A RESOLUTION
APPROVING THE PLAT OF
ELIZABETH ADDITION
FILES #11-3526 & #11-3536
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has
adopted subdivision and land development regulations for the orderly, economic and safe
development of land within the City; and
WHEREAS, on October 24, 2011, the City Council adopted Resolution No. 6089
granting Preliminary Plat Approval for 3515 Capital Partners, LLC, a Minnesota Limited Liability
Company (hereinafter "the Applicant") for the proposed development of the properties within the
City of Orono (hereinafter the "City") identified as property identification numbers (PIDs) 08-117-
23-33-0030; 08-117-23-33-0031; 08-117-23-33-0032; 08-117-23-33-0033; 08-117-23-33-0034;
and 08-117-23-33-0035 which are legally described as follows:
Lots 8 through 13, Block 6, Crystal Bay View, Hennepin County, Minnesota
(hereinafter the "Property"); and
WHEREAS, on November 28, 2011, the Orono City Council considered the
application by Sandy Beach, LLC, a Minnesota Limited Liability Company, (hereinafter the
"Developer")for final plat approval; and
WHEREAS, the Developer has completed or has agreed to complete all other
requirements of the platting regulations of the City including:
1. Completion of all platting requirements of Preliminary Plat Resolution No. 6089.
2. Dedication on the plat of perimeter Drainage and Utility Easements as required in
Resolution No. 6089.
3. Dedication on the plat of Drainage and Utility Easements over the storm water pond and
swales as required in Resolution No. 6089.
4. Granting of Drainage and Utility Easements over the portions of the storm water pond

and swale extending on to Lot 7, Block 6, Crystal Bay View as required in Resolution No.
6089.
5. Provision to the City of a title opinion for the Property and certified copies of all recorded
easements currently affecting the Property.
6. Submittal of any grading plan revisions that may be required by the City Engineer.
NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution
No. 6089, the City Council of the City of Orono does hereby approve the plat of ELIZABETH
ADDITION, Hennepin County, Minnesota (a copy of which is attached as Exhibit A) subject to
the following conditions:
1. Development within Elizabeth Addition is subject to the Conclusions, Orders and
Conditions enumerated within Preliminary Plat Resolution No. 6089.
2. The approvals granted in this Resolution shall become effective only when all conditions
of approval requiring actions by the Developer have been satisfied, including execution
of the required Development Agreement.
3. The Developer shall establish an escrow account and execute an Escrow Agreement as
established within the Development Agreement, as well as provide a Letter of Credit or
security acceptable to the City Attorney for the amount noted in the City Engineer's
Estimate and established within the Development Agreement.
4. The City Clerk shall release the plat documents for filing only upon certification by the
City Attorney, Planning & Zoning Coordinator and City Engineer that all requirements of
the platting regulations have been satisfied.
5. The aforesaid plat shall be filed by the City of Orono with the Hennepin County Registrar
of Titles Office on or before May 28, 2012 together with a certified original copy of this
resolution and executed copies of the easements and covenants pertinent thereto.
The approval granted by this Resolution shall expire six months from approval
date (May 28, 2012) if the conditions of this Resolution have not been met or the plat has not
been filed by the date specified above. In that event, it will be necessary to file a new
application with the City of Orono for plat approval.
