A RESOLUTION GRANTING PRELIMINARY APPROVAL OF A CLASS III SUBDIVISION FOR PROPERTY LOCATED AT 60 STUBBS BAY ROAD SOUTH FILE NO. 08-3355 WHEREAS, Clement Kroll and Winnifred Kroll, husband and wife, ("the Owners") are the owners of property legally described as Lot 1, Block 2, Betz Addition, Hennepin County, Minnesota("the Property"); and WHEREAS, Tim Hauser ("the Applicant") on April l, 2008, filed a formal subdivision application with the City for approval of a four lot residential plat of the Property; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.35$ et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono Planning Commission held a public hearing on April 21, 2008, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, at their regular meeting held on May 12, 2008 the Orono City Council considered the subdivision application of the Applicant noting the following findings of fact: 1. The Property contains a total of approximately 8.9 acres of land. 2. None of the Property is delineated wetland but some of the Property may fall within the required buffer for a wetland on adjacent property. 3. The property is located within the RR-1B One Family Rural Residential zoning district requiring a minimum of 2 acres of contiguous dry buildable land within each newly created building lot. 4. The proposed plat consists of four residential lots, each meeting the minimum lot standard requirements of the RR-1B, One Family Rural Residential zoning district. 5. A single family residence currently exists within proposed Lot 1. The subdivision of the property would not create any violations of zoning code regulations for this house. The proposed lots will be served with septic systems and private wells. Primary and alternate septic sites meeting all pertinent standards have been identified for all lots. 7. Access will be from Christine Drive, an existing private road. NOW, THEREFORE, BE IT RESOLVED, that based on the findings noted above, the City Council of the City of Orono hereby approves the preliminary plat application of per preliminary plat drawings by Mark Gronberg dated March 14, 2008, subject to the following conditions: 1. The Owners shall grant to the City 10 foot drainage and utility easements along perimeter property boundaries and 5 foot drainage and utility easements along all interior property boundaries. 2. Owners shall grant a drainage easement to allow the overflow from the wetland on the property to the north to reach the existing culvert under Christine Drive. 3. The Owners shall execute a Flowage and Conservation Easement and Restrictive Covenant for Wetland Buffer if any of the 50 foot buffer from the wetland on the adjacent property falls within the Property. 4. Payment of the standard park dedication fee for Lots 2, 3, and 4. 5. Payment of standard storm water and drainage trunk fee for the entire plat. 6. Notwithstanding the requirement that private road cul-de-sacs serving seven or more lots be 28 feet wide, the existing 25 foot wide roadway of Christine Drive does not have to be widened at this time. Neither does the bituminous curb have to be replaced with concrete curb. 7. The Owners and Applicant are hereby advised that preliminary subdivision approval will expire on June 23, 2009, one year from the date of City Council approval. Should the Owners or Applicant fail to complete the filing of the final plat application within the year deadline, it shall be necessary for the Owners or Applicant to file a new preliminary subdivision application with the City. These submittals are as follows: 1. Application for Final Plat Approval. 2. Three prints of the proposed final plat. Drawings to include: a. The name of plat. b. Lot lines platted per preliminary survey by Mark Gronberg. c. Drainage and utility easements 10 feet wide along the exterior boundaries of the plat and 5 feet wide along the internal lot lines. . d. A drainage easement over the overflow swale from the wetland. 3. Legal documents required: a. Title opinion addressed to the City. b. Certified copies of all recorded easements currently affecting the property. c. Signed and executed septic sites covenant. d. Developer's Agreement. e. Signed and executed Flowage and Conservation Easement over the wetland buffer, if any. 3. Fees to be paid (subject to change): a. Final plat fee=$250.00 b. Stornwater/Drainage Trunk Fees= $28,480 d. Park Dedication Fee = $9,750 - $16,500, based on land value at time of final plat application 4. Stormwater .plan conditional approval or permit from the Minnehaha Creek Watershed District.
