The driveway will not trigger the erosion control rule disturbance minimums of 5000 square feet or 50 cubic yards. There does not seem to be any aspect of this plan that would trigger any of our other rules. If your plans should change, however,we recommend that you contact us to ensure that you still do not need a permit. The area being proposed is marked (J) on the attached file. It is roughly 25 ft x 9 ft in size. The exact shape will be defined by the embankment just to the west of the added driveway. We are trying not to disturb the trees on the embankment so there may be some contour to the driveway shape on that side. My Wife tells me that the City of Orono now has a copy of this survey that was updated by the surveyor. In reviewing the survey it appears your plan is to expand a new portion of the driveway consistent with the existing driveway. According to City Code Section 78-967(b)(3) no grading or alterations within 5 feet of the property line. A copy of the code section is attached. Attached is a copy of the survey showing the approved driveway location at the time of the home's construction in 1994; there was no as-built survey requirement at that time. This proposal reflects a driveway 5 feet off of the property line; it appears from the submitted survey the existing driveway was not constructed according to the approved plans and was built right up to the adjacent property line. Ideally, the City would prefer the existing driveway to be modified so that it conforms to the required, 5-foot setback. However, while the existing driveway will be allowed to remain as it exists; the new expansion cannot be approved in a nonconforming area. Please revise the plans to reflect the proposed driveway 5 feet from the property line and submit the information so our plan review can continue. (a) The requirements of section 78-966 are not intended to govern the following land alteration activities: (1) Normal and customary grading in the area of an existing or a newly constructed building, or the grading of the driveway serving such building. (2) Any earth movement under 500 cubic yards which does not adversely impact the existing drainage. (3) Grading, filling or excavating of ten cubic yards or less within the shore setback zone of all lakes enumerated in article IX of this chapter. (b) Such grading and earth movement shall be subject to approval by the building inspector at the time of issuance of a building permit, provided that a plan showing proper drainage and protection of adjoining property has been submitted. Where such earth movement is not being performed in conjunction with a building permit, a separate land alteration permit shall be required. Any unusual land alterations, including earth filling, removal or grading, proposed by a builder shall be subject to a conditional use permit as provided for in this chapter. The following land alterations shall be considered as unusual land alterations: (1) All excavations for foundations in excess of 12 feet average depth if any amount of the excess material removed below 12 feet depth is to be stockpiled on the site. (2) Any additional fill brought on site in excess of 500 cubic yards, except for fill required to raise grade for adequate frost footing protection, the intent being that structures shall not be artificially raised above the preexisting surrounding topography. (3) Grading or alterations that would propose any changes in elevations within five feet of adjacent residential lot lines except for drainage swales and ditches. (c) The building inspector shall have the authority to refer any requests for land alteration permits to the city council for review and approval in instances where the land alteration appears to potentially create negative impacts or be not in keeping with the goals and policies of the community management plan. No grading can take place on the neighboring property without written approval (submitted to the City). • The driveway cannot be placed across the property line. Recitals 1. A zoning permit application has been filed for a property located at 245 Tonka Avenue the ("Subject Property"), legally described as Lots 3, 4, 5 and 6, Block 3, Bayside Addition to lake Minnetonka, Hennepin County Minnesota. 2. Owner requests the City to review this application. 3. The City will commence its review of the application and incur costs associated with said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in tum send a bill to the Owners.
