Re: Inquiry regarding garage construction on "300 Tonka Avenue"
Dear Mr. & Mrs. Qunell:
Thank you for your letter of March 27th, regarding
construction of a detached garage on property located to your
south at "300" Tonka Avenue, also known as Lots 17 and 18, Block
5, Bayside Addition to Lake Minnetonka.
Lots 17 and 18 are separated from your homestead parcel by a
40' dedicated road right-of-way, platted as "Hill Street". While
this road has never been developed, the dedicated right-of-way
still acts to separate your homestead parcel from Lots 17 and 18.
If Hill Street could be legally "vacated", its ownership would
revert to the abutting property owners.
I have been informed by the Public Works Department that
they recommend against a vacation of Hill Street at least until
the Stubbs Bay area sewer issues have been resolved, since there
is a possibility that the Hill Street right-of-way would be
necessary for sewer construction.
The Orono Municipal Zoning Code prohibits construction of a
detached structure on a parcel that does not -have a principal
structure. Lots 17 and 18 fall into that category, and, even
though your house would be nearby, technically a garage would not
be allowed on the separated tract.
Your options would appear to be as follows:
1. Request a vacation of the portion of Hill Street between
your homestead parcel and Lots 17 and 18. Since this would
not have a positive recommendation from City staff, it is
unlikely that such a vacation would be allowed by the City
Council.
2. Request a variance to allow construction of the garage
on a separated parcel. You would be requesting a variance
to Municipal Zoning Code Section 10.03, Subdivision 9 (A)
(copy attached) .

Lots 17 and 18 are currently proposed to be assigned a
single sewer unit as a separate building site, as part of the
Stubbs Bay sewer project under consideration. Because Lots 17
and 18 comprise only 0.3 acres in the 2.0 acre zone, it is
unlikely that a variance would be granted to allow a new house to
be built on them until sewer is available. Your acquisition of
the parcel and concurrent requests to vacate Hill Street and
combine your homestead parcel with Lots 17 and 18 , might
logically allow for a reconsideration and possible elimination of
a separate sewer unit for Lots 17 and 18.
I have attached a copy of the variance application form
should you wish to proceed. The variance application fee is
$175.00, and your application, required submittals, and fee would
have to be submitted by April 27, 1990 in order to be reviewed by
the Planning Commission at their May 21st meeting, with the
earliest possible final Council action on June 11th. Note also
that, although we have a survey on file for your property, as one
of the submittals you would need to provide a survey of Lots 17
and 18 .
