WITNESSETH, That whereas said grantors are the owners ,
of the tract of land in the County of Hennepin, State of Minnesota,
viz. :
That part of Government Lot 4, Section 20, Township
117 North, Range 23 West of the 5th Principal Meridian,
described as follows: Beginning at the point of in-

of Hennepin, State of Minnesota, viz. :
All that part of Government Lot 4, Section 20 , Town-

on the shore of Lake Minnetonka at the point of
intersection of said lake shore with a line drawn
• parallel with the Southwesterly line of Lot 134,
Spring Park and distant 150 feet Southwesterly at right
angles therefrom; thence Southeasterly and parallel

which adjoins said land of said grantors; and said grantors and
grantees have agreed upon the easement hereinafter described;
NOW, THEREFORE, The said grantors, in consideration of
One Dollar and Other Good and Valuable Consideration to them in hand
paid by said grantees, receipt of which is hereby acknowledged,
hereby grant to said grantees, their heirs and assigns, the following
non-exclusive
described/easements:
Easement for driveway purposes described as follows:
--1-That part of Government Lot 4, Section 20, Township 117
North, Range 23 West of the 5th Principal Meridian, des-
cribed as follows: Beginning at the point of intersection
of the shore of Lake Minnetonka with a line drawn parallel
with the Southwesterly line of Lot 134, Spring Park, and

with the Southeasterly extension of a line drawn parallel

westerly along said extension and said parallel line a
distance of 77 feet to the point of beginning of the line
being described; thence deflecting right 112 degrees to
the Northeasterly line of said above-described property,

Commencing at the point of intersection of the Northwesterly
line of Block 3, Casco Heights, according to the recorded
Y plat, with the Southeasterly extension of a line drawn

angles, from the Southwesterly line of said Lot 134 ; thence
Northwesterly along said extension and said parallel line

Subject to the following terms and conditions :
1. The driveway easement shall terminate upon the
grantees. or their heirs or assigns creating a new driveway entirely
across their said premises .
2. Grantees or their heirs or assigns shall maintain the
said driveway and utility easements at their sole cost and expense
except that if the grantors or their heirs or assigns use said ease-
ments, the cost and expense shall be shared equally.
3. Grantors ortheir heirs or assigns may, at their
option and expense, relocate all or any part of the utility easement.
4 . Grantees or their heirs or assigns shall hold grantors
or their heirs or assigns harmless from all acts of parties other
than grantors, their agents, assigns or invitees. Grantees or their
heirs and assigns shall maintain appropriate liability insurance which
covers the easement areas, a copy of which shall be provided grantors
or their heirs or assigns, upon written request to grantees, their
heirs or assigns.
TO HAVE AND TO HOLD SAID EASEMENT unto said grantees,
their heirs and assigns, as appurtenant to grantees said land.
IN WITNESS WHEREOF, Said grantors have hereunto set their
hands the day and year first above written.
