Dear Ms. Bills:
A 20'x 100'portion of Brook Street on which the subject arae is located was vacated b the
P J garage Y City
in 1984 per City Council Resolution No. 1619(attached). A condition of that vacation was that the
then owners, Scott C. and Debra McLain, grant to the City a Utilities and Access Easement(Doc.
#4888323) over the northerly 15' of the vacated road, for future use by the City.
This easement was granted by the McLain's with the full knowledge that the existing garage
encroaches into the easement. They were advised that the City would accept this encroachment for
the current garage structure, and that because the garage was in disrepair, if at some future date it
was rebuilt, it would have to be relocated out of the easement(See Jeanne Mabusth letter to Richard
Schieffer, April 4, 1984).
No permits have since been issued by the City for repair or replacement of said garage, hence we
assume its status and condition have not changed.
The City may at some future date have a need to make use of the full 15-foot easement for the
specified purposes, hence the City is not readily inclined to vacate or reduce its width at this time.
And,given the location of this easement in relation to the adjacent properties to the north and west,
relocation of the easement elsewhere on the property does not appear to be in the City's best interest.
In regard to'what happens next',I would urge all parties to accept the current situation as-is. In order
to vacate the easement, the Council would have to find that it serves no public purpose. It is my
opinion that this finding could not be made.

WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and t `!
WHEREAS, on March 3, 1984, Scott C. McLain and Debra McLain 4, ;

APPLICATION - Vacation of an unimproved platted road
In the process of selling their home on Tonka Avenue, the
McLain 's discovered that their residence encroached 4 feet
in the right or way of Brook Street and their garage (14 feet x
18 feet) extended 14 feet into Brook Street. It would not be
feasible for the owner to move the structures and the property
in its present state is impossible to sell. In order to clear
the title on their property, the applicants request the vacation
of a portion of Brook Street.
The applicant ' s attorney certifies that Brook Street was platted
on Marc; 1 , 1912 and that the subdividers and owners owned all
OIL the land contained within the plat and that no portion of
Brook Street i:as ever been vacated, conveyed, or otherwise trans-
ferred.
Upon vacation the entire 20 feet wide platted right of way will
revert back to the adjacent lot (lots 1 and 2, block 3 , Bayside
Addition to Lake Minnetonka) .
The applicants have asked that only the westerly 100 feet of
Brook Street be vacated leaving a. 25!-plu5 foot platted access
corridor Oust to the east of the intersection of Tonka and Brook
for the property to the immediate north.

Planning Commission recommendation - to ap?rove the vacation application
of Scott McLain vacating the westerly 100 feet of the 20 feet wide
unimproved platted right of way of Brook Street as platted in the
Bayside Addition to Lake Minnetonka based on the following findings:
1 . The City finds no public need or use as an access road
in the westerly 100 feet of Brook Street
2 . The above described area of Brook Street has never been
improved, maintained or used by the City nor its residents
3. Building permits for the construction of the foundation for
the residence (1955) and for the garage (1958) were issued
by the City
4 . Moving the house and garage is not economically feasible
Approval is based on the following conditions:
1. Upon vacation, applicants to execute an underlying road and
utilities easement granting special rights and use to the
City
2 . Upon vacation, applicants must combine vacated portion of
Brook Street with horiestead lot (Lots 1 & 2, Block 3 ,
Bayside Addition to Lake Minnetonka)

owned by Mr. and Mrs. B'orhus at the time of platting.

who discovered the problem while marketing the property.

that a permit to construct a basement for the home was
