Based upon the materials you submitted this morning, no erosion control permit would be required,so long as the
project remains under 5,000 square feet of disturbance and 50 cubic yards of excavation. Though no permit is required,
the District still encourages the incorporation of erosion control practices such as the installation of silt fence or tree

On July 10, 3013 the City received a zoning and building permit applications for landscaping and construction of an
arbor at the above property. We have nearly completed with our review and require a couple of additional pieces of
information before we can issue the permits.
1. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement
to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will
guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required
escrow amount for this project is$2,500. The escrow agreement is enclosed. The property owner must sign
the escrow agreement and submit a check for$2,500.
. 2. Minnehaha Creek Watershed District (MCWD). Your project may trigger the MCWD's permitting
requirements; please contact the MCWD regarding your project. Please note,the City of Orono will not issue
a building permit without a copy of MCWD permits or documentation from the MCWD stating the proposed
project does not trigger any of their permitting requirements.
The property owne�'s must sign the building permit and zoning permit applications. Please have one of the owners
stop in to sign the applications before we issue the permits. We are open Monday—Thursday 7:30 am to 5 pm and
Friday 7:30 to 11:30 am.

I can approve the permit for 300 Stubbs Bay Rd but on the as-built survey they need to include the landscaping plans
and all the top of wall (TW)and bottom of wall elevations (BW) on the plans.
Also if the walls are installed over 4' in height or tiered walls are over 4' in height and are not separated by more than 2x
the height of the walls, then the applicant will need to submit engineered plans and specifications signed by a registered
professional engineer.

AGREEMENT made this l`��day of � , 2013, by and between the CIT1f OF ORONO,
a Minnesota municipal corporation{"City")Tom&Susan Fleming("Owners").
Recitals
1. A building permit and zoning permit appiication has been filed for an arbor and landscaping
iocated af 300 Stubbs Bay Road North the("Subject Property"), legalfy described as Lot 1, Block 1, Tamaradc
Hill, Hennepin County Minnesota.
2. Owners request the City to review this appiication.
3. The City wili commence iks review af the applicatian and 'mcur costs associated wfth said review
only if the Owner estabfishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
7. DEPOSIT OF ESCROW FUNDS. Contemporaneously wi� the execution of this Escrow
F�greement, the Owners shall deposit$2,500 with the City. All accrued interest,if any, shall be paid to the Clty to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the Ciry
for all out-of-pocket costs fhe City has incurred (inciuding p(anning, engineering, in excess of $500, or legal
cflnsultant review) or will incur in reviewing the plan. Eligibfe expenses shal! be consisterrt with expenses the
Ovmers would be responsible for under a building permit appiication. The escrow will alsa guarantee
reimbursement to the City for all out-of-pocket costs the City has incumed to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may a(so be used by the City to elimina#e any hazardous condfions associafed with the
work and to repair any damage to public property or infrastructure that is caused by the work(including planning,
engineering, or legal consultant review) associated wifh building permit #2013-00637 and zoning permit
#2013-00638 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in tum
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBUR3EMENT FROM ESCROW ACCOUNT. In tt�e event that the Owners do not make payment
to the City wifhin the timeframe outlined in#3 above, shall issue e Stop Woric Order until the Owners pay all expen�s
invoiced pursuant to #3. The City may draw from the escrow accouM without further approval of the Owmers to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be retumed ta the
Owners when the review has been completed and�nrtitnen notification is received from the Owners requesting the
iunds.
8. CERTIFY UNPAID CHARGES. If the projecE is abandoned by Owners,or if the eligible expenses
incurred by the City exceed the amount in escrow,the City shall have the right to certify the unpaid balance to the
subject.prope�Ey pursuant to Minn. Stat.§§415.01 and 368.Q12.

Dear Ms. Mattson,
I want to let you know that we remain extremely frustrated with the City of Orono. Orono has now had our Escrow of
$2,500 for over eight(8) months for a patio! Every city engineer and inspector that has come to our property indicates
"that their inspection for our job is a waste of their time". Once again we see that we will have to wait four more
months for someone to come out and look at a retaining wall that is a couple of blocks high and is at an elevation lower
than the pre-existing patio.
The bureaucracy and ridiculous nature of the requests based on the policies you have to follow are the reasons more
people in Orono do not get permits for their work. If the City Council is trying to manage building appropriately it should
put in policies that are appropriately sized the for the work being done. There are many families where being out of
pocket$2,500 for a year to build a patio would be an immeasurable hardship. The Orono permit rules are byzantine and
difficult to interpret. I have spent over$2,000 on permits and surveys alone to for this job.
My request is that you refund our$2,500 dollars now. There is not a measurement on the retaining wall that will not
pass muster and based on all the inspections that we have had to date. There will be no recourse needed by the city of
Orono based on getting a final measurement on the retaining wall height and a city engineer once again wasting their
time to walk into our back yard for the thirty(30) seconds it will take to approve this site. I will have the survey
company provide this information and the City Engineer can come out to our house once the snow melts,or I can shovel
the ten or so feet around the 3 course wall so it can be measured by the city engineer.
Please let me know how the City plans to proceed?
