SUBJECT: Building Permit Application #2009-00890
3785 Togo Road
We have received the building permit application for the addition at 3785 Togo Road, located
in the LR-1 C zoning district. The proposed addition does not meet the required side yard setback of 10
feet.
According to our records, a new deck was constructed at this address without a permit. A separate
after-the-fact building permit will need to be pulled for the deck construction.
The building permit application is currently incomplete. Below is a list of items the City of Orono
requests to complete our review:
✓ Two (2) original scaled copies of the certificate of survey prepared by a Registered Land
Surveyor meeting the attached requirements
✓ Hardcover Calculation Worksheet prepared by a Registered Land Surveyor (hardcover
information sheet and hardcover calculation worksheet attached)

SUBJECT: Building Permit Application #2009-00890
3785 Togo Road
On December 30, 2009, we received a faxed survey and hardcover calculations for 3785 Togo Road.
This survey is not to scale; however based on the surveyor's notation the proposed addition would be
8.7 feet from the side lot line where a setback of 10 feet is required. The building permit cannot be
issued if setbacks are not met. If the proposed addition can be adjusted to meet the 10' side yard
setback please revise your plans and resubmit. At this time, Building Permit Application #2009-
00890 is denied. If you are interested in discussing the option of a variance please contact me at your
convenience.
Further, according to our records a new deck was constructed at this address without a permit and is
currently in violation of City Code 86-66. In order to comply with City Code you must apply for an after-
the-fact building permit and pay an after-the-fact permit fee (double fee) for the deck construction.
Please return the enclosed permit application along with two (2) original scaled copies of the certificate
of survey by Monday, January 25th in order to avoid further action by the City. A double fee will be
charged at the time of issuance.

the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 180 days at any time after work has commenced.
