Paul Weinberger,
Our office has been asked to design an addition to the north side of the principal residence at 500 Tonkawa.This
memo is to state our understanding of the zoning regulations governing this project and to request your confirma-
tion or clarification of our understanding.In addition,we would appreciate you letting us know of any other toning
regulations not mentioned which could affect this project in anyway.
The project will be an addition of 3 floors plus an attic.The lowest level will be located below grade as a storage
area,the next lowest level will contain garage stalls(at the elevation of the tuck under garages of the existing
house).The main level will contain a master bedroom/master bath/closet suite(at the level of the main floor of the
existing house). The attic(space permitting once developed)will contain additional storage area.
The added footprint area will be approximately 1500-1800 sf
Current Property parcel size is 2.8 acres according to survey,although this doesn't include shoreland areas.(See
attached lot plan.

For attached additions I understand that there is no footprint restriction except for total lot restriction of 15%foot-
print for all principal and accessory structures for lots 1-1.99 acres.What is restriction on lots which are larger and
for Lakeshore properties where house is within 1000'of shore?
I understand that the side setback for this addition will.be the.same as for the principal dwelling which is 30'from
property line.Is this correct?
I understand that the height restriction will be 30'or the height of principal structure whichever is less.This height
is to be calculated according to Orono method which is either from high grade to 1/2 the height of the sloped roof or
from a point 10'above lowest grade to height at 1/2 of height of sloped roof at walk out conditions.(We may look at
walk out condition for lowest level of this project.)
Please inform me of othe conditions which will apply to this project on this site_

§ 10.02
11. "Boardinghouse" -A building other than a motel or hotel where,for compensation
and by prearrangement for definite periods, meals or lodgings are provided for three or more
persons,but not to exceed eight persons.
12. "Building" -Any structure having a roof which may provide shelter or enclosure
of persons, animals or chattel, and when said structure is divided by party walls without opening,
each portion of such building so separated shall be deemed a separate building.
13. "Building Height" :The vertical distance between the highest adjoining ground
level at the building or ten feet above the lowest ground level,whichever is lower and the top of the
cornice of a flat roof,or the deck line of a mansard roof,or the uppermost point on a round or other
arch type roof, or the average height of the highest gable of a pitched or hipped roof. Topographic
changes which elevate the adjoining ground level above the existing terrain shall not be considered
in determining building height.

14. "Bulk Station" -Distributors warehouses for materials which are stored in tanks
above ground in aggregate capacity on the site of 6,000 gallons or more.
15. "Carport" -An automobile shelter having one or more sides open.
16. "Cellar" -, That portion of the building having more than one-half of the
floor-to-ceiling height below the average grade of the adjoining ground.
16(a). "Clean Fill" - Clean fill shall consist of all native soils as described in the
Unified Soils Classification System. Organic, man-made and reprocessed materials, topsoil and
rocks larger than 0.25 cubic yards (2.9' diameter) shall not be considered clean fill.

17. "Commercial Kennel" -Any premises where three or more domestic animals over
six months of age, are owned,boarded,bred or offered for sale.
17(a). "Commercial Operations" -Operations where business is conducted by the sale
or exchange of goods and/or services on site for money or other valuable consideration.

REQUIRED SUBMITTALS
All of the following information must be submitted by the application deadline date in
order for your application to be considered complete:
1. _ Completed Application Form
2. _ Certified Property Owners List of owners within 150', labels and plat map (you
must obtain this list, labels and map from Hennepin County Department of
Finance, A-603, Govt Center, 348-5910).
3. — Certificate of Survey (signed by a licensed surveyor) and include hardcover
calculations as required. In addition, provide one (1) copy 8%2" x 11" for
reproduction.
4. _ Topographic survey (existing and proposed elevations) if any changes in existing
grade are proposed. In addition, provide one (1) copy 8y2,' x 11" for reproduction.
5. _ Sketches or plans of floor & elevation views (provide one (1) copy 8'/2" x 11").
6. — List of the legal names (include marital status) of all persons with an interest in
the property. This would include name(s) of applicant(s) if not current owner(s).
7. As an addendum to this application, please attach a separate list of any other
persons you wish notified of this application.
8. _ Additional items as may be requested by City staff.
The Applicant and Property Owner must sign this application. Please remember that your
variance application is not complete if the above information has not been included.

The applicant hereby agrees to provide all information required or requested by the Zoning
Administrator, agrees to pay additional fees (staff time not covered by original fee payment)
and/or consultant expenses incurred in review of this application, and certifies that the
information supplied is true and correct to the best of his/her knowledge.

The owner hereby acknowledges and agrees to this application and further authorizes reasonable
entry onto the property by City staff, consultants, agents, Commission members, and Council
members for purposes of investigation and verification of this request.

Applicant must have all submittals into the City offices 25 days before the Planning
Commission Meeting. Planning Commission Meetings are held on the third Monday of each
month. Applicants must be present at all scheduled review meetings of the Planning
Commission and Council. If an applicant is unable to attend a scheduled meeting, please
make arrangements to have an authorized agent attend in your place and to advise the Building
& Zoning Office of this change prior to the meeting.
