Dear Mr. McMillan:
It has come to the attention of this department that a deck has been
constructed on your property. This letter is to inform you that a
building permit is required for deck construction in Orono. Please
submit a building }permit application, deck plans and a survey showing
the location of the deck before September 7, 1992. If you have any
questions or if I can assist you in any way, please feel free to

Dear Mr. McMillan:
This letter is to confirm our phone conversation on October 5, 1992.
The survey of your neighbor's property with portions of your house
and lot lines penciled in is not acceptable to the City for
application for a building permit. Please submit a survey of your
property prepared and signed by a state licensed surveyor before
October 19, 1992. If you have any questions or if I can assist you in
anyway, please feel free to contact me at my office.

Dear Mr. McMillan:
The City has given you ample time to provide the survey required to complete the review on
your after-the-fact deck building permit application.
Your failure to provide a survey leaves the City no alternative but to initiate legal proceedings
against you. Action will be withheld until February 22, 1993. If at the end of that time you
have failed to comply, citations will be issued and the matter will be referred to the prosecuting
attorney for further legal action.

VIOLATION REPORT
Defendant: Douglas M. McMillan
3780 Togo Road
Wayzata, MN 55391
Location of Violation: 3780 Togo Road, Orono
Violation of: Orono Municipal Code 12.02
Description of Violation: Defendant constructed an attached deck on his house
without a building permit. When notified, applicant
submitted an after-the-fact permit application without the
required certificate of survey and now refuses to provide
the survey.

Chronology
7/23/92 When passing through neighborhood, a new deck was noted on the rear
of the residence. An inspection slip was left on site notifying owner of
the requirement for a building permit and requested owner to contact
inspector.
8/25/92 Letter sent notifying of permit requirements. Required owner to submit
permit application before September 7, 1992.
9/8/92 Application received without a certificate of survey. Called applicant-he
stated he would attempt to find a survey.
10/5/92 Applicant submits a survey of neighbor's property showing a portion of
applicant's property with remainder penciled in by applicant. Letter sent
advising applicant that a survey of his neighbor's property is not
acceptable for application of a building permit. Requires submittal of
survey by October 19, 1992. '
10/19/92 Talked to applicant by phone - stated his father is arranging survey.
2/9/93 Letter requiring survey by 2/22/93.
2/25/93 Called applicant- indicated he would not submit a survey - Citation#393-
0293612 issued.
The City's objective is to require the defendant to submit a certificate of survey so that
a zoning review can be completed and a building permit can be issued.

3 . Chapter 1305 . 6905 - Special Fire
Suppression Systems with Option of Group B-2 2000 or More Gross
Square Feet.
Subd. 2. Organization and Enforcement. The organization
of the Building Department and enforcement of the Code shall be as
established by Chapter 2 of the Uniform Building Code 1985 Edition.
The Code shall be enforced with the corporate limits of the City
and extraterritorial limits permitted by States Statutes 1984.
A. The Building and Zoning Department shall be the
Building Code Department of the City of Orono.
I B. The Administrative Authority shall be the State
Certified Building Official.
I' C. The appointing Authority shall designate the
Building Official for the jurisdiction of Orono.
Subd. 3 .
A. Permits , Inspections and Fees. Permits ,
inspections and collection of fees shall be provided in Chapter 3
of the Uniform Building Code 1985 Edition.
B. Surcharge. In addition to the permit fee
required by Item #1, the applicant shall pay a surcharge to be
remitted to the Minnesota Department of Administration as
prescribed by Minnesota Statutes 1984, Section 16B.70.
Subd. 4. Violations and Penalties. Shall be in keeping
with Minnesota Statutes 609.033 - 609.034 which provides for a
maximum fine of $700.00.

SEC. 12.02. CONSTRUCTION PERMITS REQUIRED. It is unlawful
for any person to erect, construct enlarge,g alter, repair, move,
improve, remove, convert, or demolish any building or structure, or
any part or portion thereof, including, but not limited to, the
general construction, plumbing, water well, on-site sewage treat-
ment system, wood stoves and fireplaces, ventilating, heating or
air conditioning systems therein, or cause the same to be done,
without first obtaining a separate building or general permit for
each such building, structure or separate component thereof from
the City; the issuance of a permit for any single component shall
not imply authority for construction or inclusion of other
components. The application for a permit shall include such infor-
mation as may be required by the City which may vary between
building components. The owner and/or occupant of any property,
upon which any work has been done in violation of any Building Code
or zoning requirement shall be responsible for obtaining a permit,
and/or for correcting, removing or abating such violation within
thirty days after notice from the City that such violation exists.
