HomeMy WebLinkAbout#5016-variances-2003 . � °� w; O O � � �� CITY f z o URONO a � ;.� � ti ��� �G'�' RESOLUTION OF THE CITY C��OUNCIL `�kEsKO4 rvo. 5 0 � A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 10.23 SUBDIVISION 6(B) FILE NO. 03-2918 WHEREAS, Bruce Singer and Linda Singer, husband & wife, (hereinafter "the applicants") are the owners of the property located at 330 Tonka Avenue within the City of Orono (hereinafter the "City") and legally described as follows: Lots 15, 16 & 17, Block 5, Bayside Addition to Lake Minnetonka, Hennepin County, Minnesota (hereinafter the "property"); and • WHEREAS,the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Sections 10.23 Subdivision 6(B)to allow construction of a new single family home on a substandard lot. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: � FINDINGS 1. This application was reviewed as Zoning File#03-2918. 2. The property is located in the LR-lA Single Family Lakeshore Residential District, which requires minimum lot area of 2 acre and minimum lot width of 200'. The area of the property is 0.43 acres (18,750 s.f.) and defined lot width is 150'. 3. The Planning Commission reviewed this application at a public hearing held on July 21,2003 and recommended approval side yard setback,based on the following � findings: a) No additional land is available for acquisition by the applicants to make the properly conforming in area or width. � 1 r � � , , � K � � • � O �� 4 O S CITY of ORONO � -.- : � , ti ti RESOLUTION OF �T�HE CITY COUNCIL ��`�kEsH.�g'�G NO. o �. � � b) The property is served with municipal sewer. - c) The combination of 31ots with a total lot size of 0.43 acre is typical of lots in the immediate neighborhood. d) A single family residence can be constructed on the property without the need for further variances. 4. The City Council has considered this application including the firidings and recommendations of the Planning Commission,reports by City staff, comments by ' the applicants and the public,and the effect of the proposed variances on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this properly are peculiar to it and do not apply generally to other property in this zoning district;that granting the . variances would not adversely affect traffic conditions, light, air nor pose a fire • hazard or other danger to neighboring property; would not merely.serve as a convenience to the applicants,but is necessary to alleviate a demonstrable hardship � . or difficulty; is necessary to preserve a substantial property right of the applicants; � and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. • 2 , . • t ' � �� . • O �� O � CITY of ORONO � :. ;.. � , ti ��� �G~' RESOLUTION OF THE CITY COUNCIL b �kESH.04 . NO. � O �. 6 CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings,the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Sections 10.23,Subdivision 6(B)to allow consiruction of single family home on a substandard lot based on the following conditions: 1. Council approval is based on the revised site plan submitted by the applicants, attached to this Resolution as Exhibit A. Any amendmerits to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. ' 2. Authorities granted by this resolution run with the property not with the applicants,but are . permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (July 28, 2004). 3. Violation of or non-compliance with ariy of the terms and conditions of this resolution shall • constitute a violation of the zoning code,shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of the applicants and the applicants'heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
