As a representati�e of the Kileen's Im requestin�a variance for the driveway. Attached is the proposed site/grading plan which illustrates the following reasons for this request: 1. The curving of the drive as shown will preserve more of the mature trees that will need to be removed if the drive were to conform with the required 30'-0" side yard setback. 2. The existing grade of the site at the dri�e location is nearly 17% which is too steep for a dri�eway. By lengthening the drive we were able to decrease the grade to 13 °lo at the steepest point and provide a relatively flat parking area at the garage and waiting area at the street. 3. The residence has been located on the site to minimize the impact on both the existing neighbor to the east(the Simonds ) and the future neighbor to the west. Also attached is a letter from the Simonds,the property owner to the immediate east,wham this �ariance will be impacting. This letter states that they have re�iewed the proposed site plan and approve of this request. The Kileens and myself will be attending the planning commission meeting on Monday April 19, 1993. Simonds Letter D - Location Map E - Site Plan/Topographic Mapping F - Floor Plan/Elevations Discussion The future owners of Lot 5, Block 2 seek special consideration in the placement of the driveway to serve the proposed residence. Tim Johnson of Johnson and Associates, Architects shall represent the applicants at the meeting. Please review his addendum, E�ibit A, submitted for Planning Commission's consideration. The applicant has provided necessary exhibits to support the request. The exhibits include the survey locating all proposed improvements, topographic both existing and proposed, inventory of hardcover, and the location of mature unique tree specimens on property. Issues 1. The driveway is curved within the 50' front/street setback area and not in a straight alignment. 2. The driveways as it proceeds southward encroaches within required 30' side setback area where no such encroachment is allowed. Thomas Kileen April 15, 1993 Page 2 As part of the formal procedure developed by the City for the review of these requests, if Planning Commission denies applicant's request, the applicant may appeal the Planning Commission's decision at the next upcoming meeting of the Council, April 26, 1993. Planning Commission members may find it helpful to review the attached Exhibit B of the Sugaz Woods development. The handout reviews the procedure for all applicants seeking special consideration. : x. � t . � � � SIIPPLEMENTAL SHEET TO BIIILDING PERMIT APPLICATION FOR RESIDENTIAL CONSTRIICTION WITHIN THE PLANNED RESIDENTIAI� DEVELOPMENT OF SIIGAR WOODS SIIBDIVISION In addition to the plans , specifications and information requested in the Orono BuiZding Permit Application packet, the foZlowing is required by special resolution of the Orono City Council of all appiicants seeking to obtain a buiiding permit within the Sugar Woods subdivision: 1. Your site p�an must designate the Specific Building Setback Area for your �ot. A) front 50 ' , rear 50 ' and side 40' for Lots 1 through 4 , Block 1 ; and B ) front 50 ' , rear 50 ' and side 30 ' for aIi other Iots in Blocks 1 , 2 , 3 and 4. 2. Per Orono resolution #2552, each Yot shall be se_rved by a single driveway/one curb cut at a 20' maximum aZlowed width. The driveway width shall be measured para�Iel to the loop road, Sugarwood Drive. The portion of the drive Iocated within the front/street setback area shall be placed in a straight alignment from the Ioop road and shall not be curved. 3. An inventory of a1.I hardcover on the Iot must accompany each application (see worksheet attached, Attachment A). A11 hardcover improvements on each Iot shal I be within the building pad defined as that portion of the Iot that is not within the building setback area (exception: the driveway Ieading to Sugarwoods Drive Iocated within the front building setback area, retaining wails and similar Iand- scaping structures that may be buiit within the front buil.ding setback area). The hardcover improveinents for each Iot shaZl not exceed 80� of the area of the building pad for each Iot. The hardcover areas of each Iot shal�. inciude the surface area on the ground of each of the following improvements on the 3.ot (the inventory shall include allowed improvements within the front/street setback area) : A) Footprint of each and every structural improvement on the Iot, including each house, garage, accessory building, porch and covered walkway; B) A�1 wooden decks and boardwalks regardless of the spacing between the planks on the surface; C) AZI driveways and parking areas that are paved or graveled; E} A13. walkways and patios that are covered with asphalt, concrete, paving blocks (regard�ess of the space in between the blocks ) , or covered with gravel , rock or woodchips upon an underZiner (whether the underliner is impervious or not ) , but not those walkways that are dirt, grass or gravel , rock or woodchips without an underliner; ; �� ,_ ' . F) Each and every Iandscaped area with an underliner (whether the underliner is impervious or not ) , regardless of whether the area is covered with woodchips , stones , dirt or plants ; G) Any swimming poo 1 or wading poo i; H) Any tennis court covered with concrete, asphalt or clay, but not any tennis court covered with grass. 4. Lot Coverage. Per Ordinance 80, 2nd Series adopted February 26 , 1990 , the total combined footprint areas of aiI principal and accessory structures shall not exceed 15� of the 1 acre aneraqe density at 6,534 sf. The following sha�I be included in calculation of Iot coverage by structures: a) aZI roofed structures which extend more than 6' above grade 1eve1 ; b) tennis courts, patios, decks and aIi similar open structures when partially or fully enclosed by f ences , rai I ings or wa I i s which extend more than 6' above grade Ievei ( if any portion of such structure extends more than 6' above grade level, the entire structure shail count towards Iot coverage ) ; c) pools, including pool basin and associated deck or patio areas , regardless of whether such pool basin, deck or patio is enclosed with a fence. 5. AlI lots shall be provided with a functional means or method of backing out. The City wi I1 not approve the backing out of motorized vehicl.es onto Sugarwood Drive. 6. For a�.l appiicants who find they cannot meet the required standards for development within the Sugar Woods Planned Residential Development, please refer to Attachment B for special directions. 7. Written confirmation from Rebers Construction that the building pians and site plan have been approved by the Architecturai Review Committee for Sugar Woods. , At the time a Certificate of Occupancy is issued for a new dwelling within the subdivision of Sugar Woods, the City has agreed to execute and deliver to the owner of each Iot a partiaZ release of subdivider' s agreement for that lot. Upon the recordation of such partial release of subdivider's agreement, the Registrar of Titles is authorized and instructed to remove from the Certificate of Title for the Iot, the memorial of this instrument and the memorial of the partial release of subdivider' s agreement. Please contact the Building and Zoning Department (473-7357) if you have any questions concerning the directives Iisted above. Prior to an site preparation, tree cuttinq, Iand alterations or construction, the Building Setback Area must b� defined on the site with plastic or wooden snow fencing. Pianning Commission meeting for the month (third Monday of the month) . The City Council of Orono has approved an abbreviated review process for aIi such request whereby the P3.anning Commission shail assume the sole responsibility for the review and finai recommendaticn regarding these specia� requests. Each applicant shalZ have the right of appeal before the Council of aII decisions of the Planning Commission. AII appeal.s to the Council shalY be placed on the Council agendas for the following Monday (fourth Monday of the month) . Applicants may find that the strict enforcement of these special requirements for residential development to not be practicai nor functional when certain site conditions are found within a building Iot. The following site conditions are 3.isted below as examples to assist applicants in the preparation of their specific request: 1. the shape or Iimited area of a buiiding envelope; 2. unique or mature trees within a building envelope or front/street setback area; 3 . the topography of a building envelope; 4. desire to place house within a building pad so as to minimize impact on adjacent properties.
