Thanks for talking with me this morning. I spoke with Lyle and we agree that as long as you're of the understanding that
you cannot exceed the newly proposed retaining wall plan/grading plan we can include the changes as a revision to the
existing building permit. An as-built survey will be required at the end of the project as indicated below.

Daryl,
Christine and I spoke with Lyle Oman about your request to include the changes or additional walls in the existing permit
for the work on your home. We have determined that a new, separate building permit application is required for the
walls as they are now proposed. Additionally, in most cases extensive changes to the grading or improvements would be
required to be added to the survey by the registered land surveyor prior to issuance of a permit. In this case however,
our engineer indicated he is comfortable accepting the hand drawn copy as you will be required to submit an as-built
survey reflecting all improvement and topography changes when the projects are completed prior to release of escrow.
Attached is a copy of the building permit application necessary for the proposed retaining walls over 4 feet in height;
please submit the completed application at your convenience. The building permit application fee is based on the
estimated construction value. Although you stated you are constructing the walls the fee must include both material and
labor costs to be fair with all residents. Attached is a copy of the 2014 estimated building permit fee schedule.

Jesse,
I just received a phone call from Chris. I am very confused and disappointed that the city is now requiring an additional
permit for my retaining walls. My disappointment/confusion comes from the fact that it has always been known to the
city that I need to build retaining walls and now I find out I need an additional permit. The only thing different from the
original to know is that I have sketch the walls in on the survey and when original was originally reviewed the city should
have known what was shown was not going to be correct based on the elevations.
If I needed a permit why was it not brought up before now? I could have had all the paper work filled out and ready to
go. I am building the retaining walls myself and didn't realize that I need a permit for landscaping.

My name is Daryl Emery and I live at 3740 Togo Rd. We are currently redoing our basement, demolished the original
and created a walkout. With that being said I will have boulder retaining walls taller than 4' and below is an email that I
received from Melanie Curtis (see below):

load the walls will be supporting, etc to come up with a plan so the walls do not fail. Speak with Mark Gronberg
about this or contact our engineer,Jesse Struve, on Monday.
Can you send me an example drawing of what you need so I don't have any issues with the city? I don't want to have to
redo any part of my walls and I also want to receive my escrow money back from the city. My brother(Emery's Lawn &
Landscape) and I will be building the walls. The boulders will range from approximately 30-36" on the bottom rows and
18-24 on the upper rows.

Dear Mr.Emery:
This letter is being sent to discuss our typical engineered section for the proposed boulder retaining wall
at the 3740 Togo Road project in Wayzata,Minnesota. This design is based on my observations and
verbal information provided by you during a site visit on April 15,2014.
The boulder retaining walls will be located on the east and north sides of the existing house. The north
wall will be about 30 feet long and will vary in exposed height from about 6 feet to 1 foot. For about 20
feet,the east walls will be in a tiered configuration with each wall being about 4 feet tall. The remaining
20 to 30 feet of the wall will vary in exposed height from about 7 feet to 1 foot. A minimum embedment
of 6 inches and minimum wall batter/setback of 18° (-1 inches/vertical foot)should be used for the walls.
Slopes as noted below will be present at the top and bottom of the walls. No groundwater or other
surcharge loads have been designed for the walls. If site conditions vary from what is shown on the
Typical Section,please call me to discuss other options.
Refer to industry standard practice references for installation information,specifications,and details.
- Boulders shall be placed to avoid continuous joint planes in vertical or lateral directions.
- Each stone shall bear on two or more rocks below it with good flat-to-flat contact.
j - Compact any structural fill place behind the drainage zone to 95%standard proctor.
- Install woven landscape fabric behind the stone to limit soil migration through the wall face.
- Drainage stone shall consist of clean 3/4" to 1.5"crushed stone
The attached typical section should be referenced for the appropriate wall section height. Special note
should be made of the wall embedment depth and the geosynthetic fabric(geogrid)length,if required,as
measured from the front face of the wall. Refer to retaining wall industry standard specs for installation
information and details.

- Allowable soil bearing capacity=2,000 psf
- No external surcharge loading behind walls

Direct concentrated surface drainage away from the walls. The wall design was performed using the
design guidelines presented in the third edition of the"Design Manual for Segmental Retaining Walls"
(DMSRW)published by NCMA in 2009. If soil conditions,proposed wall layouts,or other design

BUILDING PERMIT ESCROW AGREEMENT

AGREEMENT made this Z& day of AL0V?1M-kV 20 by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") Daryl & Kristi Emery("Owners").
Recitals
1. A building permit and zoning permit applications have been filed for a new basement and grading
to create a walk out located at 3740 Togo Road the ("Subject Property"), legally described as the East 16.5 feet
of Lot 1, and the West 184.0 feet of Lot 2, Block 10, Townsite of Langdon Park, Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2013-01171 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subje erty pursuant to Minn. Stat. §§415.01 and 366.012.

State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 180 days at any time after work has commenced.
