One clarification: Under item#2, only one accessory building over 1000 s.f. is allowed (not required), and
it can't exceed 2600/3000 s.f. dependent on acreage; all other accessory buildings must be less than
1000 s.f. each, with the total square footage of all accessory buildings not exceeding the 5200/6000 s.f.
limit for the site.

In our varied discussions, you had four`areas of concern' relating to the property @ 4575 Spruce
Way. Following is a summary of what I understood after discussing those areas with Orono
representatives:
1. Water/Sewer Hookup--- Basically, to allow hookup to Medina sewer and to
Maple Plain water would require a `comp plan' update with the Met council for
that area; and would open up the door for higher density (1 to 4/acre) housing in the
area, which Orono does not want(re: in their attempt to maintain their open
spaces) for their housing. They are not interested in amending their"Comprehensive
Plan"I
2. House/Outbuildings and Horses--- If you have 9+ acres of land (excluding
wetland area), you are allowed a total of 6000 sq. ft. of outbuildings; but one building
must be over 1000 sq. ft. and no more than 3000 sq. ft. If you have 7-8 acres you are
allowed a total of 5200 sq. ft. of outbuildings; but one building must be over 1000
sq. ft. and no more than 2600 sq. ft. Regarding horses, Orono requires 3 acres
minimum to have A horse (1 acre for the house and 2 acres of pasture); and then 4
acres for two horses, 5 acres for three horses, etc. The pasture area cannot include
the primary and secondary septic system drain field sites.
3. Wetland Delineation --- I was told that they would listen regarding any wetland
delineation efforts provided it is done utilizing a qualified/experienced `Wetland
Delineator'; and 'Watershed'was consulted with an "agreement in principle". This
initiative could produce additional qualified acreage?
4. Pond discharge---Tom Kellogg from Bonostros (Oronos' City Engineer) informed
me that the area above ground was surveyed as a natural swale because he
understood it to be a wetland area between the pond and the "wetland". The first
thing would be to validate whether it is/is not a wetland? Assuming it is not a
wetland, there are several alternatives to getting the water from the pond to the
wetland area. E.G. One could run an underground pipe under the present
`surveyed swale' trying to maintain the present swale, relocate a swale to the east of
the property with pipe below it, etc. If the present swale is a wetland, then you
could mitigate the wetland to another area of the property allowing for a discharge
path for the pond waterl It must be noted that anything done must also have the
blessing of the 'Watershed DistricY, which is common protocol in the Metro area
(s)
Please note: #1, 2 and 3 was input from Orono's present`Planning Director' Michael
Gaffron; and #4 was with Tom Kellogg. Mike G. said that any future correspondence
must be with Melanie who has taken over his duties as Planning Director, as he has
undertaken a new role with Orono.

I've been looking into your questions on 4574 Spruce Way. To bring me more up to date, Mike Gaffron forwarded your previous email
chain to me (it is attached).
I cannot locate a wetland delineation for this property. Please us send a copy to put in the address file. The delineation should be
submitted to the MCWD for their review and approval. If you have not done this, it should be approved by the MCWD before making an
application to the City. Any changes to the wetland should be shown on the survey.
I understand that a potential buyer is interested in moving the existing drainage easement to an alternate location on the property. I've
outlined the steps to explore whether this drainage easement can be moved.
#1 -The establishment of an alternate over-land drainage easemenUswale location. Over land drainage is preferable. Sub-surface
piping alone or other below grade method will not be sufficient, or approved by the City. The new drainage swale would have to be
dedicated as a new drainage easement prior to vacation of the existing one. The Citys engineer would need to review and approve the
new easement and any alteration to the existing site. In order to do this the City requires additional information to be shown on the
survey.
1. Show existing topography and proposed grades;
2. Show all of the existing buildings—a possible location for the proposed home would also be helpful;
3. Show the driveway—existing and any proposed changes;
4. Show the stormwater pond on the survey including the outlet structure with overflow, outlet and weir elevations;
5. Show existing (and proposed)septic system. As I believe a new home is to be proposed,testing should be conducted and
two new, proposed 5-bedroom site designs must be submitted for review and shown on the survey. Contact Willie Gibbs,
Orono's Septic Manager, at 952249.4626 for more information.
#2—The second step is an application for a City grading permit to grade the new swale. The above revisions to the survey are
necessary in order for the City to review your grading permit request. An escrow in the amount of$500 is required for this type of
permit.
#3- Vacation of the existing drainage easement is the final step.
Please let me know if you have any questions. If the property owner is interested in this project I believe the best way to begin would
be a meeting between the owner/applicant, myself and the City's engineer. Having the necessary updates to the survey will make this
meeting more efficient.
