Dear Mr. Novak,
As we discussed on the phone your deck pen-nit was issued in error. The deck in
the side yard is required to meet a 10' setback from the property line. However, a state
statute allows structures to be replaced in kind. I measured the existing deck to be 4' x 6'
not 5' x 8' as you proposed. Therefore, you are allowed only a 4' x 6' deck in the side
yard. I apologize for any misunderstandings you had with City staff. Please feel free to
