HomeMy WebLinkAbout#6451-CUP-2014 f i �� ♦ � C ITY OF ORONO ' RESOLUTION OF THE CITY COUNCIL �`�tq 4,G~ N 0. 6 4 �'J �I kFsxo� A RESOLUTION GRANTING A CONDITIONAL USE PERMIT PURSUANT TO MUNICIPAL ZONING CODE SECTION 78-967 and 78-1610 ' FILE NO. 143688 WHEREAS, Tonkawa, Inc., a domestic business corporation (hereinafter "the Owner of 520") is the owner of the property located at 520 Tonkawa Road within the City of Orono (hereinafter the "City") and legally described as: Tract D, RLS No. 1305, Hennepin County, Minnesota (PIN 05-117-23-32-0005) (hereinafter the "520 Property"); and WHEREAS, Carlson Holdings, Inc., a domestic business corporation (hereinafter "the Owner of 550") is the owner of the property located at 550 Tonkawa Road within the City and legally described as: Tract C, RLS No. 1305, Hennepin County, Minnesota (PIN 05-117-23-32-0004) (hereinafter the "550 Property"); and WHEREAS, Michael A. Clements a single person (hereinafter "the Owner of 630") is the owner of the property located at 630 Tonkawa Road within the City and legally described as: Lot 2, Block 1, Rosenthal Addition, Hennepin County, Minnesota (PIN 05- 117-23-33-0018) (hereinafter the "630 Property"); and WHEREAS, Doug Mensing of Applied Ecological Services, Inc., (hereinafter the "Applicant") on behalf of the above Owners has made application to the City for a conditional use permit (hereinafter the "CUP") pursuant to Orono Municipal Zoning Code Section 78-967 and a wetlands alteration permit pursuant to Orono Municipal Zoning Code Section 78-1610 to allow grading and filling activities within a Type 3 wetland on the 520 Property, the 550 Property, and the 630 Property (hereinafter collectively the "Properties°) which involves excavation of approximately 0.5 acre and thin spreading the excavated material over approximately 1.64 acres within the wetland on the Properties; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the Orono Planning Commission on September 15, 2014 at which times all persons desiring to be heard conceming this application were given the opportunity to speak thereon. Page 1 of 8 � t �0�0 C ITY OF ORONO RESOLUTION OF THE CIT'Y COUNCIL � � 6451 �� � G NO. j9kESH0�� NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File number 14-3688. 2. The Properties are located in the LR-1 BC One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acre and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on September 15, 2014 and voted 7 in favor and 0 against on a motion to recommend approval of the CUP and wetlands alteration permit. The Planning Commission finds that the following factors support the granting of the requested CUP and wetlands alteration permit: a. Each of the properties meets or exceeds the LR-1 B area and width requirements. b. No structures are proposed as part of this application. c. The grading and filling activities are proposed in order to improve the function and value of the wetland on the Properties. d. The approximate top 12" of cattail infested soil will be hauled out and disposed of off-site. e. Spreading 6"-12" of excavated wetland soil across 1.60 acres is proposed to cap and control the invasive population of narrow leaf cattail dominating the wetland. Raising the bottom contours of the wetland 6"-12" is projected to limit the activity of the cattail seedbed while providing wet meadow plantings with competitive advantage. f. The excavation will create a 0.5 acre deep marsh which is anticipated to provide foraging and nesting habitat for waterfowl and waterbirds, while providing habitat for frogs, dragonflies, and amphibians. g. The area where the think spread material will be deposited will restore the wet meadow and is expected to diminish reed canary grass and cattail communities proposed to be replaced with a diverse wetland community. Surrounding upland vegetation is planned to be managed for invasive species to establish the function and value of the wetland buffers. i. Two rain gardens are proposed outside the wetland boundary to manage local runoff through the area. j. The proposed wetland restoration project should have no adverse impact on surrounding lands. Drainage patterns for runoff leaving the site are not proposed to be significantly altered. k. The wetland restoration project will not alter the essential character of the neighborhood and will not result in a negative impact upon adjacent properties. I. The proposed grading within the wetland is regulated by the Minnehaha Creek Watershed District. The proposed enhancements to upgrade the quality of the wetland are in conformity with the spirit and intent of the zoning code. m. The proposed grading and thin spreading of wetland soils is proposed to result in a decrease of invasive wetland vegetation and facilitate the success of native and beneficial wetland plants. n. The project will not impair the use and enjoyment of the properties in the area or have an adverse impact on property values in the area. _ o. The Applicant has provided a plan for the project areas which will result in significant aesthetic improvements with regard to the vegetation and appearance of the wetland. p. The project is specifically designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impacts. The proposed improvements to the wetland and surrounding upland areas will have beneficial environmental impacts. A detailed landscape plan was provided by the Applicant. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed CUP and wetlands alteration permit on the health, safety and welfare of the community. The City Council finds that granting the CUP and wetlands alteration permit would not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; and would be in keeping with the spirit of the zoning code and comprehensive plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants approval of a CUP and wetlands alteration permit pursuant to Orono Municipal Zoning Code Sections 78-967 and 78-1610 to allow grading and filling activities within a Type 3 wetland on the Properties which involves excavation of approximately 0.5 acre and thin spreading the excavated material over approximately 1.60 acres within the wetland on the Properties; subject to the following conditions: 1. Council approval is based on the survey and plans (hereinafter the "Plans") submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits A 8� B. Any amendments to the approved Plans which are not in conformity with City codes will require further review in accordance with local, State, and Federal requirements. 2. The Applicant shall implement the landscape plan as proposed. 3. The drainage patterns created by the grading plan for the site shall not cause an increase in runoff impacting adjacent properties. The City engineer has reviewed and approved the grading plan. 4. Prior to the commencement of grading and filling activities on the Properties the Applicant shall apply for and obtain a zoning permit for major land alteration. 5. Prior to the issuance of the zoning permit for major land alteration, evidence of compliance with all other requirements of local, State, and Federal entities shall be provided to the City. 6. Authorities granted by this resolution run with the Properties not with the Applicant, but are permissive only and must be exercised by applying for and obtaining an zoning permit for major land alteration and commencing said project within one year of the date of Council approval, or the CUP and wetlands alteration permit will expire on that date (October 13, 2015). 7. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor.
