While our wetland specialist was visiting 2645 Watertown Road for the purposes of construction of a new home and winter wetland determination, he noted the attached activity at 2643 Thoroughbred Lane. The property addressed 2643 Thoroughbred is proposing to construct a detached accessory structure on their property but have no permits for the above land alteration and work within the potential wetland. Based on the previously email sent, the property owner may want the grading work that must be completed to be incorporated on the survey before it's re-submitted. According to City Code Section 78-966 permits are required for filling and grading activities within the City of Orono. A copy of City Code Section 78-966 is attached for your reference. Also, according to the City of Orono's wetland maps, a Manage 2 wetland exists on or near the property line. The grading activity appears to have impacted this wetland. We do not know the exact wetland boundary and due to seasonal limitations a wetland delineation is not able to be conducted until spring. This letter has been copied to the Minnehaha Creek Watershed District (MCWD). The MCWD should offer input as to how restoration of the potential wetland should occur. Lastly, any grading impacts on the 2643 Watertown Road property should be corrected immediately. Without proper permits, the grading/land altering activity is a violation of City Code Sections 78-966 and 78-1610; in order to bring the property into compliance you must restore the area where the grading occurred. Additionally, please be aware a wetland alteration permit (Conditional Use Permit) may be required. In order to begin the process of categorizing the land alteration activity from a violation to an after-the-fact permit you must complete the enclosed zoning permit application or submit a modified grading plan with your building permit for our review. (3) Build, alter or repair any seawall or retaining wall, or otherwise change the grade or shore of Lakeshore property. (b) All land alterations involving filling and grading shall be performed only with clean fill as defined in section 78-1. Granting of such permits is subject to other regulations and prohibitions of this Code and other applicable statutes or ordinances of other governmental bodies. (Code 1984, § 10.03(19); Ord. No. 163 2nd series, § 1, 12-8-1997) Sec. 78-1610. -Alteration of wetlands. (a) No alteration of land within a wetland overlay district or a wetland buffer is allowed without a wetlands alteration permit, subject to recommendation by the planning commission and approval of the city council. The planning commission must hold a public hearing after notifying the property owners within 350 feet of the property on which the proposed alteration will occur. Activities that constitute an alteration regulated by this section include changes to the size, depth or contour of the wetlands or its buffer, dredging, or alterations of wetlands or buffer vegetation. Alterations do not include wetland planting or the selective clearing or pruning of trees or vegetation that are dead, diseased, noxious weeds or similar hazards. A wetland alteration permit is not required when a wetland district is rezoned to another zoning classification. (b) Alteration of land within a wetland overlay district will only be allowed if water storage is provided in an amount compensatory to that removed. Unless otherwise approved by the city council, compensatory wetland area must be provided within the same subwatershed district as the wetland being altered. In determining the appropriateness of an alteration request, the city council will consider the size of the total wetland district, the magnitude of the area proposed for alteration, the aesthetic, hydrological and ecological effect, the type and function of wetlands involved, and such other factors as may be appropriate in order to provide the maximum feasible protection to the wetlands. Application for a wetlands alteration permit must be accompanied by such information as required by the city, including: (1) A copy of the wetland replacement plan application submitted to the MCWD; (2) A concept plan showing the ultimate use of the property; (3) A grading plan, in hard copy format and a CAD or GIS format in Hennepin County coordinates, with appropriate drainage calculations and erosion controls prepared by a registered engineer; (4) A landscaping or revegetation plan; (5) Such other information as may be necessary or convenient to evaluate the proposed permit; and (6) A MnRAM assessment approved by the MCWD. WETLAND BUFFER ESTABLISHMENT ESCROW AGREEMENT Permit 92012-01042 AGREEMENT made this day of ajf-I , 20/,-by and between the CITY OF ORONO, a Minnesota municipal corporation("City")and Judson&Aleya Champlin ("Owners"). Recitals 1. A building permit application has been filed for an oversized, detached accessory structure located at 2643 Thoroughbred Lane the ("Subject Property"), legally described as Lot 6, Block 2, Old Crystal Bay Road Second Addition, Hennepin County, Minnesota. 2. The City has reviewed and approved this application. 3. The site work associated with the project caused a disturbance within a wetland on the property. The Owners are required to restore and reestablish vegetation within the wetland area according to City Zoning Code Article XI Wetlands Protection. The site cannot be fully restored due to the winter weather conditions. The Owners agree to establish an escrow to ensure completion of the restoration prior to the completion of the project relating to building permit#2012-01042. NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the Owners shall deposit$1,000 with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee the reestablishment and development of the required native wetland plantings and to reimburse the City for all out-of-pocket costs the City has incurred (including planning, engineering or legal consultant review)or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for as part of the establishment of the wetland buffer. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred associated with permit#2012-01042 if compliance with the wetland restoration is not accomplished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for eligible expenses the City has incurred. S. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners when the review has been completed, the native wetland buffer established and written notification is received from the Owners requesting the funds. 6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses incurred by the City exceed the amount in escrow,the City shall have the right to certify the unpaid balance to the subject property pursuant to Minn.
