A RESOLUTION
GRANTING A VARIANCE TO ORONO MUNICIPAL CODE
SECTION 78-395
FILE NO. 12-3578
WHEREAS, Dennis M. Krump and Deborah Krump, a married couple,
(hereinafter "Applicants") are the owners of the property located at 25 Stubbs Bay Road
North within the City of Orono (hereinafter "City") and legally described as: Attached as
"Exhibit A", (hereinafter"the Property"); and
WHEREAS, the Applicants have made application to the City for a variance
from Orono Code Section 78-395(b) in order to construct an attached garage 29.2 feet from
the north, side lot line where a 50 foot setback is required; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission
held a public hearing on October 15, 2012, at which times all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #12-3578.
2. The Property is located in the RR-1A zoning district, where 5.0 acres is the
minimum lot area and 300 feet is the minimum defined lot width. The Property
is approximately 1.22 acre in area and has 123 feet in width.
3. The Planning Commission reviewed this application on October 15, 2012 and
on a vote of 7 - 0 recommended approval of the variance, based on the
following findings:
a. There is no additional property available for the Applicants to purchase
to make the Property conforming with respect to width.
b. The location of the existing home and the width of the property makes
it difficult to construct a functional, conforming garage addition
elsewhere on the Property.

c. The Applicants' request will alleviate a practical difficulty inherent to
the width of the Property and the location of the existing home on the
Property.
d. The practical difficulties associated with the Property were not created
by the Applicants.
e. The Applicants' request is in harmony with the purpose and intent of
the ordinance.
f. The proposed garage addition is consistent with the comprehensive
plan.
g. The proposal does not appear to alter the essential character of the
neighborhood
h. The garage addition does not appear to adversely impact adjacent
properties.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff,
comments by the Applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the community as well as the
impact on properties in the vicinity.
5. The City Council finds that the conditions existing on this Property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the Applicants, but is necessary to alleviate a
practical difficulty; is necessary to preserve a substantial property right of the
Applicants; and would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance to Orono
Code Section 78-395(b) in order to construct an enlarged replacement garage with a
basement beneath 35 feet from the front lot line where a 50 foot setback is required, subject
to the conditions listed below:
1. Council approval is based on the survey and building plans submitted by the
Applicants and annotated by City staff, attached to this Resolution as Exhibits B & C.
Any amendments to these plans may require further Planning Commission and City
Council review.
2. Permits from the Minnehaha Creek Watershed District (MCWD) may be required. If
necessary the Applicants shall submit copies of MCWD approvals to the City prior to
the issuance of a building permit.
3. The Applicants shall follow all of the City Engineer's recommendations with the
building permit application.
4. The building plans submitted are for the purpose of setback review. The construction
plans and survey submitted for building permit will be reviewed for conformance with
Orono's building height and number of stories calculation.
5. Authorities granted by this resolution run with the Property not with the Applicants, but
are permissive only and must be exercised by obtaining a building permit for the new
construction and commencing construction of said project. A framing inspection must
be completed within one year of the date of Council approval, or the variances will
expire on that date (October 22, 2013).
6. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any
authority granted herein, and shall be punishable as a misdemeanor.
7. The undersigned Applicants have read, understood and hereby agree to the terms of
this resolution and on behalf of their heirs, successors and assigns, hereby agree to
the recording of this resolution in the chain of title of the Property.
