Staff conducted a preliminary review based on the information provided and requests the following items be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Certificate of Survey. The copy of the survey submitted dated 7-20-2010 is not to scale and does not accurately reflect the current site conditions, i.e. a paver patio is shown on the photos provided, but not on the survey. All building permits require a survey, see City Code Section 86-68, copy attached. We are able to conclude from when the home was constructed the deck expansion meets the setbacks. We can issue the permit based on the information provide,but please note an as-built survey including hardcover calculations will be required to be submitted and approved prior to the release of the escrow money. 2. Landscape Plan. Will there be any changes to the landscaping with this deck expansion? If so,the City requires a landscape plan be submitted showing all the proposed exterior/landscaping improvements, i.e. patios, grading, sidewalks, retaining walls, etc. The plan should include the name of the individual performing the work. 3. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is$700. The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a check for$700. 4. Minnehaha Creek Watershed District (MCWD). Your project may trigger the Minnehaha Creek Watershed District's (MCWDs) permitting requirements; please contact the MCWD directly at 952-471-0590 regarding your project. Please note,the City of Orono will not issue a building permit without a copy of the MCWD permit or documentation stating the proposed project does not trigger any of their permitting requirements. (a) The application for a construction permit or land alteration permit shall include such information as may be required by the city, which may vary between types of construction projects. (b) Surveys required: (1) Initial survey or site plan. Any building, zoning or general permit application for construction of a new structure, expansion of an existing structure or land alteration shall be accompanied by a certificate of survey or site plan drawn to scale prepared by a person registered by the Minnesota Board of Architecture, Engineering, Land Surveying, Landscape Architecture, and Interior Design.A certificate of survey or site plan shall conform to the City of Orono Survey and Site Plan Requirements. a. The certification of the plan by a licensed professional may be exempted by the city engineer if the project meets all of the following: 1. An existing as-built survey exists for the property; 2. Property is located outside the Shoreland Overlay District; 3. Property is not subject to the Stormwater Quality Overlay District; 4. Property contains 2.0 acres or greater in area; 5. Proposed project exceeds the required setback requirement by 150 percent; and 6. Proposed project footprint does not exceed 200 square feet. (2) Foundation survey. A foundation survey shall be submitted to the city for review and approval, unless exempted by the building official, upon completion of the foundation work for all buildings and all additions to buildings.The foundation survey, prepared by a Minnesota Registered Land Surveyor, shall certify the lot dimensions; front, side, rear, lakeshore, and wetland setbacks; and foundation elevation.A foundation survey must be submitted before proceeding with framing or further construction. In lieu of a survey a letter prepared by a Minnesota Registered Land Surveyor containing the same information as a foundation survey may be submitted. (3) As-builtsurvey. An as-built survey, prepared by a Minnesota Registered Land Surveyor, shall be submitted to the city for review and approval upon the completion of all buildings and all additions to buildings, unless exempted by the building official.The as-built survey shall certify the final topography of the site;verify drainage patterns; and provide hardcover calculations for lots in the Shoreland Overlay District.An as-built survey must be approved before the issuance of a certificate of occupancy. Recitals 1. A building permit application has been filed for a deck expansion located at 4655 Tonkaview Lane the("Subject Property"), legally described as Tract E, Registered Land Survey No. 1036,files of Registrar of Titles, Hennepin County, Minnesota except the westerly 25.00 feet of said Tract E. 2. Owners request the City to review this application. 3. The City will commence its review of the application and incur costs associated with said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the Owners shall deposit $700 with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for under a building permit application. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant review) associated with building permit #2015-01163 if compliance with the approved building permit is not accomplished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for eligible expenses the City has incurred. 5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners when the review has been completed and written notification is received from the Owners requesting the funds. 6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses incurred by the City exceed the amount in escrow,the City shall have the right to certify the unpaid balance to the subject property pursuant to Minn.
