A RESOLUTION APPROVING THE a%
PLAT OF JAMES BARTH ADDITION
FILE NO. 2642
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of land within the City; and
WHEREAS,the City Council has considered the application for a subdivision of a
2 lot residential plat by Jeff and James Barth(hereinafter "the subdividers"); and
WHEREAS,the subdivision has been found to meet the density requirements of the
LR-1 C zoning district; and
WHEREAS, the subdivider has completed all requirements of the platting
regulations of the City, including:
1. Completion of requirements of Resolution No. 4549, the resolution granting
preliminary approval of the 2 lot subdivision.
2. Dedication on the plat of standard perimeter drainage and utility easements.
3. Dedication on the plat of 15' of public right of way for Togo Road, a public road.
4. Payment to the City for the final plat review fee and fee for legal review and filing
of the plat, easements and covenants in the amount of$425.00.
5. Payment to the City for the 1999 Navarre water plant rehabilitation plant of$360 for
one additional assessment for the new lot based on the 2000 fee schedule.
6. Payment to the City of$3,600 for a park dedication fee for one new residential lot
based on 8% of the value of the lot as determined by the City Assessor.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono
hereby approves the plat of James Barth Addition, Hennepin County, Minnesota (Copy of Plat is
attached to this resolution as Exhibit A), subject to the following conditions:
1. Applicants shall apply for a building permit for Lot 2 within one year of final plat
approval or the existing accessory building shall be removed from Lot 2.
2. Prior to City recording of the plat for filing,applicant's Title Opinion and evidence
of fee ownership shall be reviewed and approved by the City Attorney,and applicant
shall meet any other title requirements as may be required by the City Attorney.
3. The aforesaid plat shall be filed by the City of Orono with either the Hennepin
County Recorder's Office or Registrar of Titles Office on or before May 13, 2000
together with a certified original copy of this resolution and final copy of the plat
noted above.
The approval granted by this resolution shall expire if the plat has not been filed by the date
specified above. In that event,it will be necessary to file a new application with the City of Orono
for subdivision review. Dated this 13th day of November, 2000.

I, Linda S. Vee, City Clerk of the City of Orono, Hennepin County, Minnesota, do hereby
certify that I have compared the foregoing copy of a resolution of the City Council of the City of
Orono with the original record of such resolution in the Minutes of the proceecrings of said City
Council at a meeting of said City Council held on November 13 . 2000 , and that the
same is a true and correct copy of said resolution duly adopted by said City Council at said meeting.
