Sec.78-1601 of Orono's Wetland Protection Ordinance,the proposed pool construction on the above listed property triggers the city's ordinance due to the following: • Disturbed property drains towards a wetland. • Grading exceeds 50 cubic yards. • Net increase in the square footage of impervious surface area. The wetlands found on this property have been classified as preserve and manage 3 wetlands, which require a 50 foot and 16.5 buffer respectively. Based on an 8 May 2007 field inspection, and review of the submitted pool building plans,the pool will be situated outside of basin#1's 50 foot buffer and 20 foot setback. Construction of the pool should not impact basin#1. Basin#2 may be impacted by a driving area that appears to be within the wetlands 16.5 foot buffer,this is described below. The following is a summary of remaining issues regarding wetland basin#1: Per Division 3. Sec.78-1605(b. 2}the buffer surrounding basin 1 contains unacceptable buffer vegetation due to large amounts of buckthom and a lack of herbaceous ground cover(a result of shading caused by the buckthorn shrubs). Unacceptable plant species(mainly buckthom)should be removed by hand-as large mechanical equipment may further disturb the wetland buffer. Following buckthom removal,all bare areas should be seeded with an approved native seed mix containing a minimum of four species of native grasses and five species of native forbs at a rate of 12(PLS} pounds per acre (seed mix should be submitted for approval pnor to planting). All silt fences should stay in place(outside the wetland buffer)during pool construction to protect wetland basin#1 from sediment. Issues regarding wetland basin#2: Per Division 3. Sec 78-1605 (b. 2)the buffer surrounding basin#2 also contains unacceptable buffer vegetation due to the presence of buckthorn,reed canary grass, and garlic mustard. Unacceptable species should be removed by hand or with appropriate herbicide(herbicide should be approved for use near water and be applied by a certified applicator)and the remaining bare areas should be reseeded with an appropriate mix of native species(explained above). It also appears that some disturbance has occurred in the buffer of basin#2 due to construction activities(a driveway to the north of the basin). Once construction has been completed,areas disturbed within the buffer of basin#2 must be replaced by planting a mix of native grasses and forbs(see requirements for seed mix above). It was also noted that mowing may be occurring in the buffer,this is unacceptable per Division 3 Sec 78-1605(b). Mowing should be stopped in order for the buffer to establish proper vegetation that will increase the buffers filtering function. All silt fences should stay in place(outside of the wetland buffer)during construction activities to protect basin#2 from sediment. To ensure all are aware of wetland buffer boundaries(and for compliance check purposes)the boundaries should be accurately marked in the field and GPS locations outlining the wetland buffers should be submitted to the city in county coordinates. It is our recommendation that the city withhold an escrow in the amount of$4,850.00 for buckthorn removal and the native seeding.
