Chapin, County Auditor and Treasurer Deputy 17 Pkg ID 1082947M Doc Name: Resolution Document Recording Fee $46.00 Document Total $46.00 This cover sheet is now a permanent part of the recorded document. � O� O O CITY of ORONO ,•� RESOLUTION OF THE CITY COUNCIL �� Gtiti 6 2 1 3 NO. s804� A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR WETLAND ALTERATION PURSUANT TO ORONO MUNICIPAL CODE SECTION 78-1609 FILE NO. 12-3585 WHEREAS, Spring Hill Golf Club, a Minnesota nonprofit corporation (hereinafter the "Owner") is the owner of the property located at 1050 Tamarack Road within the City of Orono (hereinafter "City") and legally described as: Lot 1 Block 1, Spring Hill Golf Club, Hennepin County, Minnesota, Except That Embraced Within the South 1/2 Of The Northeast 1/4 Of Section 26 Township 118, Range 23, Hennepin County, Minnesota (hereinafter"the Property"); and WHEREAS, Tim Johnson (hereinafter the "Applicant") on behalf of the Owner has made an application to the City pursuant to Orono Municipal Code Section 78-1609 for a conditional use permit for wetland alteration (hereinafter the CUP ) in order to fill in portions of the wetland adjacent to the 13th hole also identified as DNR Public Water Wetland #837W (hereinafter the "Wetland"); WHEREAS, the Applicant proposes to mitigate for the impacts to the Wetland off-site via the purchase of banked credits as governed by the Minnehaha Creek Watershed District (hereinafter the "MCWD"); and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on March 18, 2013 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 12-3585. 2. The Property is located in the RR-1B One Family Rural Residential Zoning District which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'. Page 1 of 5 O O CITY of ORONO �., RESOLUTION OF THE CITY COUNCIL NO. 6 ? 1 3 �`9kESHo4� 3. The Spring Hill Golf Club operates pursuant to Conditional Use Permits approved by the City in 1997. 4. The Planning Commission reviewed this application at a public hearing held on March 18, 2013 and recommended conditional approval of the CUP based on the following findings: a. The Spring Hill Golf Club property. contains 203.45 acres in total; 155.25 acres within Orono and 48.2 acres within Medina. b. The application was reviewed based on the following plans by James R. Hill (hereinafter collectively the "Plans"): i. Sheet 1.3 Drainage Maps dated 12/06/12 ii. Sheet 2.1 Erosion & Sediment Control Details dated 12/06/12 iii. Sheet 3.1 Grading, Drainage, Utility and Erosion Control Plan dated 12/06/12 iv. Sheet 4.1 Wetland Calculations dated 12/06/12 v. Sheet 1.1 City of Orono Wetland Buffer Calculation dated 01123/13 c. The Applicant has received Sequencing approval by the Technical Evaluation Panel (hereinafter the "TEP") pursuant to Wetland Conservation Act (hereinafter "WCA") regulations in order to conduct the filling activities. d. The TEP recommended mitigation for the wetland filling activity at a 2 to 1 ratio pursuant to WCA requirements. e. The TEP recommended the mitigation be done off-site via purchased wetland banked credits. The City understands the reasons for this recommendation are as follows: i. The adjacent wetland is dominated by narrow-leaved/hybrid cattail and reed canary grass (invasive species). In order to prevent the migration of these invasive species, significant vegetation management in the adjacent wetland would be necessary; ii. The adjacent wetland is a MnDNR Public Wetland; approval of vegetation management in that wetland may be problematic. Per WCA rule 8420.0522 subp. 5, the presence of invasive species will not allow any replacements credits to be granted; and iii. The existing wetland to be filled is degraded to the point where replacement of it with a better quality wetland off site would result in a certain gain of function and public value, i.e. an environmental benefit. The proposed on-site borrow area shown to the south of the wetland is shown to be graded to the same contour as the Wetland and seeded with buffer vegetation. Because of its proximity to the Wetland, the wetland vegetation will migrate to this area, and it will most likely become a low grade wetland in the future. The area will still provide the same stormwater treatment and rate control as originally proposed. g. The mitigation provided by the borrow area results in a minimization of the proposed impacts from an original 0.71 acres to 0.42 acres. The proposed plan proposes an additional 12,181 square feet of native buffer above the minimum required. h. The MCWD Board would be reviewing the application for placement of fill within the Wetland and a variance to the MCWD requirement for on-site mitigation at a meeting to be held on March 28, 2013. This application was reviewed as MCWD application number 12-348. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the Applicant, the conditional approval of MCWD application number 12-348 by the MCWD Board, and comments from the public, as well as the effect of the proposed conditional use on the health, safety and welfare of the community as well as the impact on properties in the vicinity. 6. The City Council finds that the wetland alteration is in accord with the objectives of the RR-1B zoning district in which the Property is located and with the comprehensive municipal plan and that the wetland alteration will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants approval pursuant to Orono Municipal Zoning Code Section 78-1609 for a CUP for wetland alteration in order to fill in portions of the Wetland, subject to the following conditions: 1. Council approval is based on the Plans submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits A through E: Any amendments to the Plans which are not in conformity with City codes will require further Planning Commission and City Council review. The Applicant shall provide the City with the digital wetland boundary (post-fill) in Hennepin County coordinates to finalize the rezoning prior to the release of the escrow. 3. Submittal of all required MCWD permits indicating approval of the project shall be required prior to the issuance of the administrative land alteration permit (Zoning Permit) by the City. 4. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by obtaining an administrative Zoning Permit for the project and commencing said project. The project must be commenced within one year of the date of Council approval, or the CUP will expire on that date (April 8, 2015). 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. The undersigned Owner has read, understands and hereby agrees to the terms of this resolution and on behalf of the Owner and the Owner's heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property.
