Sec.13.04 RIGHTS OF SUBJECTS OF DATA I �
Subd. 1. Type oF data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this secaon.
Subd.2. Information required to be given indivfdual, pn i�ividual asked to supply private or confidential data concerning himself
shall be informed of: (a)the purpose and intended use of the requesud data withit►the collecting state agency,polidcal subdivision,or statewide
rysum;(b)whether he may refuse or is legatly required to supply the requesud data;(c)any lrnown consequeace arising from 6is supplying or
refusing m supply private or confidential data;and(d)the identity of other persons or enaaes authorized by state or federal law to receive the data.
T6is requirement shall not apply when an individual is asked to supply investigative data,pursuant to section 13.82, subdivision 5, to a law
enforcement o�cer.

Subd.3. Access to data by individual. Upon request W a responsible authoriry,an individual shall be informed whether he is the
subject of stored data on individuals,and whether it is classified as public,private or confidendal. Upon his further request,aa individual who
is the subject of sWred private or public data on individuals shall be shown the dara without any charge W him and,if he desires,shall be inforuted
of rhe content and meaning of that data. After an individual has been shown the private data and informed of its meaning,the data need not be
disclosed w him for six months thereaf[er unless a dispute or acaon pursuanc W this section is pending or addieonal dara on the individual has been
collected or creared. The responsible authoriry shall provide copies of the private or public data upon request by the individual subject of the data.
The responsible au[hority may require the requesring person to pay the actual cosu of making,certifying,and compiling the copies.
Tl�a responsible authoriry shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days
of the dace of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with
the request within that time,he shall so inform the individual,and may have an addiaonal five days within which to compty with the request,
excluding Saturdays,Sundays and legal holidays.
Subd.4. Procedure when data is aot accurate or complete. An individual may contest the accuracy or completeness of public or
private dara concerning himself. To ezercise this right,an individual shall aotify in wriang the responsible authoriry describing the flature of the
disagreemenG The resporuible authoriry shall within 30 days either: (a)correct the data found ro be inaccurate or incomplete and attempt to notify
past recipiencs of inaccucate or incomplete data,including recipients named by the individual;or(b)no6fy the individual that he believes the data
to be coaect. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data.
The dererminaaon of the responsibte authoriry may be appealed pursuant to the provisions of the administrarive procedure act relaang
to contesud cases.
