Re: Buffer Ordinance Compliance
Remarks:
Per Division 1. Sec. 78-1601 of the Wetland Protection Ordinance, the proposed construction on this lot
trigger's the ordinance due to the following proposed work:
o Disturbed property drains towards the wetland.
o Grading exceeds 50 cubic yards.
o Net increase in the square footage of impervious surface area.
• Driveway as shown on 7/10/06 plan disturbs the wetland buffer area, however if access is created
from existing driveway on outlot A per plat conditions this impact may not occur.
• The wetland on this property has been classified as a preserve. This classification of preserve
requires a 50' buffer that should be protected during construction.
• The upland buffer has some invasive species such as prickly ash, however it also has a good
herbaceous layer and other natives that will provide filtering of nutrients and habitat thus
recommend preserving the vegetation in the buffer rather the requiring disturbance for seeding.
• A silt fence is being installed to protect the wetland and buffer area during construction. The
property owner has approximately 50 feet of space that can be disturbed for turf prior to the buffer.
It is recommended that signage or other markers are placed on the upslope edge of the buffer so
the property owner is aware where the buffer starts. If encroachment occurs into the buffer the
disturbed areas should be revegetated according to the city's ordinance.

The wetland delineation done by John Vogt in 2000 is attached.
A condition of the plat was that this lot access via the existing driveway on Outlot A. I
told the builder to not change the survey until we have John's comments.
Here is another example of grading contortions to provide access to an overhead door
into the basement under the garage.

Recitals
A. The Owners have made land alterations at 300 Stubbs Bay Road North, Orono
(Lot 1 Block 1 Tamarack Hill)that included disturbing the buffer for a wetland on
the property.
B. The City is requiring a security agreement to guarantee the required re-vegetation
of the buffer is successfuL
C. Owners have agreed to complete re-vegetation cited above in a timely fashion.
Owners have agreed to provide financial security for the completion of the items
cited above by entering into this Escrow Agreement.
D. The City has determined that this Escrow Agreement constitutes adequate
assurances from the Owners, sufficient to protect the City from potential damages
and noncompliance with the City Code.
NOW,THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of
this Escrow Agreement, the Owners shall deposit $ D v�0 with the City, All accrued
interest, if any, shall be paid to the City to reimburse the City for its cost in administering
the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee that the
seeding of the buffer required as part of building permit number P 10094 is completed
properly and that any vegetation that does not establish successfully is replaced. A
planting is deemed successful if there is at least one native plant from the seed mix per
square foot in the seeded area. Areas where the planting is not successful shall be
reseeded by the end of the growing season. The funds shall be spent by the City if the
Owners for any reason are unable or unwilling to honor the requirements of the City Code
and any Development Agreement. Construction costs may also include engineering
estimates and plans as well as labor and materials for any repairs or matters completed.
3. REQUIRED IMPROVEMENTS. The following work is to be completed, as
detailed on the survey by Gronberg&Associates dated O1/07/08.

of any matter cited above that is not completed correctly and in a timely fashion, it shall first
make demand of the Owners to make any necessary repairs or to take other prudent
remedial measures within a 5 day time period. If the Owners are unwilling or unable to
honor the agreement as determined by the City, the City may draw from the Escrow �
Account,as necessary. The remedies afforded to the City under this agreement shall be in
addition to any other remedies which the City may be entitled by law or equity or other
agreement.
5. CLOSING ESCROW. The escrow, less any eligible expenses, shall be returned
to the Contractor one growing season after planting if the planting is successful. If
substantial portions of the plantings are not successful after one planting season the City
may hold the escrow for an additional planting season. The City will inspect the
plantings on or about July 31, 2009.
6. ACCESS TO PROPERTY. By separate document the Owners of 300 Stubbs

2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee that the
seeding of the buffer required as part of building permit number P 10094. Contractor is
completed properly and that any vegetation that does not establish successfully is
replaced. A planting is deemed successful if there is at least one native plant from the
seed mix per square foot in the seeded area. Areas where the planting is not successful
sha11 be reseeded by the end of the growing season. The funds shall be spent by the City if
Contractor for any reason is unable or unwilling to honor the requirements of the City Code
and any Development Agreement. Construction costs may also include engineering
estimates and plans as well as labor and materials for any repairs or matters completed.
3. REQ�7IRED IlVIPROVEMENTS. The following work is to be completed, as
detailed on the attached plans:
4. DI5BURSEMENT FROM ESCROW ACCOiTNT. If the City suspects or knows
of any matter cited above that is not completed correctly and in a timely fashion,it sha11 first
make demand of Contractor to make any necessary repairs or to take other prudent remedial
measures within a 5 day time period. If Contractor is unwilling or unable to honor its
agreement as determined by the City, the Ciry may draw from the Escrow Account, as
necessary. The remedies afforded to the City under this agreement shall be in addition to
any other remedies which the City may be entitled by law or equity or other agreement.
5. CLOSING ESCROW. The escrow, less any eligible expenses, shall be returned
to the Contractor two growing seasons after planting if the planting is successful. If �
substantial portions of the plantings axe not successful after one planting season the City
may hold the escrow for an additional planting season. If substantial portions of the
plantings are not successful after two planting seasons the CiTy may hold the escrow for
two additional planting seasons.
6. ACCESS TO PROPERTY. By separate document Steven and Elizabeth Bohl,
owners of 300 Stubbs Bay North, have granted to the City, its agents and its employees,
the right to enter on the Property for the specific purpose of inspecting or completing the
revegetation of the buffer should the Contractor not complete the work by the specified
dates.

Bruce Vang noticed and John Smyth confirmed that you have destroyed a portion of the wetland
buffer at 300 Stubbs Bay Road North by grading it. Happily the silt fence was moved first so the
wetland was not disturbed. The wetland buffer will have to be replanted before the final
occupancy permit is issued. Before a temporary occupancy permit is issued the restoration plan
and an escrow of$6,400 must be submitted to the City. Enclosed are John Smyth's report and
the escrow agreement. If you have questions about the restoration plan please contact him
directly.
Also enclosed is a wetland and wetland buffer easement and covenant. Now this must be si:gned
before the building permit is issued but the City Attorney had not completed drafting the basic
form at the time the permit for the house was issued. Please sign and return ONE copy. The

Remarks:
The following are next steps to bring 300 Stubbs Bay Road North into compliance with the buffer ordinance.
1. Have the survey crew re-located the upsiope edge of the buffer on either end of the graded area and stake
the site with the lath for the installation of future signs to be provided by the City. If it is difficult getting a
survey crew to the property the other option is to provide Bonestroo with the CADD drawing in County
coordinates and we can locate the buffer edge with our GPS unit. It is accurate within 1-foot. Costs
associated with this work would be passed through to the home owner.
2. Re-vegetate the disturbed area of the buffer with native seed or plants. As we discussed on-site with the
property owner (Mr. Bohl) there are several options for a native seed mixes that could be used on this site.
BWSR mix U1 is a typically used for upland buffers and contains native flowers and grasses, however
there are several other native mixes available from the following seed suppliers: Prairie Moon Nurseries,
Shooting Star Native Seed and Prairie Restoration. Prairie Moon Nurseries also has plant material
available for the garden area discussed.
3. Sediment that is built up on the silt fence should be removed prior to seeding. It can be re-spread on the
slope if done prior to seeding.
4. Due to the steep slope of the buffer the seeded area should be covered with Straw Blanket (2S). Straw
blanked is better then wood fiber blanket because it does not inhibit the growth of forbs (flowers).

Re: Buffer Violation
Remarks:
I reviewed the above referenced project site on December 6, 2006. The grading completed on-site extends into
the buffer and was not completed as shown on the grading plan. As a result the existing buffer vegetation that
was in place has been removed in a portion of the buffer that may be up to 0.4 acres in size. In order to be in
compliance with the City Buffer Ordinance this area should be seeded with a native seed mix (recommend
BWSR Mix U1) and blanketed with a straw blanket due to the slope. Site preparation, seeding and blanket
installation is estimated to cost up to $5,900. Consultant compliance reviews may be $500.00. It is
recommended that an escrow or letter of credit of$6,400 is held by the City until this work is completed.
Due to the encroachment into the buffer it is recommended that monument and/or signage be installed on the
upslope edge of the buffer so the property owner and contractors are aware of the buffer. The survey
consultant that completed the grading plan that shows the upslope edge of the buffer will need to stake the
upslope edge of the buffer in the field so the monument and/or signs can be located.

Re: Buffer Ordinance Compliance
Remarks:
Per Division 1. Sec. 78-1601 of the Wetland Protection Ordinance, the proposed construction on this lot
trigger's the ordinance due to the following proposed work:
o Disturbed property drains towards the wetland.
o Grading exceeds 50 cubic yards.
o Net increase in the square footage of impervious surface area.
• Driveway as shown on 7/10/06 plan disturbs the wetland buffer area, however if access is created
from existing driveway on outlot A per plat conditions this impact may not occur.
• The wetland on this property has been classified as a preserve. This classification of preserve
requires a 50' buffer that should be protected during construction.
• The upland buffer has some invasive species such as prickly ash, however it also has a good
herbaceous layer and other natives that will provide filtering of nutrients and habitat thus
recommend preserving the vegetation in the buffer rather the requiring disturbance for seeding.
• A siit fence is being installed to protect the wetland and buffer area during construction. The
property owner has approximately 50 feet of space that can be disturbed for turf prior to the buffer.
It is recommended that signage or other markers are placed on the upslope edge of the buffer so
the property owner is aware where the buffer starts. If encroachment occurs into the buffer the
disturbed areas should be revegetated according to the city's ordinance.

completion of native vegetation establishment for Mr. Bohl. Discuss encroachment of
retaining wall and garden into buffer. Provide options for rectification.
June 8, 2007—Email from Melanie to Mr. Bohl. Provide two options to replace lost
buffer from retaining wall and garden. Option 1: Expansion of buffer area directly down
slope from home at a 1:1 replacement ration. Option 2: Expansion of buffer in a
different area of the property at a 2:1 ratio. Explains that lower ratio is allowed directly
behind house because area is most impacted by runoff.
November, 2007 - Option 2 is chosen by Mr. Bohl. Submits necessary paper work and
survey to shift a portion of the buffer to another part of his property to make up for buffer
lost from garden and retaining wall. Provides updated survey of buffer location.
June 2008 —Mr. Bohl requests release of escrow.
June 24, 2008 —Melanie Curtis and John Smyth visit site to determine compliance. Sod
has been placed into buffer area which is a violation of the Wetland Ordinance. Per the
Wetland Ordinance buffers are required to contain native vegetation.
July 8, 2008—E-mail sent from John Smyth to Mr. Bohl indicating escrow cannot be
released until area of buffer which was recently converted to turf is restored back to
native vegetation. Provide a timeline of August 15, 2008 to have the work completed.
Indicate City may utilize escrow to have work completed if not done by August 15tn
August 25, 2008—Meeting with Steve Bohls, Melanie Curtis, Council Member Murphy,
and John Smyth. The escrow is agreed to be reduced and Steve Bohl commits to
establishing the buffer in the portion that was converted to turf grass.
August 27, 2008—On-site meeting with Steve Bohl and John Smyth. After a discussion
of approaches, Steve Bohl indicates he will eradicate the sod using round-up and plant
plugs of native vegetation at a 3 foot triangular spacing.
September 18, 2008—Melanie Curtis and John Smyth conduct a site visit. Work yet to
be completed.
