Re: Commercial Use of Residential Property
Dear Mr. Rudd:
The City has received complaints about the commercial use of your property. An inspection
revealed the following items being stored on the property.
1. Unlicensed inoperable vehicles
2. Piles of tires
3. Piles of auto doors,hoods, frames,wheels,body parts etc.
4. Construction equipment
5. Junk and debris
These iterns are obviously in storage for Elite Auto in Long Lake. This use is in violation of the
following Orono Zoning Code sections.
• Section 10.27, Subd. 2, "Permitted Uses" the only permitted uses are one family
detached dwellings, public owned parks,play grounds and municipal buildings.
• Section 5.40, Subd. 1, Home occupations, licensed required.
• Section 9.50 Junk cars. It is unlawful to park or store unlicensed/inoperable vehicles
on property.
Therefore,the City must require you to cease the commercial use of the property and remove all the
violations from the property before 12-2-98. If this deadline is not met the City will issue citations
and refer the matter to the City attorney for further legal action. If you have any questions or if you

§ 10 .25
Subd. 3. Additional Permitted Use. Within any "LR-1C-1"
One Family Lakeshore Residential Subdistrict a credit allowing a
50� increase in dwelling unit density over the "LR-1C" District may
be obtained providing all conditions below are complied with:
A. All provisions of Section 10. 32 P�anned
Residential Development are complied with;
B. Public sanitary sewer is available;
C. Al1 dwelling units must be attached but not more
than four dwelling units to any one structure with a maximum height
of thirty 30 feet;
D. Parcels of land lying beyond 100 feet from any
shoreline shall not have more than 35� of the land area to be
developed made impervious by buildings, blacktop, or other forms of
hard cover;
E. Building size and location meet Council
approval; •
F. Vehicle ingress and egress meet Council
approval;
G. A minimum of two parking spaces are provided for
each dwelling unit, one of the parking spaces shall be enclosed and
attached to the principal structure it serves;
H. Density provisions under Section 10.60 are not
exceeded.
Subd. 4. Area, Height, Lot Width and Yard Requirements.
(See Section 10 .25 , Subdivision 6) .
SEC. 10.27. RR-lA ONE FAMILY RURAI, RESIDENTIAL DISTRICT.
Subd. 1. Purpose. The "RR-lA" One Family Rural
Residential District is intended to provide a district whicri will
allow a combination of low density residential development and
limited agricultural activity.
Subd. 2. Permitted Uses. Within any "RR-lA" One r^amily
Rural Residential District, no land or structures shall be used
except for one or more of the following uses:
A. Any permitted use as regulated in the "R-lA"
District.
Subd. 3. Conditional Uses. Within any "RR-lA" One
Family Rural Residential District, no structure or land shall be
used for the following uses except by conditional use permit:
A. Uses. Any conditional use as regulated in the
"R-lA" District except for "Duplex Credit" and "Aninals" .
B. Farms (Stock) . Provided that the area is ten or
more acres.

SEC. 5.40. HOP� OCCIIPATIONS.
Subd, 1. License Required. It is unlawful for any
person to engage in, or carry-on, a home occupation, as that term
is defined in the Zoning Chapter of the City Code, without first
having obtained a license therefor from the City.
Subd. 2. Regulation. Licenses will only be issued if
the specific use is permitted or otherwise allowed by the Zoning
Chapter, and if all conditions set forth in said Chapter are fully

SEC. 5.41. MACE.
Subd. 1. License Required. It is unlawful for any
person to sell or distribute, at wholesale or retail, the substance
commonly referred to as mace , without first having obtained a
license therefor from the City.
Subd. 2. Limitations.
A. Only persons who are duly authorized and
licensed Federal firearms dealers shall be licensed.
B, This Section shall not apply to official sales
to, or purchases from, the City Police Department.

A. "Boat Slip, Water" means a s ucture , space,
dock or other thi designed or used for the cking, mooring or
storing of a boat emporarily or permanen y in or on water ,
including mooring pos , buoys or other dev ' es.
B. "Boat ip, Land" m ns a structure, space or
other thing designed or u d for st ring a boat temporarily or
permanently on land adjacent a la , whether it is located on or
off the licensed premises.
C. "Business of king, Mooring, or Storing Boats"
means renting or otherwise pr idi space, including boat buoys,
for docking, mooring or sto ng thre or more boats belonging to
persons other than the owne or occupan of the property.
D. "Com rcial Boat Dock H iness" means providing
space for docking, m - ring or storing boa��fo� r a fee, or boats
used in a trade or b iness, including, without�limitation, provid-
ing rented spaces, oat buoys, space for keeping�b ats owned by the
licensee and hel for sale, display, rental, or o� erwise used in
connection wit�tr�a boat or marina business , and s�i.ace held for
docking of bo :ts during or pending repairs or mainten�r�ce of said
boats. �

§ 9.50
SEC. 9.50. JQNR CARS, FIIRNITQRE, HOIISBHOLD FQRNISHINGS AND
APPLIANCES STORED ON PQBLIC OR PRIVATS PROP$RTY. It is unlawful to
park or store any unlicensed, unregistered or inoperable motor
vehicle lacking essential parts , household furnishings or
appliances, or parts or components thereof, on any property, public
or private, unless housed within a lawfully erected building. Any
violation of this Section is declared to be a nuisance and upon
seven days written notice to the owner, as show n by the records in
the office of the County Auditor, of private premises on which such
material is found, the City may remove the same and certify the
cost of such removal as any other special assessment. For the
purpose of this Section, an inoperable motor vehicle shall be
defined as lacking, including but not limited to, parts essential
to operation, such parts being wheels, tires, motor, drive train,
battery, or having two or more flat tires, or having the interior,
including the driver's position, used for storage in such a manner
that no person can operate the vehicle.
S$C. 9.51. ABANDONING A MOTOR VSHICL$. It is unlawful for
any person to abandon a motor vehicle on any public or private
property without the consent of the person in control of such
property. For the purpose of this Section, a "motor vehicle" is as
defined in Minnesota Statutes, Chapter 169.
SEC. 9.52. PROHIBITED USE AND PARRING OF MOBILE HOMBS AND
RECREATZONAL CAMPING VSHICLBS.
Subd. 1. Definitions. The terms "mobile home" and
"recreational camping vehicle" shall mean and include the following
definitions, and shall not include any manufactured housing unit
bearing a State of Minnesota Manufactured Housing seal or
certificate.
A. "Travel Trailer " - A vehicular , portable
structure built on a chassis, designed to be used as a temporary
dwelling for travel, recreational, and vacation uses, permanently
identified "Travel Trailer" by the manufacturer of the trailer.
B. "Pick-up Coach" - A structure designed to be
mounted on a truck chassis for use as a temporary dwelling for
travel, recreation and vacation.
C. "Motor Home" - A portable, temporary dwelling to
be used for travel, recreation and vacation, constructed as an
integral part of a self-propelled vehicle.
D. "Camping Trailer" - A folding structure, mounted
on wheels and designed for travel, recreation and vacation uses.
