Sec.13.04 RIGHTS OF S[JBJECTS OF DATA
� Subd. l. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set fortlt in this sec6on.

be informed of: (a)the pucpose and intended use of the requested data withiir the collecting State agency,poliacal wbdivision,or statewide system;
(b)whe[her he may refuse or is legalty cequired W supply the'requested data;(c)any known consequence arising frotn his supplying or refusupg[o3upply
priva�e or confidential data;and(d)the idenary�'other peraons or endries aurhorized by state or fedecal law w receive the data,.This requitement shai�
not apply when an individual is asked to suppty investigative data,pursuant ro section 13.82,subdivision 5,to a law eafo[eeuieat.-affieec. .

Subd.3. Access to data by ladividual. Upon request to a responsible aurhoriry,an individual shall be info�w6ether he is the subject
of storcd Aata on individuals,and whether it is classitied as public, private or co�dendal. Upon his further request,an individual w6o is the subject
, of storcd private or public data on individuats shall be shown che data wi[hout,any charge to him and, if 6e desires,shall be informed of the content
and meaning of that data. After'an individual has been shown the private data and iaformed of its meaning,the data need noc be disclostd to him for

The responsible authority shall pcov�e copies of the private or public data upon roquest by the individual subjxt of the data. T6e responu'ble authoriry
may require the requesting person w pay the actual costs of making,certifying,and compiling the copies.
The responsible authority shall comply immediately,if possible,with any aquest made pursuant to this subdivision,or within five days of
the date of the request,ezcluding Sadt�days,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with du request
within that time,he shall so infotm the individual,and may have an addidonal five days within which to comply with the requesc,excluding Sadtrdays,
Sundays and legal holidays.
Subd.4. Procedure wlxn data is not accurate or complete. An individual may contesc the accuracy or completeness of public or private
data conceming himself. To eaercise this right,an individual shall nodfy in wridng the responsible authoriry des�ribing the nadtre of dte disagreement.
The responsible authority shall within 30 days either: (a)correct the dara found to be inaccurate or incomplete and auempt to notify past recipients of
inaccurate or incomplete data,including rocipients named by the individual;or(b)nodfy the indi�•idual that he believes the data ro be comect. Data
in dispute shall be diulosed only if the individual's statement of disagreement is included with the disclosed data.
The determination of the responsible authoriry may be appealed pursuant to the provisions of the administrative procedun act relaang to
contested cases.

SUBJECT: Review for Special Consideration within the Sugar Woods Plat
2102 Sugarwoods Drive (Todd and Anita Kimmes)
The City Council has approved a special review procedure for requests that do not meet the
covenants and special zoning requirements within Sugar Woods. The Planning Commission
assumes the sole responsibility for the review and final recommendation regarding requests for
special consideration. The applicant however, does have the right to appeal a Planning Commission
decision to the City Council at their next available meeting.
Please review the attached Supplemental Sheet to Building Permit Application for Residential
Development within Sugar Woods (Exhibit G). Please pay special attention to paragraph 3 and
Attachment B.
Todd Kimmes has submitted a Building Permit application for Lot 2, Block 4 (2102 Sugarwoods
Drive) for a new residence. The special conditions placed on the development require any
improvements that occur on the property must do so within the required building setback. Setback
requirements for this lot are front 50', rear 50' and side 30'. The proposed driveway is a hardcover
improvement and would be required to meet the 30' setback by the approvals granted within the
subdivision. Applicant is requesting a driveway 10' from the side property line.
Please review the attached letter submitted by the applicant explaining the special conditions that
apply to the property (Exhibit D). Letters supporting the plan have been submitted by the adjacent
property owner and the Architectural Committee of Sugar Woods. They are attached as Exhibits E
and F.
PLANNING COMMISSION ACTION REQUESTED
Motion to approve or deny the request for special consideration to allow a driveway to encroach 20'
into the required 30' side yard setback.

Dear Ladies and Gentlemen,
We would like to submit to the City of Orono,a request for a waiver for our driveway
encroachment into the side setback of our lot at 2102 Sugar Woods Drive. We are
seeki.ng permission to allow construction of a side load garage tha.t will cause the
dtiveway to exceed by 18 feet,the setback specifieations on the south side of the lot. The
resulti.ng driveway will be 12 feet from the property line. We are in compliance with all
other setback specifications, including the restriction which mandates that the driveway
be no more than 20 feet wide as it passes through the front setback area.
Our pie-sha.ped lot has a relatively narrow area along the street. Movement of the house
in any direction will cause the loss of 2 very large trees that we would certainly prefer to
save. 'Phe current placement of the driveway is such that no large trees will be lost.
We understand that numerous variances have been granted in Sugar Woods to permit side
load garages. We also ask that you take into consideration the accompanying letters from
the neighboring property owner and the President of the Sugar Woods Homeowners
Association. They have both expressed their approval of our request.

In addition to the plans, specifications and information
requested in the Orono Bui�ding Permit Application packet, the ,
foilowing is required by speciai resolution of the Orono City
Council of a� l applicants seeking to obtain a buiiding permit
within the Sugar Woods subdivision:
l. Your site pian must designate the Specific Building Setback I
Area for your Iot. '
A) front 50' , rear 50' and side 40' for Lots 1 through
4 , B�ock 1; and
B ) front 50' , rear 50' and side 30' for aIi other lots
in B�ocks 1, 2 , 3 and 4.
2. Per Orono resolution #2652, each Iot sha11 be served by a
single driveway/one curb cut at a 20' maximum allowed width.
The driveway width sha�l be measured parallel to the Ioop
road, Sugarwood Drive. The portion of the drive 7ocated
within the front/street setback area shal� be placed in a
straight alignment from the I.00p road and shall not be
curved.
3. An inventory of aIl hardcover on the lot must accompany
each application (see worksheet attached, Attachment A).
AII. hardcover improvements on each Zot shall. be within the
building pad defined as that portion of the Iot that is not
within the building setback area (exception: the driveway
Ieading to Sugarwoods Drive Iocated within the front
building setback area, retaining walls and similar Iand-
scaping structures that may be built within the front
bui�ding setback area). The hardcover improvements for each
Iot shaZl. not exceed 80$ of the area of the building pad for
each �ot. The hardcover areas of each Iot shall include the
surface area on the ground of each of the foliowing ,
improvements on the Iot (the inventory shall include allowed

A) Footprint of each and every structural improvement
on the Iot, incl.uding each house, garage,_ accessory
building, porch and covered wa�kway;

underliner is impervious or not ) , but not those

Lot Coverage. Per Ordinance 80, 2nd Series adopted February '
26, 1990, the- total combined footprint areas of a1I {

be included in calculation of Iot coverage by structuresi

6. For aII app3.icants who find they cannot meet the required
standards for development within the Sugar Woods Planned
Residential Development, �please refer to Attachment B for
special directions.
7. Written confirmation from Rebers Construction that the
building plans and site plan have been approved by the
Architectural Reniew Co�aittee for Sugar Woods.
� At the time a Certificate of Occupancy is issued for a new
dwel3.ing within the subdivision of Sugar Woods, the City has
agreed to execute and deliver to the o.wner of each l.ot a partia�
release of subdivider's agreement for that Iot. Upon the
recordation of such partia3. release of subdivider's agreement,
the Registrar of Titles is authorized and instructed to remove
from the Certificate of Tit3.e for the Iot, the memorial of this
instrument and the memorial of the partial re�ease of

AI3. owners' or builders' seeking special consideration must
submit a written request to the Zoning Administrator 7 days
before the official P3.anning Commission meeting for the month
(third Monday of the month). The City Council. of Orono has `
approved an abbreviated. review process for a13. such request
whereby the Planning Commission shall assume the sole
responsibility for the review aad fina� recommendation regarding
these special requests. Each applicant sha3.I have the right of
