Dear Larry and Scott,
We are really enjoying the design and features of our new home here on Long Lake. Understandably
there are several warrantee issues we are working through with Jay. Unfortunately,we have a serious
and escalating drainage issue that I am worried is not being appropriately addressed.
The evidence of the drainage issues is made apparent by the melting snow and rain and would appear to
be caused by: (a)the design of the sidewalk,the driveway and the landscaping on our property and (b)
the design of the driveway,the slope between our house and the Bergstrom house and the design of the
roof on the Bergstrom house.The consequences of these design and construction issues are: an
extremely dangerous section of driveway that puddles and ices in front of our garage, a dangerous and
constantly wet/icy condition on at least a third of the sidewalk and a wet lower basement entrance
(including a now warped double door).

The frustration we are experiencing is that we indicated our concern regarding drainage during
construction, particularly during excavation.We indicated to Matt that there seemed to be a high
potential for a drainage issues and were assured that all water would be properly routed around the
house. Matt is a great foreman, but your contractors failed to provide a safe driveway and sidewalk. We
are contacting you formally since there doesn't seem to be a formal plan in place to rectify these issues
when the ground thaws. Furthermore, we have serious concerns of flooding and additional damage and
erosion that will occur should we have a heavy Springtime rain.
The Driveway and sidewalk(see pictures): I wrestled with the driveway all winter keeping the snow/ice
off, adding some "safe" salts and sand, etc.While we were able to drive up and down the driveway,the
bottom was very dangerous because of the "pooling".We've had guests slip and we're concerned that
regardless of routine snow and ice removal we are going to have a serious accident.There isn't enough
slope to allow the water to runoff.The water should not collect and freeze such that walking is difficult

and dangerous in a section as wide as 15 feet out from the garage. Further water and ice forms in a
section 10'wide from the asphalt and should not collect along the sidewalk throughout the winter and
early spring.The design doesn't accommodate the seasonal freezing and thawing.
East side drainage(see pictures): The East side of our property is flat to sloped towards our house and
towards the lake such that the water is flowing through our retaining wall and into the Southwest corner
of the foundation. We are sure to have a "washout"within a relatively short time. Furthermore, it
appears that the West side of the Bergstrom property,their roof, and driveway is draining on to our
property. The drainage of water should not be coming from the Bergstrom property on to ours to the
extent that it has been draining. Ultimately,this condition combined with the drainage issues on our
property presents an even worse scenario for our retaining wall and basement flooding.This condition is
not only damaging the retaining wall but wetting and warping the siding and door.This condition needs
to be remedied including the replacement of the lower garage door. It is my understanding that
concurrent with the permits to build the Bergstrom house, LDK was notified of the potential drainage
problem by the city planners/engineers.
We expect to continue to work with Jay on various warrantee items which we have and continue to
summarize for him. In addition however,we would like to see a plan and implememtation schedule that
rectififies the drainage issues for our property and the Bergstrom property, (to the extent that it affects
our property) before LDK completes the driveway and additional work on the Bergstrom property.
