Colfax Companies has applied for a permit to build a new house on your property at 4655 Tonkaview Lane.
City code requires that the property owners provide a$2,500 escrow and sign an escrow agreement to guarantee
payment of the City's consultant costs in excess of$500 and to ensure compliance with erosion control
measures. The escrow agreement is attached. You may return the signed agreement and check by mail, drop
them at City offices between 8 am and 4:30 pm Monday through Friday, or send them with your contractor
when they pick up the permit. You will be sent a signed copy of the agreement and a receipt. Once the house is
completed you may request a return of the escrow.
I understand you closed on this property yesterday so the County website still shows Dennis Meyer as owner.
The county website is updated every working day, so hopefully the change will show up by the time the permit
is ready to be issued(probably the end of next week). If the change hasn't been made on the Country website
by that time you will need to provide a copy of the recorded deed. You can check by going to the Hennepin
County website,htti)://www.co.hennepin.mn.us/, clicking on the property information search and entering the

We have reviewed the plans for the proposed house at 4655 Tonkaview Lane. The plans are
dated 3-19-10. We have the following comments with regards to engineering matters:
• The grading plan is acceptable from an engineering standpoint.
• To the extent possible, the rain gutter downspouts should be directed towards
Tonkaview Lane.
• The proposed house footprint is similar to the previous house (now removed) on the lot.
Therefore, we would not expect there to be any significant changes in drainage patterns
and flows rates.
• This project will disturb more than 100 CY of material. Sediment and erosion control
information meeting the requirements of Orono's City Code 79-7(c)(2) must be
submitted. The minimum $2000 sediment and erosion control financial security should
be required of the owner for this permit.

BUILDING PERMIT ESCROW AGREEMENT
Orono Building Permit 2010-00176
AGREEMENT made this D day of , 2010, by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City")and Angeand Rachel Licursi("Owners").
Recitals
1. A building permit application has been filed for a new house located at 4655 Tonkaview Lane(the
"Subject Property"), legally described as Tract E except the west 25.00 feet thereof, Registered Land Survey No.
1036, Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owners establishe an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with Building Permit 2010-00176 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #4 above, the City may draw from the escrow account without further
approval of the Owners to reimburse the City for eligible expenses the City has incurred. The City shall cease issue a
Stop Work Order until the Owners pay all expenses invoiced pursuant to#4.
4. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
5. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
