SPECIFICATIONS-2008
CARLSON ESTATES NEW ASPHALT
TONKAWA ROAD
ORANO,MN.
This specification has been prepared for asphalt replacement and related work. The contractor
will be responsible for a full and totally complete installation,no matter if this specification lists
all the detail necessary for such a full and totally complete installation or not. The contractor
must point out and list any deficiencies noted in this specification prior to contracting. The
contractor will provide all labor,materials, equipment and resources. Nothing will be provided
by the owner,unless specifically noted in this specification. There are two (2) drawings- C 1
and C2 dated 7-14-08 for this work. A subsurface geotechnical assessment prepared by SPC
Engineering,PA is also included. All measurements and assumptions for bidding and
contracting must be based on these specifications and field measurements of the property.
I. THE WORK BASE BID)
1. Mill 2 inches of existing asphalt from roadways and driveways as noted on
Drawing C I. Milled asphalt may be stored on site to be reused as partial subbase
where required. All excess materials to be removed.
2. Remove all existing asphalt,base material and soil within 15 inches of final,
grades at two(2)noted areas. See Drawing C1.
3. Remove existing stone gutters as noted on Drawing C1.
4. Furnish and install new 4 inch diameter PVC pipe for utilities where noted on j
Drawing C 1. Trench minimum 19 inches below finish asphalt surface and fill
with compacted base.
5. Existing removed stone gutters to be replaced by Larry Barlett Construction(952-
221-3142)after asphalt work is completed. Such construction is not part of this
work.

6. Concrete apron slabs in front of storage garage and 550 Tonkawa Road garage
will be furnished and installed by Larry Barlett Construction. (952-221-3142).
Such construction is not part of this work.

7. Furnish and install three(3)new catch basins and precast structures. See
Drawings C 1 and C2 for locations.
A. C. B.No. 1 - Grating to be raised approximately 5" from concrete gutter
surface,approximately 20" diameter grating,28" diameter precast
structure. Note: This type of catch basin and grating can be viewed at 724
Tonkawa Road.
B. C. B.No. 2 - Grating to be flush with finish asphalt,approximately 18"
diameter grating and 28" diameter precast structure.
C. C. B.No. 3 - Grating to be flush with asphalt, approximately 24"x 36"
size and precast structure to be approximately 30" x 42".
8. Furnish and install one layer of approved 300 lb.woven eo textile fabric such as
Y PP g (
Amoco 2006)under three (3)areas to receive new base and asphalt.
9. Furnish and install minimum 10 inches of mechanically compacted Mn/DOT
(Type 3138) class 5 100%crushed aggregate, or approved CONBIT,or approved
class H RAP sub-base at three (3)areas to receive new base and asphalt.
10. Furnish and install 3 inches total of approved MnDOT Type MV3 bituminous
base course at three (3)areas to receive new base and asphalt. Furnish and install
2 inches total of approved MnDOT Type MV4 bituminous wear course with good
tack coat between base course and wearing surface course.
11. Furnish and install inches total of approved MnDOT Type MV4 bituminous
wear course with good tack coat between existing asphalt and new asphalt where
2 inches of existing asphalt was milled.
12. Pavement edges to be restored by Owner's sub-contractor,"Earth, Stone and
Water". Asphalt contractor to coordinate work as required. Steve King(952-367-
7960).

9. Furnish and install inches total of approved Mn DOT Type MV3 (3 inches)
bituminous base and approved Mn DOT Type MV4(2 inches)bituminous wear
course,with good tack course between. Furnish and install 2 inches total of
approved MnDOT Type MV4 bituminous wear course with good tack coat
between existing asphalt and new asphalt where 2 inches of existing asphalt was
milled.

III. OTHER REQUIREMENTS
1. Contractor shall provide quote details for each section as outlined on the Proposal
Response sheet.
2. Contractor shall not install any products in poor weather conditions. All products
shall be applied strictly according to manufacturer's specifications and
recommendations.
3. All material supplied must be approved by Owner or its representative -and
shall be the best of all available materials that comply with this Specification.
4. Contractor shall acquire approval from the Owner or its representative, for any
"Extra"work to be performed.
5. Contractor shall 100%clean up property at the end of each working day,but may store
equipment on-site in reasonable manner as approved by the Owner.. Contractor is
responsible to protect all adjacent areas of the property, including grounds, during
work and shall fully restore and repair all areas necessary after completion of work.
6. Contractor shall be properly licensed to work in Minnesota and the local municipality
and shall show proof of licensing before start of work.
7. Contractor must meet schedule established at contract time. Owner reserves the
right to terminate contractor for lack of steady progress towards timely completion.
8. Contractor may store materials and accessories on-site in an appropriate area
designated by the Owner.. All storage must be inside trailers or trucks or outside
by arrangement with the Owner.
9. Contractor shall operate in a safe manner at all times,not endangering his own work
force or the Association property,guests or other parties at the site. OSHA
requirements shall be followed at all times. The contractor and any subcontractors on
the site are 100%responsible for all safety requirements at all times. Any violation of
reasonable safe practices per OSHA requirements are strictly at the risk of the
contractor and subcontractors and shall not involve the Association or its consultants
or agents. Any burdens (legal, financial or any other)directed at the Association, or its
consultants or agents,will be resolved or defended totally by the contractor and/or
subcontractor, if involved.

10. Contractor shall have in force at all times during the term of the work: (1) Statutory
required Workmen's Compensation; as required by law; employer's liability with
limits of$500,000. (2) Commercial General Liability Insurance
covering all operations under the contract in the amount of$1,000,000 per
occurrence; (3)Auto liability on all self-propelled vehicles used on the project,
$1 million personal injury per person per accident, $1 million bodily injury and
property damage combined single limit liability. Proof of this insurance(binder
from agent)must be provided before contract signing. All employed subcontractors
shall have same coverage as outlined above or contractor must include those
subcontractors in his insurance policy as outlined above. The following must all be
listed as "Additional Insureds"on all policies:

Teachers Insurance and Annuity Association

No work shall start until proper insurance forms are delivered to Construction
Consulting&Inspections,Ltd.
11. Contractor shall gain Owner approval to subcontract any part of the work.
12. Contractor agrees to defend and hold Construction, Consulting and Inspections,Ltd.
and the Owner, all other contractors and consultants and other persons affiliated with
the Association harmless for acts or omissions committed by contractor, contractor's
employees, suppliers or agents and subcontractors. See item#17 of this section for
additional references in contract.
13. Contractor must report any deficiencies detected in these Specifications before signing
contract. Any obvious deficiencies will not alleviate contractor's responsibilities for
providing complete job as intended.
14. Contractor shall repair any damage done to any part of the property during the course
of the work.

15. Contractor shall provide an approved(by Owner)two year written warranty for
all work provided,plus normal manufacturer's warranty for all products that provide
warranty. This warranty shall cover all aspects of the work. Contractor shall correct
any problems, including inside damage,covered by the warranty within one week of
notification by the Association or within 24 hours of a leak emergency.
Manufacturer's and contractor warranties must be delivered to Owner,in the
Owner's name before final payment.
16. All claims and disputes arising out of this agreement, for any breach thereof, shall be
subject to arbitration as a condition precedent to any legal actions. The arbitration
award decision, including any allocation of arbitration costs, shall be final,and
judgement may be extended upon said decision in any court jurisdiction thereof. By
submitting a bid,the contractor has accepted and agrees to arbitrate in accordance
with this paragraph.
17. The successful contractor shall be required to endorse a contract for the work to be
accomplished on the project. The contract to be used is AIA-A107 -Abbreviated
Form of Agreement Between Owner and Contractor(1997). All articles of this
contract will be in effect(unless noted as deleted at time of contract signing), as will
any terms of this Specification and the Proposal Response used as part of the bid.
The contractor will become familiar with the AIA-A107 Contract form before bidding
and bid accordingly.
18. Contractor is responsible for acquiring and paying for all permits and inspections for
the work as part of the contract price.
19. Contractor shall submit appropriate invoices for work and shall provide a lien waiver,
plus waivers from all subcontractors and major suppliers. All work to be inspected by
the Owner's representative prior to payments. Owner will hold 5%retainage on all
invoices until 100%contract completion.
20. The contractor shall install and maintain an approved portable"john"on-site at all
times during construction.
21. The Contract Sum includes all taxes,fees, levies, surcharges or other impositions of
any type whatsoever, imposed by any governmental authority, or the contractor,or any
subcontractor or supplier, against or on account of the work.

We propose to furnish all materials, equipment and labor as per ASPHALT
SPECIFICATIONS-2008 We propose to do the work according to the"Other Requirements"
as noted in the Specifications and all general sections of Owner's contract, starting work August
07,2008 and finishing work August 18,2008. We agree to make steady progress once work
begins,to get Owner written approval for any changes,and to follow the accepted standards of
OSHA as in force in Minnesota during the course of the work
Note: It is anticipated that formal}notice to proceed will be forthcoming by July 23,2008. The
successful contractor shall submit a proposed schedule to Construction Consulting&Inspections,
