Home My WebLink AboutResolution 5843 } XO • 00 O =:A , _ CITY of ORONO ti �. e till 110: - �� RESOLUTION OF THE CITY COUNCIL �ikES80v NO. 8 4 l A RESOLUTION APPROVING THE PLAT OF WYNDMERE 2" ADDITION FILE NO. 09-3409 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application by Kern M. Hoppe (hereinafter the "Subdivider") for subdivision of property located at 1150 Wyndmere Road and legally described as: Lot 1 Block 1, Wyndmere, Hennepin County, Minnesota (hereinafter "the Property"); and WHEREAS, on April 14, 2008. the City Council adopted Resolution No. 5743 granting preliminary plat approval of Wyndmere 2nd Addition; and WHEREAS, on October 13, 2008, the City Council adopted Resolution No. 5777 granting final plat approval of Wyndmere 2nd Addition; and WHEREAS, the approval granted by Resolution No. 5777 was valid through April 13, 2009; and WHEREAS,the Subdivider has made application for renewal of this approval: and WHEREAS, the Subdivider has completed the following requirements of the platting regulations of the City: 1. Payment to the City of final plat review fees and legal review and filing fees. 2. Provision to the City of a title insurance commitment for the Property and certified copies of all recorded easements currently affecting the Property. Inclusion on the plat of Drainage, and Drainage and Utility Easements as required in Resolution No. 5743. WHEREAS, the Subdivider has agreed to complete the following requirements of the platting regulations of the City: 1. Provision to the City of an updated title insurance commitment for the Property and certified copies of any easements currently affecting the Property recorded after September 21, 2008. 2. Execution of a Flowage and Conservation Easement and Restrictive Covenant and Wetland Buffer for the wetland and wetland buffer within. 3. Execution of a restrictive covenant for protection of drainfield sites for both lots and an agreement for replacement of septic system on Lot 1. 4. Execution of a covenant prohibiting access to Lot 2 from Sixth Avenue North (County Road 6). 5. Payment of a park dedication fee for one lot, based on the fee schedule in effect at the time of the filing of the plat. 6. Payment of a Storm Water Trunk and Drainage fee for the entire plat, based on the fee schedule in effect at the time of the filing of the plat. NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution No. 5743. the City Council of the City of Orono does hereby approve the plat of Wvndmere 2nd Addition, Hennepin County. Minnesota, a copy of which is attached as Exhibit A, subject to the following conditions: 1. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, City Planner and City Engineer that all requirements of the platting regulations have been satisfied.
