potentially recover more. For example, if the city has $1 million of excess coverage and chooses to waive the statutory tort caps, the claimants (whether it’s one claimant or several) could then potentially recover up to $2.5 million in damages in a single occurrence. If the city carries higher excess coverage limits, the potential maximum recovery per occurrence is correspondingly higher. See Section II.D.3, Purchasing higher liability limits. Carrying LMCIT’s excess coverage under the waiver option is a way to address an issue that some cities find troubling, and that’s: the case where many people are injured in a single occurrence caused by city negligence. An example is if a city vehicle negligently ran into a school bus full of children causing multiple serious injuries. Excess coverage under the waiver option makes more funds available to compensate the victims in this kind of situation. See Section II.D.3, Purchasing higher liability limits. The cost of the excess liability coverage is about 25 percent greater if the city waives the statutory tort caps. The cost difference is proportionally greater than the cost difference at the primary level because for a city that carries excess coverage, waiving the statutory tort caps increases both the per claimant exposure and the per occurrence exposure. b. Not waiving the statutory limit See Section II.D.3.a, Statutory limits may not apply. For cities who choose not to waive the statutory limits, the city’s liability is limited by the statute to no more than $500,000 per claimant and $1.5 million per occurrence. LMCIT’s higher coverage limits would only come into play on those types of claims that aren’t covered by the statutory limit. 3.Purchasing higher liability limits LMCIT makes available the option of carrying higher coverage limits than the basic limit of $2 million per occurrence. This coverage, called excess liability coverage, is available in $1 million increments up to a maximum of $5 million. There are several different reasons why cities may consider carrying LMCIT’s excess liability coverage. a.Statutory limits may not apply Minn. Stat. § 3.736. The statutory tort caps either do not or may not apply to several types of claims. Some examples include: •Claims under federal civil rights laws. These include Section 1983, the Americans with Disabilities Act, and so on. •Claims for tort liability the city has assumed by contract. This occurs when a city agrees in a contract to defend and indemnify a private party. •Claims for actions in another state. This might occur in border cities that have mutual aid agreements with adjoining states or when a city official attends a national conference or goes to Washington to lobby. •Claims based on liquor sales. This mostly affects cities with municipal liquor stores, but it could also arise in connection with beer sales at a fire relief association fundraiser, for example. •Claims based on a “taking” theory. Suits challenging land use regulations frequently include an “inverse condemnation” claim, alleging the regulation amounts to a “taking” of the property. During a recent building permit inspection of 570 Orono Orchard Road the inspector noted that the right of way to the rear of the property, Barrett Avenue, had been graded/filled and a new gravel surface installed (see exhibit A). The current lot is the result of a combination of three lots; one abutting Orono Orchard and two undeveloped lots abutting Barrett Avenue. The improvements are within unimproved portion of the ROW and constitute a second access/driveway to the property. The resident submitted a Right or Way Permit requesting to retain the encroachment and second access. The City Attorney prepared a draft encroachment agreement (See Exhibit B) 3. Relevant Ordinances. a. Sec. 18-106. - Required. It is a misdemeanor to construct or reconstruct a sidewalk, curb and gutter, driveway, driveway approach, driveway turnaround, curb cut, roadway surfacing or any other private improvement in any road or other property in the city without a permit in writing from the city. b. Sec. 18-136. - Residential driveways, approaches and turnaround. One driveway approach shall be allowed from up to two single residential parcels of land to the same road, provided that appropriate easements exist between parties sharing the driveway and driveway approach. Further conditions of encroachment approval are as follows: • The City shall have no responsibility to maintain or repair the Improvement located within the City’s right-of-way area. • The Owners shall own the Improvement and shall be responsible for the maintenance, repair and/or replacement of the Improvement located within the City’s right-of-way area. • The Improvement located on the Subject Property must not impact or increase water drainage on the abutting properties or cause any adverse drainage patterns or erosion to the abutting properties. • The Owners are fully responsible and liable for any and all damage caused to the Improvement because of the Improvement being constructed in the City’s right-of-way area. Further, Owners agree that the Improvement was constructed consistent with all applicable federal, state and local laws and regulations. 3. INTEREST IN RIGHT-OF-WAY. Nothing in this Agreement shall be deemed a waiver or abandonment of the City’s interest in the right-of-way. 4. HOLD HARMLESS AND INDEMNITY. In consideration of being allowed to encroach within the City’s right-of-way area, Owners, for themselves, their heirs and assigns, hereby agree to indemnify and hold the City harmless from all costs and expenses, claims and liability, including attorney’s fees, relating to or arising out of this grant to the Owners of permission to encroach on the City’s right-of-way easement are for the construction, maintenance, use, operation, and the like of the Improvement. 5. TERMINATION OF AGREEMENT. If the Improvement interferes with the use, maintenance or repair of the City’s right-of-way and/or utilities within the right-of-way, the property Owners shall remove the interference at their sole expense. If the property owners fail to maintain the Improvement or fail to remove the interference as provided in this paragraph, the City may, at its sole discretion, terminate this Agreement by giving the current Owners of the Subject Property thirty (30) days advance written notice. The Park Fee is determined as 8% of the fair market value of the land being subdivided, but must be between a minimum of $3,250 and a maximum of $5,550 per residential dwelling unit. Purpose. The purpose of this item to gain council approval of the East Long Lake Trail Concept Plan. 2. Background. At the May 29th, 2018 meeting, the City Council directed staff and the Parks Commission to develop a plan for the conversion of northern section East Long Lake Road to a trail. At the July 2nd Parks Commission meeting, the Commission established a special committee to develop a plan. Bolton and Menk was selected by the city to provide landscape architect planning consultation for the project. That committee, city staff and our consultant have held several meetings and developed a concept plan for the trial. The Parks commission reviewed the plan and endorsed it at their November 5th meeting. 3. Scope of Work. The project would convert the existing roadway to a bike trail. This will include the removal of the existing asphalt, stabilizing the lakeshore where required, construction of a 10ft wide multipurpose trail and adding some amenities such as benches, rock fishing points, a dock, and interpretive signage. See Exhibit A for the concept layout. 4. Coordination to Date. To date the committee has met twice to review the draft plan, Staff has coordinated with Three Rivers Park District, Hennepin County, Minnehaha Creek Watershed District and MN DNR. There are two key partnering opportunities with this project: one; since the project is located on a designated regional route regional funding is available and two; the 900 Old Long Lake parcel that abuts the project area is due to be included in the Woodrill SNA by 2020 providing possible collaboration opportunities with the MN DNR. 5. Public Comment. The plan was posted on the city website for public comment in October with a mailing sent to those property owners in the vicinity of the project. A listing of comments received is provided in Exhibit C. The general comments are supportive and encourage the City to maintain / restore as many natural aspects of the corridor as possible. The majority of the specific comments are items that the project is already incorporating or should be considered during detailed design work. Several Spring Hill road residents did provided concerns about parking on the north end of the trail. The plan current envisions 1-2 spots within the exiting foot print. 6. Cost And Funding. The probable cost based on the concept layout is $347K. See Exhibit B. The intent is to fund a significant portion of the project with grants. The concept plan, once approved will be used for the solicitation of those grants. The portions of the cost borne by the city will be funded by the City’s Stormwater Fund and Park Funds. The City will be applying for the Hennepin County Trail Grant, the DNRs Local Trails Connection Program, and have requested inclusion on the Three Rivers Parks District CIP for 2020. 7. Way Forward. Once approved, the concept plan will be used to seek grants, funding and secure partnerships with other agencies. Add appropriate signage and barricades (ATE) 23 Oct 18 Preliminary Design concept, 5OCT18 Here are some quick feedback points - • Because it’s such a unique opportunity to convert an orono/Long Lake lake-side road to a trail, be really vigilant about keeping the trail as natural and low-key as possible. • Trail and the trail heads should reflect natural treasure of Woodrill and the lake and remain very low-profile, i.e.. this isn’t a typical Luce Line or Dakota Trail section; East Long Lake Road is an incredibly short stretch of rare lakeside and SNA woodlands - very different from larger commuter,etc. trails. • No parking slots on Spring Hill Road side - only at Summit, where parking is ample. • Avoid having the Spring Hill “information kiosk” become out-of-scale, i.e. over- built relative to the special/rare quietness that East Long Lake and Woodrill offer: Don’t build an information kiosk or a “bike facility” at the “North Trailhead” location-> consolidate those services at Summit Park, only. Kiosk and bike services will be targets for vandals…keep it simple and only offer those on the south side/summit. • Consider how you will prevent motorcycles and motor bikes from getting through the barriers…. in past several times Ive been running on East Long Lake Rd, a motorcycle came thur and then just yesterday a motorbike rode thru…..is there a width or surface that would do that trick? My comments are generally very positive about the direction you are headed, with a few ideas for consideration. I've broken out my input into three areas: (1) plantings/run off prevention and water quality issues, (2) educational signage, and (3) facilities. Please continue to emphasize native plantings and additional rain gardens when possible as a presence on the trail, ideally on BOTH sides of the trail. Long roots of native plants help filter run off and improve water quality, and provide a natural boundary to the lake, preventing erosion and increasing the water quality! Consider also the opportunity to involve Otten Bros., to get plantings (supporting our local retailers!), and also to provide landscaping advice and consultation for shady areas, where traditional rain gardens may not be feasible. Additional considerations/comments - • Please consider a permeable trail, to reduce run-off and increase the absorption of water and nutrients into land surrounding the lake, vs. in the lake. • Also very much appreciate the defined entry points to the lake (ie, the boulder canoe entry spot) vs. open entry all along the trail, both in terms of run-off mitigation, but also so that it reduces some of the heavy shoreline usage and the erosion that happens as a consequence, in such a vulnerable area. FACILITIES: • Please add trash cans to prevent litter, with specific stations to provide "poop" bags for dog walkers, and disposal sites for the animal waste. • Please de-emphasize lighting, and/or use primarily "down" lighting at night, to reduce light pollution around the lake. Would love a shaded pergola, much like in Lurton Park. • Love the canoe launching area. • Consider installing or allowing the installation by neighbors and citizens of birdhouses, and bird nesting areas for birders and photographers to enjoy. • Consider writing the code to allow a future "little free library" along the trail, for children to enjoy, and/or future public artwork emphasizing nature/water and or/ our interactions with nature. • Please consider adding a "Biffy" or enclosed toilet facility for the public at one of the trail heads. If you do decide to add plumbing, please also consider a water fountain (for use in refilling water bottles). • Please consider adding a bike rack at the trail heads. Trail is on a regional route for TRPD and HC. Regional trail standard is 10ft wide paved. Long Lake Waters Association (LLWA) is excited about the project and Orono City Councils’ commitment to leverage the natural beauty of our area. Turning the existing road into a walking, biking, and nature trail is forward thinking and will positively impact the citizens of Orono and the local ecology now and in the future. We offer our support moving forward and would like to work with the city on aspects that might impact the lake and the wetlands in the Long Lake Creek Watershed and the enjoyment of the area by residents. Moving forward we would like to set up a meeting with Orono and we have a few concrete suggestions that we would like to offer based on the current plan. NATIVE PLANTS/PERMEABLE SURFACES FOR FILTRATION We encourage adding more landscape design elements that emphasize native plants, reduce erosion, and filter run-off whenever possible. The water quality in Long Lake Creek Watershed is a critical part of our local eco-system. Long Lake and the surrounding wetlands/woods flow directly into Lake Minnetonka via Tanager Lake/Browns Bay. Using native plants, and a permeable trail could help improve the poor (D rated, per MNPCA) water quality within the lake. EDUCATIONAL SIGNAGE The East Long Lake trail area could provide valuable educational opportunities for the community and local schools. We suggest signage about the natural landscape be included beyond the trailheads. More and more communities are building “nature’s classrooms” and it would be valuable to offer outdoor, science learning opportunities to our children and citizens. NATURAL ENVIRONMENTAL DESIGN We ask that the plan be evaluated in terms of providing a reduction in pollutant loading of the lake, including reduction of storm water flow into the lake, and protection of the shoreline from human or storm water erosion. We also recommend that every effort be made to prevent light pollution at night and to provide the necessary facilities to eliminate trash and pet waste from polluting the lake. PARTNERSHIPS We offer to partner with Orono on the project and other local businesses and service organizations to identify possible sponsors for sections of the trail to help with cleanup and maintenance, and potentially cost sharing. We suggest that Minnehaha Creek Watershed District (MCWD) be contacted to determine if they would offer to go beyond their role as a permitting and regulation body to provide their expertise in upfront planning with the goal of identifying ways to cost effectively go beyond the current plan for long term protection of the lake. Other valuable partners could be the Minnesota Department of Natural Resources (DNR SNA) and volunteer Master Water Stewards and Master Gardeners who live in the area. As a nearby resident, I am thrilled at the prospect of new trails for hikers/bikers in such a beautiful setting. I hope that when redeveloping the road, you will consider the imperatives to focus on the rural setting, the need to restore and support native habitat, and to improve water quality. I will echo the comments that I imagine others have shared to: · use native plants and rain gardens to filter water runoff into the lake · develop signs that educate trail users about the history and importance of the area and its native habitat · create facilities specific to humans, pets, and watercraft so disturbance to the lakeshore is minimized, and waste does not negatively impact water quality. Perhaps consider composting toilet facilities. Additionally, I would encourage the city to involve Orono schools to use the trail for field trips, and to publicize the benefits of the new trail to the students and their families, as well as best practices for how we can improve and maintain the Lake as a community.
